      He has a good point though, the artists that block are literally stifling progress for everybody including themselves. It's the exact same thing as burning books. They think they are going to make more money by blocking, but they end up making _less_ because of it. It's an archaic mentality.

I just don't think it should be brought up in the comments of a video about fair use. So i explain why i dont think a comment about a deadly virus should be on a video about music, and now im racist? Jesus christ, i have no problems with black people, i have had arguements with my family about them saying something remotely racist about any race (blacks,Pakistan i,asian), i absolutely rip them apart. Besides donation money, Lobbyists also provide samples and frameworks of the laws they're looking to see passed, so the politicians and their staff don't really have to do much work on drafting it. Sometimes they just get their laws passed verbatim.

      Most of these fossils in the senate both states and Federal are so out of touch with whatever committee and subject they're about to write and pass law on, they haven't a clue nor really care.
      They're paid puppets for usually even richer plutocrats who have "think tanks" one of most notorious American Legislative Exchange Council (ALEC), they make these sound like wholesome charities, but they're really just a cookie cutter companies for collusion among the plutocrats to set law that flies in the face of anything fair or moral, and always puts more power and money into these plutocrats' portfolios.
      Their puppet politicians do as they're told, I mean they got someone else to "do their homework" the law is already written complete in legalese, all they have to do is vote on it and go home.

      It's exactly that argument that needs to be made. There's a guy with a channel where he makes videos on repairing Apple products, Louis something I can't remember. He testified in a thing like Rick, only for the right to repair you own products, so manufacturers can't stop you from fixing it with warranty voiding.
      Basically he put the senators in the role of a technician and they all got the point. If someone could get the senators to imagine themselves as TH-camrs who wanted to explain a concept to their audience, then ask them rhetorically how they would do it and give them the answer "use existing songs as examples", they'll get it in a second. Just make them feel how ridiculous it is, not just see it

    "What makes this song great?" is actually free advertising, you are winning these musicians new fans instead of letting their songs die out.
    The 50/50 share really is a good solution.

      It would of been a shame if I never heard any of these great songs. Many I know of I heard at a young age playing grand theft auto. Quite a few of the artists and songs that Rick has made videos on have appeared in many grand theft auto games. Artists such as Boston, Toto, Yes, Alice in Chains, Metallica, Rage Against the Machine, Smashing Pumpkins, Megadeth, David Bowie, Soundgarden, Korn, Kansas, Tom Petty, Genesis/Phil Collins, Faith No More, Stevie Wonder, and Jane's Addiction. Its a shame how the music industry doesnt want people to hear this great music.

    To me, “fair use” should cover any situation where listening to the clip or example does NOT substitute for the experience of listening to the original work. Playing a musical example is nothing like playing a song to provide entertainment.

      I get what you're saying JM2019, but think it works both ways, as Russell White describes. The artist is getting exposure to a new audience. This could both be the case with an oldie/goldie song, that the younger viewers don't know - but it has certainly also been the case with newer artists that I wouldn't have listened to if it had not been for Rick Beato or one of his colleagues - though few are as interesting.
      Now, I think that the comparison with new artists making cover versions are something completely different. If it is in fact just a cover, then thats not fair use - and at least some money should go to the original artist. If on the other hand it is an actual tutorial, where the song is broken down in segments and you wouldn't want to watch the video for the actual music - it doesn't hurt the original artist.
      As much as I enjoy Rick Beatos videos, I don't think anybody would put on one of those to hear The Eagles or any other artist. Sorry Mr. Beato, but you're simply too informative for me to enjoy the actual song - I'd rather find the original recording for that. ;-)
      So even the "What makes this song great" series shouldn't be a problem as it is in no way a substitute.

      JM2019 A good question, about whether use of the material helps someone else make money. But in the end, anything short of a full performance of a song, such as in an educational example, is likely not causing a LOSS of income to the copyright holders - people are not listening purely for entertainment when watching a TH-cam. Once a work of art or a song is out in the world, is it reasonable for the creator to maintain complete control over even the discussion of that work of art as well as the thing itself...if that discussion includes use of examples from it? Even if those discussing it make some money? Dunno. Discussion probably drives sales for the original artist/publisher. However, the whole situation is very layered since there are copyrights that protect the writers, the publishers, and a different copyright that protects the sound recording of a song, so there are differences in copyright issues depending on whether the sample used is played by Rick on a guitar or bass (so it is just a matter of someone’s intellectual property - their creation) or if he actually plays the original sound recording, which is copyrightable separately from the underlying composition. Perhaps if there were a an easy and reasonable structure in place similar to the compulsory mechanical licenses for when you cover a song (and release on CD or distribute digitally), then Rick or others would have option to pay a small and reasonable fee based on how much use of a song is involved and handle it that way. Something that would calculate the percentage of the song used, etc., so as to not make it cost-prohibitive for those creating educational content.

      Richard Hunter, you make an intriguing point with your question. In my opinion, the answer is no, although they might be forced to revenue share and or amend their video to give more credit and promotion to the artist they used the clips from. If the popular artist releases a new song that uses substantial elements from the new artists' song then the fair-use teaching video would actually help justify the copyright claim against the popular artist. In other words, the fair use teaching video can only benefit the new artist and not ultimately harm them if the social media platforms are forced to protect fair use rights.

    As a recording artist I’d be thrilled to have a TH-camr like you cover one of my songs! Besides, you actually got me to buy the new Pearl Jam album by covering them in “What makes this song great”. The failing record labels just don’t get that it’s free advertising for the artist’s music. Instead of making new music they get paid by others making videos about their old songs. It just makes no long term sense. If those videos go away like they say they want, no more income and no more exposure. We need new laws to reflect the changing landscape to benefit the artist and the youtuber. Revenue sharing is a great answer.

    It's amazing how short sighted people can be. I can guarantee no artist has lost a single cent of my money because of your videos. Quite frankly many of your vids, especially "What makes this song great?" have made me go back an spin up and album on YT Music that I haven't listened to for a long time. How is that a bad thing?
    Rick, your videos are terrific. Thank you for your content and introducing me and reintroducing me to so much wonderful music.

      Absolutely agree. I've been known to go out and buy CDs that contain songs used, or in Rick's case, analysed, on TH-cam. That generates income for the artist. Not quite the same, but when I was still in school, one of my friends was playing "Message In A Bottle" on Guitar Hero... two weeks later I owned a copy of "Reggatta de Blanc".

      Exactly! It’s just people who are not hip to the New Music Business, which ironically has the biggest players of the Old Music Business at the top of the list. In a rational world, artists should recognize ZERO THREAT from your breakdowns. They are likely to see renewed interest in their work from either their original fans or new ones. I hope you are able to continue to teach using the real song examples. They are instructive even to neophytes like me

      As I understand it, radio stations have to pay royalties for rights to broadcast by paying ASCAP, SESAC, and BMI. They then pay to the record companies, publishers, songwriters and recording artists.

      I'm no expert on this but in i would guess the radio station had to pay for use of the content? In Norway radio channels have systems that automatically reports to a national non profit organisation (GRAMO, owned by the content creators themselves) whenever registered creative content is played. Seems like a low cost and fair way to do this?
      I'm speculating now;
      If youtubers and other content providers like Rick Beato got an account in a similar organisation ((same or in collaboration with) as the radio stations, tv stations, record labels, artists and participants) it would be fairly easy to maintain for all parts i would assume. If this is even possible to achieve in the US i'm not that optimistic about given its long history to benefit large corporations rater than the working man...

    Also, thanks for agreeing to speak to the senators. That was a pretty selfless act, really, and I appreciate it. I'm a listener, not a creator, and in that sense, in terms of demonetization and so forth, I do not have much of a dog in this fight. I do believe that for many students, 'learning' happens best when 'teaching' is tied to real-life (!) examples and references.

My Senator is on the subcommittee and I will be writing to him in support of your idea of white listing certain users. Great suggestion and I feel that offering a solution is much better than just whining about the "unfairness" of the current situation.
    I am proof positive that your videos reinvigorate interest in music I already know and pique my interest in songs and music creators (for example, Tool and A Perfect Circle) that I've either never heard about or know little about.
    Thanks for the clarity of this content.
    I urge all of those who watch your videos look up the subcommittee senators and tell them how you feel.

    Rick: Testify! Rage Against The Machine! I'm with you on this all the way. I'm 62, so I'm in your generation.
    I've watched many of your videos on great songs (not really big on music theory and such), and never have I got the impression that you were using them in any way for profit or to benefit yourself. In fact, your videos are actually a tribute to the great songwriting, musicianship and production of these songs.
    I agree with you that instead of protecting their music, blockers are in fact stopping potential expansion of their fan and financial base. Many of your subscribers are young people, who are unable to see just how great these songs and musicians are. So bottom line, people like Don Henley are actually shooting themselves in the foot (and I do like his music as well as the Eagles).
    It took me awhile, but now I understand why so many great bands and musicians I like don't get mentioned on your channel. Blocking eliminates them, and that's truly sad.

    I would be interested to know how much traffic your "what makes this song great" videos drive to the videos of the songs on TH-cam. How many of your audience members watch your video, then go listen to the highlighted song on TH-cam. Frankly, if I were a band trying to make money off of an old song, I would beg you to make a video about it.

      Right? I don’t get the artists who have a problem with this. It can only promote them and help to get new listeners. All this friction is greed. I get it, but I just think the YT format should be given a little more leeway. A lot of it is obvious that people aren’t trying to steal. I know it’s potentially a legal nightmare, but I don’t think the majority of TH-camrs should be penalized and broad stroked.

      What I see is people taking advantage of Free publicity. It's convinient like a slave. You let them work, take the fruit of the work, and give nothing but pain in exchange.

      That'd be a great system, with one small problem; If I recall correctly, the only option outside of youtube's copyright strike system is settling the claim in court, which is super expensive.
      It's a great idea to have the three-strike system work both ways, but sadly current copyright laws just can't support it

      For some clarification. I had used Creative Commons licensed music in one of my videos. I then had a Content Id claim by "AdRev for Rights Holder".
      I disputed and they immediately released their copyright claim.
      Further to that I made contact with the music composer and he was unaware that this was happening, that AdRev did not represent him and made it clear that the Creative Commons license was still valid.
      This is what the current system encourages. Unscrupulous operators who issue random content id claims when they clearly do not own copyright. They know that many claims will be disputed, but some percentage will not because of the fear of having their video taken down.

    I‘m usually a passive Beato-watcher but I have to say here that I have the highest respect for you for putting in so much effort on this topic, despite that you said you don‘t want to actively fight the problem the way you would if you were younger. These videos are actually the ones I always watch till the end (maybe shouldn‘t be saying this aloud) because these problems are very important in my opinion.     Rick, I’m a copyright lawyer and I’ve always thought your videos are fair use due to the low impact on the artist’s marketplace. In fact, I would argue you actually help the artist because often times after a video I’ll listen to the song through a paid streaming service. The certification is an excellent idea. A annual fee coupled with a royalty to the artist solves this. This concept is like the CCC (The “Copyright Clearinghouse Center”).
    Love your videos man and they shouldn’t be free. Keep pushing this idea! Add the royalty for the artists and it should a no brainer.

    Great testimony! I served in the California Legislature for many years. It was unusual for witnesses to provide potential solutions, regardless of the issue.
    We heard lots of intellectual property discussions since so many music and movie people live in California. This TH-cam stuff has been making me crazy - your channel will never replace the purchase of a song or an album. If anything, it will generate additional sales or streams.
    I don't expect results any time soon, but beginning a discussion of the issues is the first step. I worked on many issues that took several years to bring to fruition, and of course some things that I could never make happen - although we are paying the price during the pandemic for some things that went unaddressed, and some things that were blocked due to the influence of powerful interests.
    Go get them, Rick! Keep bringing up the issue. I'll keep posting fair use explainers.

    The thing is, when you make a "What makes this song great" or a "top 20" video, you're actually promoting those songs, especially for an audience that doesn't have great exposure to classics and old rock music. So, they shouldn't block. You are actually helping those artists make money.

      I do advertising so I get to deal with a little IP law. Copyright is so hard to enforce I don’t bother most of the time. Yet TH-cam and the publishers are making billions stealing you tubers content. I do not have a TH-cam channel.

    Rick Beato's tenacious efforts to simultaneously educate and entertain people around the world is admirable and a testament to the BEST that TH-cam can be. Rick is one of the few musician/producers with the talent and communicative skill that can connect the new generation of developing musicians with the greatest contemporary music of the previous and present century. Mr. Beato's approach, in my opinion demonstrates an innovative and respectful use of intellectual property to create educational and entertaining conversation and musical exploration. I think it is great that Rick Beato can offer viable solutions to enable the Social Media platforms to share copyright risk with content creators when a probable fair use of intellectual property occurs in a fair-use challenge situation. Blocking the monetization of videos where fair use has been challenged disproportionately harms people making videos with a high educational value as well as the new multi-media platform content creators. To allow the arbitrary and pernicious censoring and removal of content that has not been adjudicated for fair-use compliance, betrays the spirit of an assumption of innocence before guilt. More importantly, it makes the world less richer with the consequential absence of informative videos. As to the tie, it is great but I would have chosen a skinny black tie and dark suit like the Beatles once wore at The Cavern Club.

    Imagine taking an English Lit class and the teacher can’t read excerpts from a poem, play, or book. Or a Calculus class and the prof can’t show a paper with a copyrighted proof. 🧐
    There has to be a better solution. I am not a fan of Congress finding a solution when I believe the industry could do better itself.
    I fully support your idea that “what makes this song great...” introduces to newcomers and reintroduces to others. While listening to your amazing interview with Larry Carlton including your talk about Jaco Pastorius, this week, I was so enamored, I ordered $30 of deeper cuts to listen more. Your idea works, and it has worked over and over for me. You should get a referral fee the way Amazon pays affiliates.
    If the blockers keep it up, in another decade it will be, “Eagles, Pink Floyd, ... who are they?”

    It’s the ‘whether or not it infringes the artist’s ability to profit from their work’ that gets me. So many of your What Makes This Song Great vids have introduced me to bands I wasn’t previously aware of and revived my interest in artists I had previously liked but got out listening to. On occasions this has lead to me buying the music.
    Hell, it’s not as if you’re running a parallel series called What Makes This Song Suck...

      Exactly that. It seems to me that in most, if not all of these cases, it promotes the song/artist. I can not see how, in any shape or form, demonstrating any passage or parts of a song could possibly harm any sales. Any such rhetoric which claims otherwise would be conjecture, supposition in it's prediction of people's behaviour harming sales.

    It’s also funny that the wealthiest, and let’s not forget, luckiest artists often make the biggest stink over what are essentially ads for their back catalog. In the jazz realm, listening to past masters is literally the name of the game..
    I wonder how many jazz artists have pursued these takedowns. I would guess very few. Of course, jazz musicians rarely can afford ONE lawyer let alone an army of them.

      Except in the rarest of incidences, people don’t just spontaneously learn how to deep listen to complex music in general.… When I tell people that I will spend hours listening to music with my eyes closed, they look at me like I have two heads. Then when I tell them what I was listening to they ask.. “who?”.

    I really don't understand why any musician would have problems with your educational videos Beyond the educational properties, these videos expose an audience to unfamiliar songs (or showing familiar songs in a new light) and provide an incentive for the audience to go out and listen not just to that particular song, but possibly the rest of the musician's catalog (which could lead to increased sales).       Because they are using a grenade to kill ants. His videos are 100% fair use (despite his claims to the contrary), but by using algorithms to enforce a 0 tolerance policy they are lumping him in with pe people that would put up a song to a pretty background and hope to make money off people that want to listen to the song.

    Total respect Rick. One of the things that gets me with blockers is that when you do a video on a particular song I then listen to that artist as I have a new appreciation for the song/artist.

    Simply put, “What Makes This Song Great,” can only HELP the performers, writers and record labels! You are often reviewing songs that is 30 plus years old. I’ve personally gone to download (buy) several songs and albums, immediately after watching one of these episodes. It seems the biggest problem is the robots who scan YT for content, do not have the ability to determine how, or why the content is being used. It’s just ridiculous.     Wow you had 1.7M subscribers at the publishing of this video and now 2 years later you have 3.5+Million. Pretty sure it’s safe to say and proven the growth in interest you’ve experienced is because of you mister Beato and your selfless sharing of knowledge. Not a single band or record label can lay claim to all the work you’ve done. I am just getting started with your content, have just scratched the surface and I already know the time I spend in the future catching up will be of immense value. So I thank you ahead of time. 🙏🏻 P.S. I’m sure I am not the only one who believes you could easily win “that fight”. If anything, you are driving the artists more revenue by either renewing interest in their music, or basically advertising their music to new listeners whom have not yet discovered their band or song(s). I don’t know about anyone else, but when I hear a song that is amazing and it’s been a while since I’ve listened to it, or a song that I am digging and have never heard before, I go straight to Spotify and add it to my playlist.     You're such a classy guy. Listening to this makes me think of the book, "How to Win Friends and Influence People," by Dale Carnegie. Using logic and positive reinforcement opens so many doors for success. Whereas a bad attitude, complaining, and illogical ranting will shut those doors of opportunity so fast your head will spin.

    So many people complain about (insert topic here) but you were prepared and showed up to present potential solutions rather than whining about a problem and expecting the government or someone else to solve all your problems.
    That should be the model everyone who has any complaint should follow. It shows a vested interest and an effort to find an equitable resolution.
    You showed the 2 Senators that thought it was significant enough for them to attend the meeting and listen to the constituency they were elected to represent that there are solutions.
    You even validated your ideas with past precedent used to solve analogous issues in the past.
    Thank you for taking the time out of your life to prepare for and appear before the Senate subcommittee to remove “blocking” when the piece is being used for educational purposes.

    You should look into recording some of the “What Makes This Song Great” segments with the artist or a member of the band. I wonder if guys like Don Henley who are obviously panicked over the music industry’s change in the last 20 years and who think they have to defend their work on a hill with swords would be more apt to come on and share insights where they could see the educational benefits as well as promoting to a newer generation their older music. Just a thought

    It's a true show of your character that you don't dispute fair use claims on your What Makes This Song Great? videos. It shows that, a) you care about musicians and their livelihood, b) you understand the work that goes in to making music, and (most importantly) c) you're truly doing this for the love of teaching your audience.

      TH-cam for me is like an advertising jukebox. I like old stuff and if I find an artist or group I don't know about, I listen to their stuff on TH-cam, and if I like it, I go spend money on it.

      @@gunnaryoung - often people don't know a song or group, or hadn't thought about it in awhile. So they won't even be looking for an official video, UNLESS THEY SEE AND HEAR IT ON A CHANNEL REVIEWING IT. THEN they will look for it.
      Practically all the music I have bought in the past 15 years, I became aware of on TH-cam, including some that I learned about on OTHER channels than the act's official one.

    What kills me about all this is, when people who either react to or break down songs post something, that's exposure for that artist, which, in many instances, leads many listeners to look into more from those artists. By putting copyright claims on these videos, or especially blocking them, they're stifling that exposure that could lead to a much greater return. It's absolutely absurd that they do things like that. In the end, they're only hurting themselves.
    The recording industry is, after all these years, still a joke.

    I have to declare to being a Brit, so the niceties of US law are not something I feel able to comment about. I'm 62 and have always been an avid listener of music, and a perpetually optimistic BAD guitarist. At times , my listening has been restricted by peer pressure and a kind of obsessive affiliation to a genre, but even with a completely open mind I cannot listen to everything and I'll miss some very good things. Rick doesn't just educated...in a uniquely accessible way I must say...but helps us to appreciate, and like a mentor brings things to our attention. The media is so fickle, good music drops off the play lists and maybe younger people are the ones really missing out on some of the gems that have defined our popular culture...in the UK I cannot remember the last time I heard REM (for instance) on the radio...since the nineties probably...there's probably 20 somethings who have never heard their music unless their mum plays it !! The music that survives is the music that is played and sung....that won't happen if you don't know its there...

    As to Rick introducing music to new audiences, I am one of those people. Ricks channel has introduced me to a lot of new music. Music that I have purchased through iTunes. I’m pretty sure that I am not the only person who has purchased music because of Ricks channel.
    You would think the music industry would like channels such as Rick’s. You would even think that they owe him some sort of commission, or at least a thank you. He is after all providing new consumers and adding new cash to their already bulging bank accounts.

Those of us with zero musical talent (the only thing that separates me from successful bands is talent and ability!) have no idea what goes into making a record. You break it so interesting by breaking it down and explaining the intricacies. As Harry Chapin said "music was his life, it was not his lively hood, but it made him feel so happy....and it made him feel so good". BTW--how about a show on Warren Zevon???
