I was deported in 2011 I was charged with aggravated Felony sales with intent to distribute cocain. I was bar to reenter the United States permanently. I have four American born children all graduated from four years college and one of them is a NYC firefighter. Can you please do something about my case . Thanks

There are different ways to approach a situation. I would first need to see if criminal relief is a possibility, and if not, if there might be non-immigrant visas with waivers of admissibility that might be available.

I was issued a ten-year deportation order, which is set to expire in July of this year. My case involved theft by deception. I am legally married in the United States and have a son, although my wife has chosen to separate from me. At the time of my arrest, my immigration paperwork was in process, which ultimately led to my deportation. I served a three-month jail sentence. I am considering traveling to USA from Sweden as a tourist. In light of my circumstances, I would appreciate guidance if you can give me advice.

Thank you for reaching out regarding the All Criminal Waiver in the context of immigration and consulate processing. The American Immigration Lawyers Association (AILA) provides valuable resources and guidelines on this matter.
Steps for All Criminal Waiver Processing:
      1. Eligibility Assessment:
      • Review the applicant’s criminal history.
      • Determine the specific grounds of inadmissibility.
      • Evaluate the nature, severity, and recency of the offenses.
      2. Documentation Preparation:
      • Gather court and police records for all offenses.
      • Obtain personal statements explaining the circumstances and demonstrating rehabilitation.
      • Collect supporting documents showing ties to the U.S., such as family ties, employment, and community involvement.
      3. Filing the Waiver:
      • Complete Form I-601, Application for Waiver of Grounds of Inadmissibility.
      • Prepare a compelling legal argument and evidence package.
      • Submit the waiver application to the appropriate USCIS office or U.S. consulate.
      4. Consular Processing:
      • Schedule an interview at the U.S. consulate.
      • Prepare for potential questions and provide any additional documentation requested by the consulate officer.
      5. Follow-up and Monitoring:
      • Track the application status.
      • Respond promptly to any requests for further information or documentation.
Given the complexity and critical nature of criminal waivers, it is essential to approach this process meticulously. I recommend contacting our firm for a detailed consultation to discuss your specific situation and provide an accurate estimate of the associated costs.

Why would they try to get in the legal way the second time, if they didn't do it the first time?

It depends on the provisions they departed you. However, it likely will last 10 years. However, there are ways of doing petitions to get back sooner. I would need to know if you have another employer to sponsor you

Hello. Drug trafficking does make you an aggravated felon and it would be for the rest of your life that you would not be able to come back as a lawful permanent resident. There is the opportunity or way of trying to do criminal relief depending on the situation to vacate or reduce the crime so that you’re not considered an aggravated felon. However, there also is the opportunity to apply for an E visa with a non-immigrant waiver, depending on the type of business you would do and invest in the US.
