    There certainly are laws now, I reported my own stalker, the police charged him and he was taken to court in Scotland. If she isn’t currently stalking someone then she is unlikely to be charged with stalking.

  • @HanChap2
    @HanChap2 6 หลายเดือนก่อน +9

    Spot on! When my stalker ramped things up a notch and the police were heavily involved, i swear the fear i was constantly living in, the lack of sleep, the living on adrenaline waiting for a space in a women's refuge to come up so i could move out of my home and relax, was detrimental to my health both mentally amd physically. I ended up so run down i developed an UTI which tracked into my kidneys and became Pylonephritis. I collapsed in front of the police, who were at my house, AGAIN, because of an incident with my stalker, and they had to call an ambulance out to me and i was rushed into hospital. I then had protection whilst seriously ill in hospital because my stalker found out (he had planted listening devices in my house which were found by the police) i was admitted and which hospital i went to.
    So yeah, the stress from these People can seriously make the victim ill.

    Gary, I totally agree with all you say on the legality of points - there is a BUT, though. The law in the UK and probably the US too is an ass and the technicalitites that are considered when deciding if someone is 'guilty' of something are a joke and to me more than often seem to want to ignore truth and facts that would help a jury make decisions. Another thing we keep hearing in legal cases is how UNIMPORTANT a past fact about someone is, to the case in hand. So, for example, let's say a guy is accussed of raping a woman and in the past had been accussed of this with also but he was never found guilty. The prosecution lawyer isn't allowed to mention this because as the guy wasn't found guilty it's considered irrelevant to the present case! [I disagree with this but that's how it goes.] Now, our unique Fiona Harvey, if we are to believe all the stuff that's being thrown at us, has had one Interim Interdick served on her by Laura Wray and that's it! She was never charged legally with stalking anyone or sentenced to jail - and THAT is what's her case with Netflix is based on. Her lawyer will no doubt say that everything else is irrelevant!

    • @Leesa111_0
      @Leesa111_0 6 หลายเดือนก่อน +2

      Her lawyer already has. They're not interested in all her other victims, just Netflix, but I don't know how they will win her case. The show's end credits say that the programme "is based on real events: however certain characters, names, incidents, locations, and dialogue have been fictionalized for dramatic purposes. Then she went & Outed herself on Piers Morgan 🙄

    I dont think Piers Morgan is defending her, I think hes just hightlighting the arguments her lawyer will use in the civil trial, which will be based around the "True Story" statement at the beginning of the episodes, I know they have a "based around" disclaimer in the end credits but unfortunately Netflix may find themselves in a bind around what the average viewer would have been reasonably assumed were factual events (ie: the assault, the conviction etc) that were not factual. I'm personally team Richard but the legal system is not always the "justice" system.

    Hey Gara828! Let me start by saying how much I have been enjoying your coverage of this issue. It has been fascinating to watch how you went meticulously through her own Facebook posts to expose lies and deception. I think you would make an incredible private investigator. On the issue of the law. I am a lawyer from Jamaica and our laws are modeled after the UK legal system. This is also similar to American law, so what I can tell you is the Fiona is going to win on the substantive issues of her case. She definitely wants this to go to trial and she is going to win in my opinion. Here’a why. The courts won’t care that she is a horrible stalker and deserves to have gone to jail a dozen times over. The only thing her lawyer has to do is show the court that message at the beginning of the series where is says, ‘this is a true story.’ Then Show the court scene where the actress playing Fiona confesses and goes to jail. Lastly they will show the court proof that the real Fiona never went to jail and was never charged a thing. Done!that’s all the judge really will care about. That proves that Netflix lied. Fiona wins just like that. Then onto damages. The court will look at the series damaged her life and the mental or other toll it took on her. Also the judge will likely want to punish Netflix for portraying her as a criminal when she was never convicted. It doesn’t matter that she should have gone to jail. She didn’t go to jail. I think she is going to win millions of dollars. I agree that she will likely loose some of it on defamation law suits and possibly other cases as people she harassed in the past come out the wood work. But I have no doubt that Fiona will defeat Netflix on this. It’s a slam dunk case.
