FSU Attacks ACC's "Baseless Argument" To Florida Appeals Court | Filipowski SNUBBED Day One?

- Florida State University has fired back at the ACC after the conference filed an appeal in Florida earlier this month. FSU defended the ruling of Judge Cooper in Leon County, and referred to the ACC’s argument as “baseless.” We continue to see dueling lawsuits in North Carolina and Florida. It’s becoming more and more clear that we aren’t anywhere near a ruling or a settlement at this moment. FSU is attempting to break the ACC’s Grant of Rights in order to exit the conference for a lower fee (they want the fee to be zero) than the over half billion dollars that it would supposedly cost to get out.
Hosts Alex Donno and Kenton Gibbs break down the latest court drama and explain why recent events slightly favor Florida State. However, Kenton points out that neither side has landed a haymaker yet. If the ACC would have fought as hard for the teams to get a better contract as they are to keep the ACC intact, they may not be in this situation! They could care less about the teams as long as they keep their cushion jobs!!!
@@user-wv4bd5yw2r exactly! The term "fiduciary responsibility" must not be in their lexicon. Not only have they neglected that responsibility in the past but they are still right now as we speak continuing that neglect. The whole reason the conference exists is to be a representative body for it's members. Yet, somewhere along the way the administration lost sight of that and began to represent it's own best interests. When I say "it's own" I don't mean the conference. I mean the handful of people that make up that administration. Before it's all said and done I'm willing to bet one or more of these court systems teach those people a vocabulary lesson lol

But when FSU and Clemson both started citing gor and espn agreement language stating the acc no longer holds their rights if they leave the conference, it was an uppercut to the chin moment for him, and he finally started publicly question of the acc's attorneys completely screwed up when they drafted the gor.
It was funny. Normally a bit too the head makes you loopy, but it actually knocked some sense and clarity into him in this instance

Florida judge listed pages of case related to forum shopping. The problem is different laws between North Carolina and Florida so both are right.
NO. Both judges are not right. The ACC bylaws require having a 2/3’s vote to take legal action against a member school. It is clear and mandatory in all matters deemed material. A half billion dollar lawsuit is THE most material matter in the history of the ACC. Because they failed to do it, they did NOT have standing to sue. Plain and simple. Realizing their mistake, they took that vote three weeks later. And yet, in DIRECT contravention of NC law, the judge erroneously allowed it. NC law is crystal clear on the subject: “Subsequent events cannot confer standing retroactively”. Three weeks later, by definition, is subsequent. Judge Bledsoe, an ACC graduate, erred. The ACC does NOT have first-file standing.
Judge Bledsoe ruled that the ACC had standing because a nonprofit, voluntary organization can interpret their bylaws as they see fit. If that is the case, then bylaws can mean anything, everything and nothing. Therefore, bylaws are legally unenforceable and virtually worthless. Is that going to be the legal standard going forward in NC? Are other organizations that have bylaws in favor of this new standard gutting their ability to enforce their bylaws? It doesn’t appear that Judge Bledsoe took any of that into account. He should have.

Seems you guys are still confusing the Media Rights deal which is not of consequence in this since FSU is not a signatory to it. The whole thing is the GOR which ESPN is not a signatory on.
@@artpowers812 the Gor referencies the media agreement so that’s why I believe it is part of the whole contract
@@wendykozdras5471 Was not the GOR signed and presented to ESPN BEFORE the Media Contract was signed? There appears to be a gulfs worth of space between the 2.
@@artpowers812no the media rights was first because that is the purpose of the conference. Since Maryland the GOR was created to house the media rights and package them so the conference could negotiate the media rights. Unfortunately that has not gone well for the members or not all of them.

@@artpowers812no, you are wrong. The acc signed it's deal with ESPN in 2010 and then updated it in 2012. The first gor wasn't signed until 2013.
The espn agreement is critical to the case because it defines language in the gor, specifically which "rights" are "necessary to fulfill the contractual obligations expressly set forth in the espn agreement" (verbatim language from the gor)

None of a Florida State court or one in NC or in SC will have the final say on the GOR covering all teams in the ACC and all states.

They’ve had top ranked recruiting classes every year since Mario got there and Florida State continues to be a better team than they are with their two and three stars and their transfer portal additions. I’m trying to even remember that they put anybody in the NFL this year and what do you wanna bet UCF wins more games than Miami this year any takers?
