I think good 4th ground rule for the dad to have for his son, Nick, would be to not talk to law enforcement when pulled over because ANYTHING you say to them will be used against you in the court of law and that he should take advantage of his right to remain silent. When the cop asked why he pulled Nick over, Nick gave a bunch of guesses that were obviously incorrect. Many lawyers advise you to say that you have no idea why you were pulled over. I think it's just simply better to go straight to telling the officer that you won't be answering any of their questions when they ask why they pulled you over. The cop scolded the teen laughing about this, but keep in mind that although it can be used as evidence in the court of law, I'm pretty sure that laughing at the cop is a 1st amendment right. As long as it doesn't involve any threats or disobeying their orders, calling police officers names, cussing them out, and yelling at them are all also ill-advised but legal according to the constitution. The cop wanted Nick to hand over his documents, and I can't think of any state that doesn't require you to do this. When I got pulled over recently, I articulated to the law enforcement officers (I even asked for a supervisor) that if I hand over the documents, then I would be a witness against myself in the court of law. I mean, how are you remaining silent if you hand over documents with a bunch of information on it? It kept me detained longer, but in the end, I didn't even get a warning for refusing documents. After all, I'm afraid to touch that glove box or reach wherever when those officers are ready to shoot at the first flinch. With my pull over aside, I think it's a good thing that Nick handed over the documents unless he was to try to use his "right to remain silent" like I did because if his reason for refusing was to mess with the officer, hide that it's parent's car, think that speeding isn't a good enough reason to have to hand over the documents, etc, I'm sure it would have gotten him booked. When the officer told Nick to roll down his window, I'm pretty sure that he only had to legally roll it down a few inches. Nick is likely lucky that he didn't get arrested for saying that he didn't have parents because lying to a law enforcement officer to impede their investigation is illegal I believe. I'm very disappointed in Nick for squandering his right to remain silent by a long shot.
