What if the society members are taking illegal decision like the fungible area is 35% of the BUA of earlier house, but builder is giving only 25% and utilizing that 10% for his own profits. Also the incentive FSI of 15% (old building more than 30 years old) is taken by builder and not given to society members. I believe the BMC rule says that fungible has to be given to members or not used at all. so this 35% + 15% = 50%. But if only one member is opposing it and society management takes majority decision to go ahead with this project? Is this considered for any legal value? does court make the provisions legal if majority approves it?

7 persons are owners of 1 flat each and 8th is owner of 2 flats

Tenants were staying from 1970 onward.

Policy of builder to offer flat or flats from the sale component of the to-be-constructed structure as security to the rehab component instead of giving bank guarantee or surety bond. Shockingly Mumbai High Court has not questioned the adequacy of the above type of security policy offered by the redeveloper in place of bank guarantee or surety bond.
These days builders don't give bank guarantee after RERA as under RERA builder has to maintain ESCROW ACCOUNT and can't use this money for any purposes other that that specific project only. Lien is additional offer as guarantee

My building is going for self redevelopment .
There is no structural audit in place and nor there is a sales deed (since 1975) and now also with no sales see done the contractor. The managing committe is corrupt and in aww of the builder / contractor and hence not even got the existing premises measured via BMC for actual and additional areas.
It is 19 member society in Mumbai but certain members have share certificate and due to internal division between families , few don’t have share certificate but they legal heirs staying since 1975
We want all occupants with a separate flats to obtain membership rights in the new building as all are considered occupants ? Plz share your insights . Thankyou

New construction Society Comittee is formed around 2/3 years back before that no comittee. 70% member paid full amount now remaining members hv to pay balance payment but the construction work was not completed as decided because Builder died in between now the comittee is charging 21percent interest to remaining members is it correct or wrong . Can they pass rule of charging 21percent in AGM.

Our plot size is 2500 sq meters and there are 14 flats of 485 sq feet and 30 flats of 632 sq. feet (in Mumbai suburban area). We want to redevelop the building. Builder has mentioned that redevelopment under 33 (7B) is not feasible for him so he has suggested 33 (11) scheme. He is offering around 27 % rera carpet area and will construct approx. 632 sq feet and 790 sq feet apartments under 33 (11) .
He is going to construct a building in sra for a slum in the nearby area where market rate is less. Builder is going to use 33 (11) scheme under SRA, clubbing with SRA projects.
Requesting you to give advice on the risks that can come if 33 (11) is used for redevelopment instead of 33 (7B).

Out of 22 members 4 to 5 members are not in favour of redevelopment, because the boulding is strong, can last for next 50 years. The members have reached age of 80 years. They are afraid of completion of redevelopment. Can these 4/5 members stop redevelopment. These 4/5 members are in favour of self redevelopment project.

I want to know, what is the legal authority of the agreement between the plot owner and developer after 30 years if developer gets expired if the agreement is not registered. After 30 years will the legal rights or authority will belong to the tenants or the land owner. Can you recommend such people or ( mediator) who can complete all the legal process for land owners in Pune city.

usable carpet - 866.07 sq.mts.
Builder sold society's office of 135 sq.fts and 2 units of 150 sq.fts.
( Society issued share certificates and collecting maintenance also. Have registered agreement)
But now they r tendering with 914.16 sq.mtrs. considering upper 16 flats balconies.
They r giving all benefits to society office but not 2 units.
saying that 2 units r garages not assessed hence they hv no rights.
