    Great info.! Some of the deeds have a place to initial if your reserving the minerals. The people we bought the house and land from did not reserve them. The house and land had been in their family for many generations from the early 1800's. The guys mom passed away at 100 years olf, imagine that!
    Someone contacted us recently, asking if we would be interested in selling the mineral rights to our land.......nah, we just are not interested. I couldn't figure out exactly WHY anyone would want to buy mineral rights? This video helped me alot! Thanks

    I'm 26 and I inherited six sections of mineral rights in Oklahoma, texas and Kansas.
    My great great grandfather worked for Hess Oil and thats how we obtained the rights to miles upon miles of land.

    They can still come underground without your permission and extract minerals. Whole neighborhoods in Pennsylvania were destroyed when a coal company did just that. It was national news, and they showed really nice homes with walls cracking and even sidewalks and porches broken up and sagging deep into the soil because of it, and the coal company wasn't paying any compensation. I don't know how it ended up, but that's when I learned how hinkey mineral rights are.
    Same with fracking. They don't have to tell you what fluids they're using to frack because they made them a trade secret. Therefore, you can't take them to court on the basis of their polluting the environment, because you can't know what noxious chemicals they're using and you would have to list them in order to bring a case against them. So the aquifers, wells, and springs that they're polluting with these chemical solutions have no protection.
    Here's all you need to know about mineral rights: you have no rights, the mining and oil companies have them all. This will remain the case until a) such companies get sued out of business, and/or b) CEO's and other executives of these companies start serving multi-year sentences in prison, and/or c) Americans finally pull their heads out of their backsides and start demanding politicians who will change these laws and many others. Likelihood of this happening: 0.000%, especially option c.

      My family with held mineral rights from 2019 because dad abd i are medicaid. That money would have helped his vision and my life.
      I guess I hold 11 acres or 7/8 of something, what's that mean?
      Mineral owners often don't know they own anything...I'm a steward in life in all areas, I'm appalled at corporation snd my fellow humans for hindering my dad and I and our health. Dad died 11/11/2021. He suffered needlessly. Look at the thumbnail of the text in a video of mine. Greed. Meanwhile I'm trying to recover from mom and dads abusive siblings making fun of me, who does that? Family? That's family.😓. Drama and division meanwhile pple like me get blamed for things we had no clue existed. I love the earth and saw what others did with steel. I suffered needlessly in Ohio and WV and Oklahoma cleaned me up. I would have died there and both corp and family said no lease for me because I'm disabled. Why?

    Louisiana Mineral Rights are somewhat unique. Unlike other states, Louisiana mineral rights revert back to the original owner after 10 years from the date of sale or from the date of last production.

    i was looking at land for sale and some has '' mineral rights convey'' what does it mean? you purchasing the land with the mineral rights or only the land ?

      That means the mineral rights are included with the land.

    I know this is an old video, but got to ask. If you dont' have mineral rights would that prevent you from instaling water wells or septic systems? If you only own the surface sounds like this might be an issue.

      Excellent question. Water rights are specifically excluded from mineral rights. So, if you own the surface land, you can drill for water. And a septic system isn't drilling for a resource, so you can still install one.

      Fracking is simply a method to attain minerals. Just like drilling a well or building a mineshaft. All the laws of mineral rights still apply.

    You mentioned that its a lot better for individuals to have mineral rights instead of the government. Can you explain why?

      Because that is what the Founders intended.
      America was created on the notion of individual freedom and liberty. The federal, state, county and city governments, which are an unquestionably necessity, are only supposed to have minimal involvement in the day-to-day affairs of United States citizens. The Founders encouraged the individual to control such resources, not the government. Nevertheless, the government should be there, to protect those interests, as Alexander Hamilton noted in Federalist Paper #11, the troubles that could arise without such security:
      "That unequalled spirit of enterprise, which signalizes the genius of the American merchants and navigators, and which is in itself an inexhaustible mine of national wealth, would be stifled and lost; and poverty and disgrace would overspread a country, which, with wisdom, might make herself the admiration and envy of the world."

    please explain to me this. I own mineral rights on land in Saskatchewan and only receive money if the weather is good or whenever "they' decide. I used to receive about 3-400 dollars a month and they would send it to me where I live in California. lately they say I owe back pay or rent and have had zero money coming in for about a year.

      I'm sorry, but I have no idea how to help you. Since you live in California and your land is in Canada, I'm sure that creates all kinds of legal redtape to sift through. My only advice would be to speak to a lawyer who specializes in mineral rights. Since your situation will involve international law, not state or federal laws, I'm sure it's a lot more complicated.

    how do new surface owners become royalty owners? bought a house in cali but the previous owner still owns royalty.. do i have to buy the right from him?

      You need to ask the county clerk’s office in your county. They can help you with that.

    I'm about to buy a land but the seller wants to keep mineral rights. This could be a deal breaker since I dont want complications in the future wherein somebody can just come in and drill and I dont have the right to stop them

    I think you are wrong about your 75%. If you lease for 1/4 like I did, you will not get 75% but 1/4 of 75% where I got 1/4 of 100%. You explained this in a confusing way. If you kept 75% no one would ever drill on you. In Permian Basin most of us with new and decent leases are getting 25% interest not the 1/8 you suggested.

      Well, based on my limited knowledge, that could be extremely valuable or it could be worth nothing. You need to find out if any valuable minerals exist under that 400 aces, then find out what kind of rights you have to access them. There could be any combination of scenarios.
      The land could be worthless.
      The land could have 500 tons of gold under it and you may have access to mine it, even on someone else's private property.
      The land could have 500 tons of gold under it and you may not have access to mine on someone else's private property, so you'd need to cut a deal with them and give them a percentage to grant you permission.
      So, there are a lot of potential variables.

    Mineral rights are a weird bag.. I get the feeling they came about with the owner of the mineral rights is someone that basically said, "I want a way to avoid paying taxes on this land I plan on extracting the minerals from... but I don't know how I ever will get anyone to just rent all this land." Obviously, mineral rights laws its weird hiccup that came about from someone want something for less or close to nothing. And while it does seem like a reasonable bargain considering the mineral right owner could of just ate the loose on the taxes and not sold the land.
    Basically what mineral rights mean for you is you might get a really good property reasonably cheap with the only cavity being you might have to let someone pull oil and natural gas out. If I was so lucky to have something worth extracting off my land that I could see the rights off to it.. I might actually do so provided I could see what the disturbance I would be subjected too.

      Like most things in life, there are definitely situations when mineral rights are a good thing and are very beneficial to people... and there are times when they are awful and result in people getting ripped off.

      You can't get ripped off if you know what scam someone is trying to pull on you. But you also can't live in a Forrest if nobody is willing to sell a wooded lot.. Your only course is to be educated in what could happen and decide how much risk do you wish to partake in.

    Seems like the lack of information on your deed is a loophole. Heaven to hell rights doesnt just go missing. My guess is the mineral rights were sold, or kept, and then the property value was frauded to be the same.

      I never said the rights went missing. I said they need to be looked up in another bureaucratic resource. As the old saying goes, "Never attribute to malice that which can be explained by stupidity." And there are a heck of a lot of things tangled in the mire of bureaucratic red tape which may seem like malice, but it's just dumb disorganization.

    This is what happens when people don't follow Gods commandments they violate his word and create laws which are false. As the Torah says land and all that is in it belongs to the owner. When Messiah returns this too will be the law for all people. Oy what a evil it is to be under mans law and not Gods. But what a grave evil it is for a man to reject Gods law and be deemed a thief under his law. For a thief will have no share in the world to come.
