  • Lawyer Robert Barnes says there is a “substantial chance” the judge of Donald Trump’s hush money case will be dismissed following the SCOTUS ruling.
    “It’s what he should do constitutionally,” he told Sky News Australia host James Morrow.
    “The big question is whether this judge actually cares about the constitution.”

      So, kids, a jury of 12 folks picked from a pool of 200 sat through several weeks of testimony and presentation of documents, paid close attention by all accounts, and found Trump guilty. Just because Trump says he did nothing wrong, just because you happen to not like him being held accountable, just because he is a candidate for public office are not adequate reasons to ignore the law and the finding of the jury.

    Justice was never the issue here, Trump was almost guaranteed to win on appeal because of Merchan’s behavior and the overreach of the charges. The point was to embarrass Trump and diminish him in the eyes of the voters. Nothing more.

      That’s exactly what it was. that’s why they had stormy Daniels telling stories about sex when they had nothing to do with the case. it was supposed to be about falsified documents which were falsified by Michael Cohen. They played that salacious testimony on every news program on repeat. The porn star that was extorting a presidential candidate was suddenly everybody’s hero.
      Wait until you hear what the Supreme Court has to say about that.
      Because there’s a law specifically against irrelevant testimony..
      They refused to allow the election official testify that would explain the alterations in the financial documents . But they let that freaking porn star gold digging slut play victim after she got paid for the confidentiality agreement. which by the way she defaulted on and will now have to pay Trump.
      Why wasn’t Michael Cohen and stormy Daniels charged with extortion?

      He was never charged with paying hush money. He was charged with falsifying business records to influence a "federal" election. The records were not false they were booked as payments for legal services. What legal services? Organising a non disclosure agreement which is legal. The case was Judicial fraud.

    Here's the problem. When judges are appointed based on their political affiliation you will sooner or later get to a situation like this. No matter where you stand in political terms, there is a measure of unfairness in the judges' rulings. It is not about justice at all, it is about who you,as judge, want to support.

    Not a chance in hell will Judge Merchan dismiss the case. Even doubtful the New York appellate courts would act fairly. And yes, the Supreme Corut did make a mistake in 2020 by not hearing the Article II, section II case dealing with electors and state legislatures.

    I agree Robert. If the NY court sentences him to any time, file a habeas motion directly in the SCt. The judge should declare a mistrial or JNOV. Will he? I doubt it.
    Florida. Smith is not constitutionally appointed. Every thing he’s done is null and void. The DC judge didn’t even make a record on the case. They are reversing on that basis too.
    Bailey out of MO is suing NY for the gag order. It’s unconstitutional. Will they take it. That is the question. Sometimes they refuse cases that are so politically charged. But 1A is very important in a presidential election. His right to campaign and my right to hear him are on the line.

      Not a hush money case. Charged as a business expense violation. Jack burned himself by adding "Top Secret" cover pages, that were not part of the evidence. He admitted to tampering with evidence. No admissible evidence, no case.

      No, what makes the hush money case eligible is the evidence Bragg used to prosecute the case. The evidence used was dated after Trump was elected president starting in February of 2017. Trump claimed executive privilege on that evidence . Now that there is some presidential immunity involved that evidence may no longer be admissible. It may be thrown out.
      Then Bragg would have to start over.
      The problem was that Bragg and Merchan were so quick to get a conviction that they didn't wait to see what the SC immunity ruling would be.

    The AG Missouri case against NY State is about far more than violation of 1st Amendment Rights. Because potential sentencing on the 34 felony counts could include imprisonment, home arrest, or probation that restricts travel, all of which would impact on Trump's ability to campaign in Missouri, the lawsuit against NY could also raise issues with violations of Trump's 14th Amendment right re selective prosecution and equal treatment under the law, 5th Amendment right to due process and to know the charges he was tried under, and 6th Amendment right to an impartial jury. This case could potentially be a fast-track to the Supreme Court overturning the entire case without having to go through an appeals process through the NY state courts first. If that NY trial judge sees the writing on the wall, he may choose to dismiss the case before it can be overturned.

      I believe he will declare a mistrial. It's a much more graceful outcome for the judge than being reversed for due process violations.
      As for Missouri's suit, it is strictly about the 1st Amendment. They can't sue because Trump's rights were violated, only their own. The 1st Amendment isn't only the right to speak, but also the right to hear. This is how Missourians have standing.

Would SCOTUS only consider the validity of any sentencing which restricted Missouri 1st Amendment rights, or would it consider the validity of the trial and verdict?

      @@peterlegg7456 I'm certain SCOTUS would only address the gag and potential sentencing. First, that's the only relief Missouri's asking for. Second they are loathe to intervene in the usual appeal process. And in fact since the sentence has not yet been pronounced, the judge could conceivably set aside the jury's verdict (fat chance I know) so an appeal would be unnecessary. Stranger things have happened, and I'd be truly surprised if even stranger things DON'T happen between now and the election!

      Trump will not serve even one day in prison and will not be a "convicted felon".
      Trump is NOT "above the law". Presidential immunity IS THE LAW. The JUDGE is not above the law. The case will be declared a mistrial. The verdict will be vacated.
      The Judge messed it up by allowing inappropriate evidence and testimony to be presented over defense objections of immunity. He should have waited for the SCOTUS decision before starting the trial. 🤷‍♂
