      @TiffanysBunnyGang หลายเดือนก่อน

      Apparently, they didn’t have to agree on what he was guilty of. Because it can only be a crime if he falsified business records in attempt to hide another crime. But they say the jury doesn’t have to agree on what the second crime was. None of that makes sense. Like he gave the example of murder. The jury in a murder trial saying he’s guilty of murder but we don’t agree on the weapon used. Now, how would that work? That makes absolutely zero sense. Every trial, you have to agree on both that a crime was committed, what the crime was & the means of the crime. They can’t say it was three different crimes that he tried to cover up. It has to be unanimous. Especially because this whole case is contingent on, it can only be a crime if he was covering up a second crime. This judge gave incorrect jury instruction because they knew there would not be a unanimous verdict. To me this just shows the corruption that’s involved in this case.

But then the jury instructions say that they don’t have to agree on what that second crime is. That is completely an absolutely absurd. That’s never going to, hold up in appeal. This is obvious that they had to literally tie themselves in a pretzel and do some major gymnastics to create this into a crime. Otherwise, it was an expired misdemeanor end of story. That’s the same thing I’m getting out of this. And the jury instructions are bogus anyways, because they have to be unanimous in the charge & the reason. They can’t just be unanimous in the fact that it was a crime they have to be unanimous on the reason for the crime. Otherwise, it doesn’t make sense you can’t say he was guilty but say you don’t agree on what crime was committed. That would never get through an appeal. Just like the example he was giving what weapon was used in a murder. So the jury says they agree he committed a murder, but they disagree on the weapon used that would never fly in a criminal conviction. Never. So he’s proving how ridiculous this is in his own example.

      They basically had to twister pretzel to get some kind of conviction to work. Let’s give the example of the murder trial. In a murder trial, you have to agree that the crime occurred, what the crime was, and what type of weapon was used in the crime. They are saying in Trump’s case the only way that falsifying business records could be a crime in this case Would be is if he was falsifying those business records to cover up another crime. But they are saying you don’t have to unanimously agree on what the second crime was. That is completely ridiculous. That would be like saying in a murder that you agree that they committed murder but you don’t agree on the weapon used. That would never be acceptable and a criminal trial ever. It will definitely be appealed but honestly, I don’t believe they care if it is appealed they just wanted to have it interfere with his ability to campaign during the election. Drain his money and be able to call him a fell in during the election. And this just proves it more than ever.

      No, it wouldn’t because it’s not an actual crime. They literally had to twist a pretzel up to figure out how to make this into a crime. The only way this could be a crime is if he was falsifying business records to cover up another crime. But in the jury instructions, they’re saying they don’t have to agree on what that crime was. Will you would think if the whole case is contingent on him having to commit that second crime they would definitely need to agree on what the crime that he committed. In a case, it has to be unanimous that a crime was committed & the type of crime. There’s no way this will not win in appeals. The jury said they don’t agree on what crime he committed which makes the whole case invalid. It’s bad jury instructions and it was intentional. If anything, the judge is committing the crime because the judge knows better.

    It's even simpler than it seems. Pretend for a moment that this was about hiring a hitman. Falsifying the document is you wanting to hide that you solicited a murder (whether or not the murder ever ended up happening.) Whether your solicited that murder because your hated the victim or to cash in on an insurance policy or to get an inheritance isn't something the jury needs to unanimously agree on as long as they unanimously agree that you falsified documents to cover up that you solicited murder for any of those three reasons. One guy thinks you hated the victim, 2 think you wanted that life insurance policy, 9 think you were gunning for an early inheritance--12 jurors think you are guilty and that's that.

    • @TiffanysBunnyGang

      The reason that that’s not the same in your example is because the only way the first part of it can be a crime is is the second part of it. It was a crime. So it’s not disagreeing on why the crime was committed like your example is showing. The second part has to be a crime that they’re covering up. I.e. tax fraud. So they would need to unanimously agree on what that second crime was in order to make that one a crime. Otherwise they have three people saying he committed three different crimes to make that first one qualify as the crime.
