Good day atty. yung kapitbahay namin na barangay kagawad ay Geodetic Engr. marami na sya inangkin na lupa sa area namin tapos ibebenta, dumating ang araw na nag survey sya sa lupa ng lola ng asawa ko sabi niya lupa daw niya yung sinurvey niya at tumobo lng daw yung lupa yung katabi kasi ay fishpond, eh more than 50 years na nakatira yung parent ng asawa ko doon, tapos may mga muhon yung lupa, tax dec po yung lupa. Ano po ba gawin namin para matigil niya yung pag angkin ng lupa.

Ang isang paraan na magkaroon ng hiwalay na property kahit wala pang annulment ay mag file ka kayo ng Petition or complaint for legal separation or Judicial Dissolution of Conjugal or community Property na kung saan ay magkaroon na ng pag hiwalay ng conjugal at community property at pag bumili ang sino man sa mag asawa ng property ay hindi na maging bahagi ng conjugal property. Makipag ugnanayan kayo sa lawyer for further assistance.

Kung totoong may titulo na at na-confirmed ninyo sa Register of deeds ay akipag ugnayan kayo sa lawyer for further assistance upang makapag file kayo ng affidavit of adverse claim sa Register of deeds at within 30 days ay mag file kayo complaint sa korte for the cancellation of the title and reconveyance with damages laban sa umangkin ng inyong lupa.

Mag punta kayo personally sa PAO. Kung maipakita ninyo na base sa inyong income ay hindi kayo makaka afford ng private lawyer ay obligado ang PAO na mabigyan kayo ng free legal assistance. Maari din kayong mag sadya sa Legal Aid ng Integrated Bar of the Philippines (IBP) Chapter sa inyong lugar. Nagkakaloob din ang IBP ng legal assistance sa mga mamayang hindi maka afford ng mag hire ng private lawyer.

Atty may nabili ng lupa ang byanan ko at nakapangalan sa nanay nya at sa byanan ko mag ina sila nakalagay sa titulo ngaun paano ang hati an may Kapatid ng byanan ko 8 sila pero byanan ko bumili at yong title dalawa sila nakapangalan patay na sila dalawa mag ina yon gusto mga ibang anak nabili daw nila sa nanay nila pero yong title nasa amin binigay ng byanan ko ano po ang maging hatian

Thank you for the correction. FYI. At the time na na-record ang video at ayo sa pagkakaalam ko ay hindi pa member ang Canada sa Apostille convention during that time. However as of this year, ang Canada is already a signatory of the Apostille treaty convention.
