    The lower judiciary is one area which needs reform. In Goa the lower court judge has not been appointed for the last six months. Cases are being adjourned and prolonged unnecessarily. Waste of time and money.

    Dushyant Dave said that the quality of judges has come down since the Collegium started appointing the judges; better judges rose up the system when the Govt was in charge of appointing the judges.
    From this, we better not conclude that we will have better judges if we revert to the previous arrangements, even if that is mediated through the NJAC!
    The quality of politicians and the environment has changed in the last 30 years and more so in the last 11 years. The party in power today and its prime movers are hell-bent on making India a Hindu Majoritarian country.
    Someone at the senior level from the party opens his gob and says so some or the other time!
    We didn't have Shekhar Yadav or Victoria Gowrie, she has been advised to keep her mouth shut now and open it at appropriate times, in past! Shekhar Yadav apes Adityanath, Bhagwat, Amit Shah and our Prime Neta who calls the minorities as INVADERS!

    Apart from certain number of years of being a practicing lawyer in a lower Court to become judge of a higher court, the number of cases he handled and the number of cases he successfully handled also should be a criteria to be considered.

    Shri Mukul Rohtagi has raised a very important point about the simplification of law. The simplification of laws can help to a very large extent in solving the problem of clogging and backlogs. The ambiguous, complex, and cumbersome laws are a delight to bureaucrats and those who are in powerful positions. Many of them use these to deny the people their rightful dues. Therefore, people flock to courts even for minor problems that would not have occurred had the laws been simple and unambiguous.

Unfortunately the laws made in the parliament who's some members aren't educated and having no clue about laws and lacking basic knowledge how to make India great, Add to this corruption, religion and politics, People work for themselves and not for the chair🙁. The judiciary sitting in the chair are young and inexperienced and lack maturity. For example , The most abused law is 498A and Domestic violence which has been acknowleged by the government and the SCl etc; Still govt is sleeping , 💤 Everyday harrased men are commenting suicide 😢. I have Lost faith in the judiciary. Very sad state of affairs in India. The Constitution itself is violated by the executive so How can India be a great country.     TN Seshan once said that indian judiciary is highly corrupt system in India, because there's no checking mechanism, nobody is there to question the judges/advocate community.......there's no accountability for judiciary, nobody takes any responsibility, so sorry state of affairs, endless taareekh pe taareekh, taareekh pe taareekh, just killing the justice seekers with delayed justice.....no court proceedings if judge is on leave and luxury of holidays throughout the year.....Most ironical part is that the advocates community is highly unprofessional and corrupt unethical group in India where clients are virtually destroyed by their own advocates....... Even in civil cases the clients are totally battered by your own advocate and most of the times your own advocate colludes with the other side advocate and your own advocate is your own enemy...... It's better to talk less about the judges because they take decades and decades to decide a case, it takes lifetime delay to deliver justice, generations change but cases remain pending, even after reserving for judgement judges will take years to pronounce, and High courts are still worse.... Crores of cases pending in courts, worst outdated procedures of filing documents, marking of documents, accepting the documents, silly rules of sending notices and acknowledgements, years of trial procedures, if the judge is on leave nothing will move an inch, worst advocate community with no control, highly corrupt court systems, corrupt court staff where at every level you have to pay bribes... hardly you find sincere judges, may be one or two percent..... In all, the outdated judiciary is highly corrupt and uncontrolled system in India including the highly unethical advocate community.......😎

    Kapil Sibbal was a Cabine Minister of India took oath to Protect Unity & Integrity of India was advocate of Kashmir sepratist for restoration of Art 370 under interpretation of coinstitution that J&K a seprate state (country).
    This thing is wrong with Judiciary that They decorated such a traitor as Senior Advocate.
    This man is forgetting that current govt never broke any custom of Judiciary.But Indira Gandhi broke seniority custom of Judiciary 3 times to get her favourite Judge as Chief Justice.
    Constitution was not in danger for this man at that time because he was struggling for his political carrier.

    They should together write articles or paper and letters to the govt over these issues and seek the functioning of the bodies concerned with robust suggestions. Educate the system about these requirements. Should also talk in the language which common people understand. They are a civic body in themselves.

    1. Promote only from lower judicary --> HC --> SC, based on merit and quality of ones judgements.
    2. Develop a transparent and objective criteria to evaluate quality of judgements.
    3. STOP lateral and direct entry to HC or SC.
    4. Implement reservation policy in these appointments.
    All ills shall disappear soon.

    MR Sir- pointed out following problems: 1. Manner of appointment
    2. Quality of Judges
    3. Capacity of Judges
    4. Difficult and Complex Laws
    5. Stuff which is being appointed is not up to the mark
    6. Clogging of cases
    7. Different Factors should not be excuse for selecting poor fellow
    DD Sir. I pointed out that one.
    1. There is clamor for Justice
    2. No rule of law
    3. Number of cases
    4. Complete nepotism in appointment
    5. Per Capita ratio of judges is low
    6. No Chief Justice showed any interest to deal with these issues. No conversation with other wings of judiciary

    1. Collegium usurps the power to select judges so they have more responsibility to make it more transparent.
    2. It seems that the government advocate gets appointed as judge more
    3. Judges behavior
    4. Appointment of the Government Advocate is also not based on merit only.
    5. Roster must be made by CJs according to expertise of judges.
    There is agreement on broad based independent parmanent selection committee.
    As junior member of the bar, I am completely agree with these but these are only symptoms not the cure.
    Please see Judiciary is run by humans. We do not have any system to prepare good human beings. Our society has become morally corrupt; what we have is just a byproduct.

    in India, the largest democracy, the judges are not appointed by the govt, but by the collegium --yet the govt been criticized on the ground of delay etc.

      Not just district court judges but even many higher authorities and lawyers of district and state legal services organisations are corrupt. They connive with police and powerful culprits so that culprits are not exposed and punished, to victimize a victim endlessly instead of doing their best to get justice to victims which is their foremost duty.

    Why don't you guys yourself make a Committee of lawyers and former judges of High Courts & Supreme Court consisting of 7-11 members. It should also include at least 1 jurist and 1 former senior bureaucrat. It should look upon the matter of appointment and Roster System (and other matters if possible).
    Look into the matters concerned in depth and make recommendations. Publish the report publicly in a press conference. If the committee thinks that there should be a law then make a draft law.
    But remember that it should be useful, rigorous and applicable.
    This committee would be obviously private in nature (or civil society's work) but if its recommendations would be of use then it would be a landmark committee and will find its mention in history books. Don't worry if any Govt or CJI would look into it or not. If the recommendations would be useful and powerful they will be forced to accept it, with or without naming it.
    Pay your duty.

    Conversation tempted me to ask if present CJI ,his colleague justice Dipankar Dutta or all earlier judges who dealt with EVM cases since 2011/2013(Petitions of Subramanian Swamy or Vaman Meshram of BAMCEF were TECHNOCRATS ?
    If not ,were they COMPETANT Enough to hear on a Computerized
    m/c .
    They all must answer as to why VVPAT was ordered to be added at exhoribant cost of 3500 cr (tax payers money) when its slips were not to be matched with EVM nos ?
    Do they all lacked even Common Sense ?
    Case is still dragging even after 12 years ?
    Was it such a big legal decision ?
    As a citizen,I don't have any faith in Indian judiciary

    As an listener to this debate... One suggestion from me... Fix the tenure of CJI everywhere to say at least 2 years... This will percolate the stability in the institution...

      Nope it won't help, make the appointment of all the Judges for life plus more judges to be appointed and thus you are giving almost total independence except the option of impeachment if they become biased for any reason.
