- The plaintiff is a music artist who was hired to perform at the defendant’s party. She says she learned when she got there that it was a “swingers” party, and everyone was naked except for a COVID-19 mask. She says she was not paid for her performance, so she’s suing for breach of contract and emotional distress. The defendant argues the plaintiff walked off the stage after only two songs.

I agree. This was supposed to be a business transaction and both parties should have went over the terms. Had agreement and signed off on it. This way she would have known what it was and could have said no before agreeing to it. A case would have been clearly valid then of he truly misrepresented.

Judge missed this one. Defendant said that he informed "her team" that it was a "freak nature party". It was up to them to get a clarification of the nature of the event, if they didn't understand what kind of party it was. However, they did not. TH-cam her video, she appears to be a perfect fit for this type of party. It seems like her brand is about "freakdom", this could have helped her build her brand. Like the defendant said, "She's a freak of nature, I brought into a room full-a-freaks. I don't see what the problem was." Judge might be calling Yella Yella to smoke some weed and get "rated".

I don't think that her boundaries were compromised. I feel like we're missing some information from management. She said 90% were naked so 10% weren't. He said that the crowd was allowed to express themselves freely, so those that wanted to be naked were and those that didn't weren't. Yes, she can have boundaries, but her management team is responsible for knowing these things and informing her not the venue. As he said he was only able to talk to them.

A contract for a performance is just that. It was her manager's responsibility to research the defendant & his business. He paid her $1000 deposit of $3500 & she wins $5,000 in court? She did not fulfill her contractual obligation. She wasn't entitled to a dime more.
She should have her management make specific stipulations in her contract about expectations in the future.

The question is whether or not the plaintiff was informed, and the defendant stated repeatedly that her management team was notified. Her “promiscuity” doesn’t even factor in, just the comfort level with her own sexuality, and her representation indicates that she is very comfortable. It’s sensible that he thought she’d gel. That’s not sex-shaming, it’s inductive reasoning.

I’m a spoken word artist In Baltimore and was hired to do a set at a MUSEUM in an upscale area on Light St. I go in to do my thing and all of a sudden some of the ppl come from somewhere in the back NAKED and some had on body paint. Now most of the ppl were dressed but there were quite a few who were totally naked. I did what I came for and got gone afterward. I was shocked but I didn’t skip a beat. Collected my coins and thought about how gross it was that they had naked behinds on public fabric couches and chairs. 🤢🤮 I was repulsed but I rolled with it and made a mental note to not touch or sit on anything.
