    Criminal law is SO fascinating and exciting.
    Contracts are so boring. Essential but compared to this, I love it🙏🏻

    Investigation - LEO (criminal procedure)
    Burden of Production - judge
    Burden of persuasion- jury
    Trier of fact.
    Preponderance- more than 50%
    Clear and convincing
    Beyond a reasonable doubt
    Affirmative defense.

    Question if the charge of receipt of stolen property includes the element of with the intent of permanently depriving the owner of this property then could it be argued by the defendant that their intent was to return the property to its owner and if so is it the prosecution's duty to prove that the intent was to permanently deprive the owner of the property or is it a defendants responsibility to prove intent

    In this example, the reason the stolen property would be inadmissible is b/c of it was a 4th amendment violation, but if it was a 5th amendment violation (or just a Miranda violation?), THEN the physical evidence *would* be admissible, right?

    Help me understand... You spend hundreds of thousands of dollars on law school only to find the education to be insufficient, and that impels you to sign up for programs like this just to survive the bar exam? Seems odd.

    A juror should not have the knowledge of elements of a crime, though,so how can this be a consideration for them to make a decision?

    • @cargopilotguy305
      @cargopilotguy305 9 หลายเดือนก่อน

      Judges issue jury instructions which direct to the jurors what the elements of the crime are

    The standard in a civil case is proof by a preponderance of the evidence and not perponderance of the evidence as you state.
