      Someone told me it is pretty common, and happens a lot in the tech industry. I heard Microsoft use to do it as well.
      How true is it? I don't know. Yet it doesn't surprise me.
      I'm not defending Apple. It is wrong. It needs to stop, and maybe it will teach these huge companies from doing shady crap like that.
      Now if it is true, and many other companies poach employees or steal IP? Why do we rarely hear about it. Why is this case different?

In a market economy it happens all the time and there is a pretty good argument that increases competition, dynamism and leads to higher wages. Walking out the door with your former employers intellectual property on the other hand is shady and in a lot of cases illegal.

That's exactly why companies like Apple poach employees from their competitors and you know it. Oops, since the employees who stole trade secrets has his hands dirty, that means that the company that expected him to do it and rewarded him for doing it must have its hands clean. Fuck you.

    Masimo actually has their own fab for sensors and signal conditioning ASICs. They even provide III-V foundry services. That is just how much they have invested in sensing technologies in recent years.

    For how Apple present themselves as a green, friendly, customer-oriented company, it is a surprise for many to see how unethically they behave in their day-to-day operation.
    They preferred to pay large amounts of money to hire Maximo engineers rather than licencing the technology, as they prioritise total control over an honest and efficient business conduct.

      @@PhilippeSaner That won't ever work because the crimes are committed on orders of the executives but the fines are paid by the shareholders. Until the law allows for corporate officers at the level of vice-president and above to be personally fined, barred for life from ever holding another executive or board position in any company, and even imprisoned in particularly egregious cases, nothing will change because the worst they face is a golden parachute.

      well they have not moved on. They started in 2013 ish, they released v1 in 2020. As stated, the inaccuracy makes the project incomplete and they are likely still working on it. Also these are medical & software engineers making like 400k/y, they will be fine.

    Your retelling of the Xerox Alto story was completely wrong.
    1) Xerox Parc was known throughout silicon Valley and multiple companies were trying to pull of their own GUI before someone patented it.
    2) Jobs was literally the only person who paid Xerox for their technology. He gave them 100,000 shares at a rate that was so reduced that the board threatened to walk out over it. He had wanted to just give them 50,000 shares at no cost but they decided they'd never clear it with the shareholders.
    Apple are definitely villains in any story of computing history. But the Xerox moment is one of the few times they weren't but have been made out to be by selective retellings.

    If you're going to get a smartwatch this year, go with a Garmin. Week-long battery life, waterproof enough to swim with, and the HRV monitoring is actually remarkably useful.

    I don't think pulse O2 monitoring on a smartwatch is medically useful in practice. The blood is so good at maintaining your O2 level that a fall in O2 is generally a late sign that you are unwell. In other words, by the time your smartwatch warns you that you might need to go to the hospital, you'll have already gone to the hospital. We may prescribe home blood glucose, blood pressure, and even ECG monitoring, but home O2 monitoring was rarely done until the pandemic and even then, the evidence remains unclear as to whether it's actually helpful. We should have learned from Theranos by now that what the public perceives as medically useful and what is actually medically useful are different ballparks.

    Apple should be forced to fork over all the money from the international sales of the apple watches with stolen technology to Masimo plus a hefty fine for copyright violation and corporate espionage. The amount should significantly affect Apple's bottom line and be used to fund other technology companies.

      nah, people don't buy those phones just because oximeters. They should be fined by every smarth watch sell relative to the cost of lincensing the patents. Given the fact masimo is "trying" to sell a smartwatch, my best guess is that they will ask a quantity based on the cost per unit of masimo's smarthwatch

    Using light to determine blood oxygen levels, has been around for a couple of decades. Masimo has a significantly improved version, and its patent had to have been issued less than 20 years ago. Otherwise the patent would have expired. The technology also had to be fully explained in their patent documents. The technology, by just applying, becomes public record, though the patent gives Masimo exclusive rights of the tech. Developing the exact same tech, independently is not a defense in patents. It is with copyrights. Two different IP laws, but copyright is poor for protecting technology.
    In copyright, two authors working in respective caves, can both write "War and Peace", independently, and both will have full IP rights to their own version. In patents, the one who get to the patent office first, wins. In the early computer days, software was protected by copyright. But sometime in the late 80s or early 90s, patent law changed, and software became patentable.
    As for Apple stealing Xerox PARC tech. They didn't. PARC gave it away. That's why both Apple's MAC OS and Microsoft Windows could co-exist. Any rights to the tech, belonged to Xerox, and they did nothing.

    I have an Apple Watch for the sole purpose of not carrying my phone. And I have an iPhone for the OS only. A lot of people believe it’s the hardware that draws Apple fans but that’s not true. I was using Windows from the very first release, dos before that, back in the 80’s. It has only been in the last 15 years or so that I began using OS and I just like it much better. So it makes sense to have all your devices using a version of the OS you love using and a side benefit is that they can all communicate with each other and share data. I still have a windows machine and always will.
    By the way. For serious hikes and exercise I use my Garmin Fenix 6X Saphire. Much better battery life than Apple and they and others have been doing blood oxygen sensing for years. Apple has a long way to go to become a true sports watch. The Apple Watch is the best smart watch though.

    they do an aggressive IP defensive tactic by claiming too much coverage for their patents. the idea is simple, claim that any new invention is infringing on your patent and get the other guy lose the patent. this was made possible by the change in law in 2012.

    The people who say the use Apple for the "ecosystem" crack me up.
    You just want to be edgy and feel like you are part of the crowd.
    Android/Samsung are better phones.
    There is little to no benefit in using a MacBook with an iPhone and MacBook has massive drawbacks. Even ChromeOS has overtaken Mac in market share now.
    Apple Watches have absolutely no purpose. If you need a watch, buy a Timex.

      I'm not a big fan of apple devices but for a long time Android phones were clearly not superior. Simple things like lag when you scroll made Android look very weak. I blame the Java OS on this and I heard they've mostly replaced it since with a C type language. Apple software can be irritating to use and the hardware is lower spec but the OS and apps are comparatively running more efficiently than on Android. Also there's much less money to be made in Android store so many good apps focus on iOS which makes it the preferred version. This used to be the case for multimedia editing programs too, anything video/image related was better on the mac.

    I don't understand how apple continues to be so successful unless really just a combo of that many fan boys and people that like smooth corners. I don't get it their phone is like 1000 dollars but does same thing as my 50 dollar android phone. Someone explain please what I am missing.

    Wait a sec, the patent for pulse oximetry belongs to a Japanese man. Takuo Aoyagi, a Japanese bioengineer at Nihon Kohden, developed a pulse oximeter based on the ratio of red to infrared light absorption in blood.
    I've seen chinese continuous pulse oximeter watches on aliexpress that look very similar to Masimo W1 watches.
    What exactly is Masimo's patent dispute with Apple?

    Wry misleading title, they didn’t steal the entire watch design, nor did they do anything wrong for the previous 5 designs. A single component of the 6s gen was an issue, this is even how your video starts. I’d rethink the title as it’s not accurate in any way

    Windows is entirely based on an old McIntosh OS created by Apple. Apple would have the dominant pc in the world if bill gates hadn’t stolen that.

      Windows is way dirtier than just that. They got their practical monopoly through backroom dealings, IP theft, and alleged criminal conspiracy.
      And Apple allegedly ripped off more than a few IP's on their way up, too. It seems to be a prerequisite for mukti-billion dollar status.

      There is a big difference between copying functionality/UI, which is what literally every company does, and stealing the underlying technology. MS Windows was technologically very different from old Macintosh systems.

    What a disappointing video! Apple has engaged in the entirely legal and consumer-benefiting practice of poaching top talent. They have won every case on this matter expect one bureaucratic, non-judicial ruling.
    Apple has achieved something that Masimo never did and likely never could: getting an O2 sensor working in a mass market consumer product. That’s much, much, much harder than getting it working in a niche, high margin industry like medical devices.
    A Masimo win would have a chilling effect on the consumer electronics industry; keeping many future technologies locked away from ever reaching us consumers. Why anyone would root for that outcome is beyond me.
