    • @shubhamjohri290
      @shubhamjohri290 2 ปีที่แล้ว +21

Well, the judiciary is so powerful it can completely strike down laws passed by the Parliament. Sort of an impasse.
But the caste census of the higher judiciary was so irrelevant. The collegium already tries to balance the proportion of genders, religions, state high courts etc.. while making recommendations of elevation of judges. But representation cannot take priority over merit. The higher judiciary is the body of the finest jurists in the nation.

@@shubhamjohri290 Indian has finest judiciary!? Bullocks, just see the World justice project report, India ranks 118 amongst 140 in well performing judiciary. And to be a judge there's nothing as such a merit, it isn't a field of innovation or anything extraordinary, just need good conduct and ideals, almost every lawyer can understand the law, it is thier ability to overcome their prejudice and be impartial that matters, it doesn't need any merit, and merit itself is bonkers, Charles Darwin isn't a topper of their class, and we are aware of his contribution to the mankind and so merit at the end of the day is how much you helped in enhancement of human civilization, not how much of marks have you scored in an examination. Shut up with your subtle casteism.
PS1: Supreme court is most powerful since it can strike down laws passed? Did you ever hear parliament legislations can overturn Supreme court's verdict? You are an ignorant numbskull aren't you? In India no institute is more or less powerful than each other, President's authority, parliament's sovereignty and supreme court with its supremacy keep vigil on each other, that's the beauty of our constitution unlike any other big democracies.
PS2: this is the problem, these mediocre upper caste patriarchy full of stupidity disguised in name of knowledge lecturing us about affirmative action and merit.
PS3: collegium already tries to balance with gender caste and et cetera? Do you know since it's republic India just had one Dalit chief justice and zero women chief justice, but had more than 50% of them as Brahmins? And, after all that it is still so bad in world justice project rankings, meritorious Brahmin chief justices huh! Go fool your friends, because they must be someone like you or shall bear you. But you shut up lecturing.

I just remember All quiet on Western Front ' novel where in First world War Young German conscripts were very enthusiastic and desperate to fight in War. Full of energy and motivation fighting in gorges of Ypres , Ardennes and Northern France .
They just collapsed badly n front of many times fewer British Soldiers which were experienced.
This shows just enthusiasm and a new vision is not just enough.
We need experienced leaders to think and act on the same path.

It was horrendous to watch a Homophobic BJP Minister recently mocking the concept of LGBTQ+ . A society can never be progressive and a country, never a democracy, unless their are representatives for all the genders. @shubhamjohri290 2 ปีที่แล้ว +20

      Brahminism in judiciary 🤣🤣🤣
I am afraid with this mindset you are not going to clear CLAT. The higher judiciary represents the finest jurists in the country with the highest quality of justice dispensed, and can't afford reservations of any sort. So whether there are 10 brahmins or 1000, we need not be concerned. If you are unhappy with the judgment of a Brahmin judge you can challenge it.
This is not to say that the collegium should not keep in mind representation of various sections while recommending elevation of judges....and they do try to keep the ratio of various religions, various state high courts and genders in mind, but representation cannot take priority over merit.
So stop thinking about reservations and shortcuts to get into the elite club and work harder for it.

Okay, I want to ask if you people were already united in India, what's the problem now when you're united by a law. Is there any change?
Yes, the way they did was autocratic and unconstitutional. But, this must had to be done, not in 2019 but much much before that.
If this government has taken wrong way to unite j & k with other parts of this country, why wouldn't you politicians have tried or spoken about this unification before. You should have made a plan and put it infront of the LS to debate over it..... And making our J & K an integral part of India.
But after 1947 you all politicians never raised a strong thought of uniting J & K.
So blame should be given not only to this government for forcefully or unconstitutionally doing unification... But you politicians also who never thought about it.
