    How could Jirard simultaneously NOT know the funds arent being donated BUT know that the intent of the organization was to hold the money until it was large enough to make a restricted donation??

    I wouldnt worry about jirard trying to sue you, based on his actions it'll probably take him 10 years to find the right court room, or lawyer. He might even ask you for some recommendations since it clearly isn't his responsibility

      I wouldnt worry about him suing because publicly asking for a charity to serve its charitable purpose and/or be investigated by state or federal authorities is the furthest thing from illegal. They were very careful to explain any accusations with legal definitions and not explicitly make claims not backed up by information & statements they had and presented publicly.

    As someone who has been on several 501c3 boards, I wanted to mention that it's common practice and used to be a requirement to discuss financials at every meeting. This ensures that the board can fulfill their fiduciary duties in overseeing the funds. Jirard claiming ignorance of the financial records for 8 years is absolutely ridiculous and if it's to be believed, it means he never once attended a board meeting. The fact that he misled donors as a board member is very damning. If he weren't on the board it would be a very different story and his claims of ignorance might hold water.

      I think you assume that there was a meeting at all. I feel like this was always going to sit in a bank account and be used as a pool of money to pay people large sums of money under the guise of a salary or to line other peoples back pockets. Also my intuition is screaming that his father has some sort of hand in the bigger picture somehow

      obviously it's still a problem, but imo that's like saying it's dangerous to go outside cause someone might run you over with a car, should we refuse to call people out for things they're doing which may be nefarious or scummy because there's a psychopath who's waiting for a trigger to go and shoot someone's dog, and that might potentially happen?

    I have been practicing law in The State of California since passing the bar in 1989. Although I am admittedly not a criminal prosecutor, I am still dumbfounded as to how or why Mr. Jirard Khalil’s legal counsel would allow him to make the potentially incriminating statements he chose to make in his now infamous “ My Response “ video.
    Allow me to explain.
    Over the past decade Mr. Khalil has repeatedly made the claim during his many charity drives that any and all funds secured through direct donations, Twitch subscriptions, merchandise sales and so on would go directly to, and become the sole property of, a registered charity based in The State of California known as The Open Hand Foundation, of which Mr. Khalil claimed to be both a founding member as well as an active board member. He had stated to his viewing audience that at no time would any of these funds go to, be used by, or be made available, to either himself, his business or any other entity other than that of The Open Hand Foundation to which his donors believed they were donating to in good faith. Yet in the above mentioned video he posted to TH-cam entitled: “My Response“, Mr. Khalil openly and freely admits to illegally allocating large portions of these charitable proceeds to himself and his business ventures in order to offset what he refers to as the “production costs“ related to the “Indieland” webcast program.
    These cost include, but are not limited to: Air fare costs for himself, his team and select guests of the “Indieland“ webcast program. Hotel accommodations for himself, his team and select guests of the “Indieland“ webcast program. Insurance, security, appearance fees, supplies, food and catering as well as merchandising costs. In this video he makes the claim that the total cost for all items listed under the heading “production costs“ came to a total of $12,000.00 USD. Although it seems highly unlikely that even the most frugal individual could hope to cover all of these rather costly expenses for a mere $12,000.00 USD, this is not exactly the point that has placed Mr. Khalil in jeopardy of facing potential felony criminal charges in the very near future. The real issue here is that once Mr. Khalil had made the statement that at no time would any of the funds secured during his many charity drives go to, or be utilized by, himself, any other person, persons, or entity's other than the charity the funds were raised for, The Open Hand Foundation, he was legally obligated to refrain from accessing and thereby utilizing ANY of those funds for ANY reason. Least of all using the funds, or a portion there-in, to fund his expenses for the Indieland webcast program or ANY other cause, entity or person.
    In plain English, by using any of the money collected in good faith during any of the previous charity drives, for any other purpose outside of The Open Hand Foundation, after stating to potential charity donors that no such action would be taken, he has, I believe, committed felony embezzlement and felony charity fraud according the laws of The State of California. In eliciting funds generously donated by his audience with the understanding that those funds would not be used by Mr. Khalil personally, he was legally obligated to see to it that at no time would any of said funds be used by Mr. Khalil or any other person or persons other than that of The Open Hand Foundation. It is clear that Mr. Khalil misled his donors into donating funds to a charity which did not receive said funds in total. By making false statements in order to secure donations for himself, his business ventures or even The Open Hand Foundation itself, it is my professional opinion that Mr. Khalil has violated California State law and in doing so has potentially committed felony charity fraud.
    My son has been a fan of Mr. Khalil for some time which is how I became aware of this sad situation. I know that many of you must feel as though you’ve been used and lied to by someone you trusted and cared about. Just remember that those of you who chose to donate to the cause of finding a cure for Frontotemporal Dementia, you are the true heroes here. Have faith that the legal system will see to it that every dime you generously donated will eventually make it’s way into the hands of doctors and researchers struggling to put an end to this dreadful enemy.

      I'm no lawyer but I think to legally be held liable for fraud there needs to be proven intent to commit fraud. (Hence Jirard's emphasis on clerical errors) I don't know if that could easily be proven in Indieland's case (certainly the facts are clear cut as you lay out), but in the grand scheme of things, Indieland using some of the money towards expenses is one of the less problematic things in this entire mess. It does speak to a sloppiness in operating a business though; such a thing could easily have been avoided by procuring sponsorships for the event.
      The much bigger problem for me is the blatant misrepresentations about Open Hand in order to procure donations. I agree, I don't know why a lawyer would advise/allow Jirard to make such a long-winded and defensive video response. Whether or not some type of fraud conviction could be obtained given that the money was eventually donated and (apparently) wasn't misused (just neglected) - I have no idea - but I wouldn't want to be defending Open Hand in this spot.

      @MichaelJM It seems clear that as Mr. Khalil was busy soliciting donations which he claimed would become the sole property of The Open Hand Foundation, he was fully aware of his intention to utilize a portion of those funds to assist in covering his out of pocket expenses incurred before, during and after, and related solely to, the Indieland webcast production. If it was his intention to use any of the funds donated in this way Mr. Khalil was obligated under California State law to inform his donors of this fact. As he did not, under State law, his actions could be construed as meeting the definition for both felony embezzlement as well as felony charity fraud. This constitutes intent.

      Frankly, I understand why he did that. If he outright admitted to misleading people, that would be him admitting that he commited fraud. If you or anyone else were in his shoes at the moment where he was crafting his response, you'd do the same thing. You would be a fool otherwise.     IMPORTANT - the audit was of their status as a nonprofit, not a fraud audit. In my experience, a nonprofit status audit is mostly procedural and self reported, confirming you met certain qualifications to keep your tax exempt status. Again, NOT a financial or fraud audit, where they actually look at bank transactions, receipts, etc.

If there really wasn't any financial foul play like he claims in his response video, why would he use that specific audit as proof knowing it could be easily cross referenced? On the flip side, if his denial of illegal activity was deceptive, using that audit just makes his case look even worse than it already does. It doesn't make sense to post it at all. It just makes him look bad either way

    I always feel like I need to preface this with the fact I am a wet lab research scientist...the idea that 600K is a "large" impact. It's not. It's less than a single NIH grant that supports two staff members working on the same project. That 600K would have gone to much larger uses had it been spread across an entire department as unrestricted funds, and allowed to have been used for training, education, and small project grants. It would have amplified and increased the field and have raised many people up. It's clear to me he's never spoken to a single fucking research scientist and asked anyone how to actually make the biggest impact with the money and instead had it sat in an account devaluing for 10 years through one of the worst periods of inflation in recent history.

      @@Turbovolver you knows worse…most of those PhD holders like myself pull 80 hour plus weeks in the lab and are on around 50k a year before tax and deductions. There is no over time we are contracted to “deliver activities on the following project” so you don’t get extra except not being fired. So I end up making less than minimum wage if you figure it out per hour but sure wanting to sleep in a safe bed and eat is a crime. Doctors don’t work at the bench side most of the time. I know very few who do. The ones doing the experiments are underpaid PhD holders who spent ten years studying to do this job and earn a fraction of the amount a doctor does. Doctors are too busy treating patients to spend 16 hours a day doing protein extractions and western blots. The man has never spoke to a researcher in his life.

    I think it's ridiculous to say they didn't benefit from all this charity work. Doing that stuff is a good look, builds your reputation, attracts an audience based on the high profile people involved in those drives. Maybe they didn't transfer funds, but it's basically marketing for his brand.

      This just makes everything so much worse. He could have benefited while also donating the money to charity. His family could have even taken salaries off the top of the charity for managing the funds. All Jirard had to do was to avoid getting too greedy, and trying to steal the entire fund. Which he did. Or one of his family members did. And everyone else either agreed to participate, or at least they agreed to cover it up. What's crazy is that he's willing to drag his mother's death certificate through the online mud pile, instead of calling out the person responsible for stealing money from a charity. If it was a family member, why not pass the blame to them, for stealing and insulting your mother? His actions make me think he's the main person responsible for this crime.

    The Completionist subreddit has been privated after a head moderator essentially said that they'd be deleting any discussion about the situation, including talk about any further Karl or Muta videos, with the same mod also, without any shame, proudly stating their bias and that they'd spoken with Jirard a heap of times and that they were mates or whatever.
    The backlash from the community was immense, and as I went to check on things today, found that it'd gone private. Very, very fucking telling.

      I think Jirard is trying to spin it as, 'all the money goes to charity(the charity specifically being Open Hand). We don't touch any of it(meaning the Completionist's company). Therefore, the charity can spend donated money and proceeds on running the event and other expenses while saying that the people running it don't touch it'
      I don't think this line of reasoning works when you run both parts and are not clear on which you are representing when asking for donations.

      @@dragmire3D that doesn’t actually work as a defense because the argument is gross income does not match what it should. If the charity was paying for Indy lands cost that would show on the cost of the company, but the gross income would still be the same. It’s not, so that’s not a defense.
      Example I raise $100 in an event that cost $10 to make I give it all to charity charity gives me $10 to cover cost of the event. It is the charity’s only source of income.
      tax filings for charity should be
      Gross income $100
      Expenses $10
      Net income $90.
      According to the completionist the $10 was taken out before it was given to the charity which explains why the amount given to charity was lower than it should have been and their tax filings were more like.
      Gross income $90
      Cost $0
      Net income $90
      If the second one is true, what he said in the clip, and in the disclaimer was a lie because that $10 never went to the charity even if it would’ve been reimbursed anyway.

    The 6 things that anger me from the response:
    1. He never explained why he lied for 10 years about the funds being donated just a bare bones "I'm sorry".
    2. HIs statement of "Sorry IF YOU felt mislead" is another stand out problem for me. It's not an acceptable apology to shift the guilt onto someone else. We didn't felt mislead. We WERE MISLEAD FOR 10 YEARS
    3. He said in your interview he didn't even know the money wasn't donated until 2022 yet in 2023, he would still advertise as if it was
    4. It is crazy how many people want to forgive him when even if he didn't do something illegal, it was still terrible to lead us on like that for 10 years
    5. Jirard is LITERALLY stepping down from the charity made for his mother. Why would you step down if you weren't guilty? Shouldn't your word be golden and true? Besides, it's pretty bad if you are leaving the place that helped honor her.

They fell out as people, Greg left, and there was no contract protecting his contributions to the channel so he had to make demands on the grounds of general copyright law.     Thank you for bringing this to light, Muta. My uncle died from his LBD nearly four years ago. He was barely 60. It was difficult to watch him slowly deteriorate in both mind and body until he couldn't even walk without assistance. My once 300lb jovial uncle who always smiled turned into this quiet 90lb man who wouldn't say a word to any of my family. He died before my mother and I made it to the hospital. We sat with his body for hours until the coroner came to take him from the hospital and every second was spent wondering if he managed to find peace in his last moments. My Grandma said that before we got there, he had said her name for the first time in a year, and told her he felt like he'd been dreaming and he even managed to smile. I cannot understand how someone who claims to love their mother who died from Dementia, could let funds that could have helped combat the illness, depreciate in a bank account without feeling like the scum of the Earth.

    There was so many issues with Jirards "apology" that didn't sit right with me.
    1. The appeal to emotion. I get how personal the cause is to Jirard, it was his mom and family that were victim's of the disease, but that does not make it relevant to bring up the donation of her body. That isn't what people are looking for answers too. Also just because it is personal, doesn't mean that they are incapable of wrong doing in their fundraising practices. These aspects should have, in my opinion, been left out of the apology. They were only put in to tug at heart strings and distract from the problem at hand.
    2. As addressed in your video, the brushing aside of the lies regarding their partnerships with different organizations and universities. I saw all those original clips, they were not poorly communicated, or misleading statements... those were outright lies. And ultimately Jirard was lying, year after year, until caught red handed. That to me is what makes it hard to take anything he says at face value.
    3. Leaving open hand. I find this decision kind of odd for a man who is insisting that they are above board, did nothing illegal, ect. If they haven't done anything wrong, why leave? Continue raising money like you have been, keep doing the fundraiser. To me the decision to distance himself from Open Hand strikes me as very cautionary to avoid future issues. You know, in case of an audit, in case things go south, and it feels very deliberate to protect his brand (and even in the call with Karl and Muta, you can tell he was very much concerned with how all this was going to look for his brand, and what he had built.)
    4. The legal threat. This one really did come off as puffing his chest, cause I don't really see how he can come out so confident after he does basically confirmed that they had misled, and mismanaged the money. Also now that we've heard the convo, we really can say that it is thanks to Karl and Muta that the donation was finally given. So people giving Jirard a pat for finally donating and saying "oh well he's done right, lets forgive" ... remember that is only because they investigated him. To me Jirard will have to re-earn that trust back.
    These were the immediate things that really didn't sit right with me, mind you I did notice when I peeked the files, that it was a whole load of nothing burger, and everything else that was great to hear, was said without showing the receipts. To me Jirard made a very carefully, constructed reply (probably with the help of a legal team) to try and shift public perception on this matter, and simultaneously threaten to try and get the people investigating to back off. Which again, just raised flag for me. Found it so strange to see people giving this apology a pass, but some people really are easy to sway with emotional appeals.

      A side note, as I've followed this story, I strongly believe that Jirard's end game strategy for this whole controversy will be to put the blame on his father and brother (and I think they will be A-Okay with that, they will take the bullet for him).
      I think what I mentioned in my third point is the fist step of this move. Jirard stepping down from Open Hand, and dissociating with the fundraiser. Now thanks to Muta sharing that new clip form their initial interview I'd say the seeds are there as well. There is that mention of dispute with his family regarding the fundraiser and the money. He also had mentioned that he was "in the dark" on the status of the money being donated (finding out in 2022) ... insinuating that another family was the one taking care of that. So again, the seeds were planted to give him an out, that he was unaware, that there was some familial dispute, ect.
      I think that will be his final plot for an Exit scheme. Like a snake shedding it's tail to escape being caught. His last ditch effort to absolve himself of all responsibility for what happened.
      Mind you that might be trickier after that legal threat where he seemingly stands by his family's name, and instead chose to use his mothers' death as a shield for any criticism. So wonder what path he will ultimately choose.

      Honestly regardless of the intentions gone into the charity itself the way he has been handling things when people have put his feet to the fire over it is very telling. A lot of what you point out seems to indicate that he is mostly upset about his brand with this and is trying as hard as he can to not actually do right but swing the narrative back in his favor and get out of the way.
      It very much seems like someone that is mad that the screw up was discovered and went instant rage defense mode rather than someone who messed up and is trying to make things right. By his own admission he knew the funds were just sitting there for at least a year and went on to lie and needed his arm twisted to get the money actually donated which is just incredibly sad.
      The saddest thing honestly is that due to inflation that the donations legitimately went down in value compared to how much it would have helped if donated when they should have been

    I think another aspect is that Jirard does not appreciate the moral conundrum here. He seems to just think if he proves they technically were not doing any legal wrongdoing, he's all good and this is all being blown out of proportion, he's being bullied, etc. Desperate and manipulative people use all the tactics he used. Clouding judgement with emotional hardships, smokescreen by addressing irrelevant, pointless claims, getting visibly angry and threatening a lawsuit to intimidate, apologizing for people "feeling a certain way" instead of addressing the real reason why people are upset....etc.
    He is so offended people want to look into him when they have legitimate reasons to do so. He acts so fishy it's impressive.

      Good point. But I think Jirard is well aware of the moral conundrum. He did make that comment on the discord call that there is the issue of legality vs morality. I think that there is so much more he would want to say but since they've lawyered up, he his has to go off the script. I think a lawyer would have him avoid the moral side because it would imply guilt.
      But even then I could be wrong because by the end of Jirard's response he leans so far into the "righteous indignation" character, claiming to be the victim himself. He made it so much worse by doubling down, that's for sure...

    As somone who works with charities, the fact that he has tens of thousands of donated $ *spent and listed* as "administration costs" is insane. My charities costs are high as we are all over my country helping a lot of people.
    I HAVE TO report every PENNY. This means that when i need food for guests or pay the bills for the workspace or buy something for the work space I MUST get the recipt. attach it and send it to the tax office to be looked over.
    This means my meals cant be a steak and red wine, i cant buy a 3000$ gaming PC for work etc.
    P.S
    Most common way i saw charities steal money is by asking the sponsors to provide them with stuff that they would need for the event. Then proceed to write the cost of those things as if they bought/rented them and pocket that money while showing they have said things.

Get better arguments.
      edit: they also made a restricted donation anyway since the charity published a breakdown of what the money would be going to, again get better arguments.

If no one reports them to the IRS, then this is what would happen: After the final indieland stream for the 10th anniversary and probably golf tournament, they'd wait for a year, and when everyone had completely forgotten about the charity and it was all in the past, they'd take all the money and split it between them. As long as no one reports you, the IRS literally will never check. They have way more cases then workers. So Jirard and his family would have walked away with a huge payday, easily hundreds of thousands each (they're still lying about how much money they made). They got caught and that's why he's so mad. Because they were almost at the end of the scheme to make them all very rich.

They only donated anything when they got caught, and it 100% is provably not the full amount they said they would donate. So there's still funds that are hidden and not reported. That was the scheme and they almost got away with it. It is only Karl and Mutahar that stopped this from happening. That's what they were getting away with, the exact type of charity fraud that happens across the world every single year. It's not a new scheme. They just got caught in time.

      Donating the money makes it look like he has something to hide? Really?
      I'd have thought the opposite. If I were him I'd have donated it, got on the call and said "The money has been donated because I want to make this right. I can't make it 100% right, but I can correct the biggest wrong so far and take steps from here to fix the rest."
      Continuing to hold onto it just made it look like he cared more about his image than actually helping people.

His lines were very deliberate without guaranteeing solid answers and many of the claims. The video was mainly targeting the claims of their accounting being flawed or money being missing. It didn't at all cover the main claims made in the first video.
      Jirard's response really just seems to preempt an IRS suit.

I think that also supports the idea that he's worried about how he looks in this instance, because he wouldn't have reason to be worried about that even if an IRS suit followed assuming he wasn't aware of any foul play. There were multiple things he could've done to prevent himself being put in the position where he felt he had to make a response video in the first place.

      @luisarroyo7656 Like I said, the main things he seemed to target are the claims of embezzlement which were always a huge stretch. Considering the charity was run entirely by his family it's likely they just have no idea what they're doing. I will say that him claiming the money went back into the events is a pretty damning thing to say, I honestly can't believe he openly stated that in the video considering how open he's been this whole time about not touching any of it.

    After donating alot of my own money during Indieland over the years, I can't stress enough how disappointing this all is. To call Jirard anything but deceptive and dishonest is fcking bs. He consistently, intentionally lied to countless people knowing his lies would garner more donations since people thought they were legitimate and working directly with those foundations. That is FRAUD.

    22:34 I just want to point out Muta completely missed why the UCSF keeps getting mentioned by Jirard, which is because that's where his mother's body was donated. That's why he brother described the UCSF as a "historical donation" in his letter, and why Jirard seemingly randomly gave out his mother's autopsy report.
    However, the single donation back in 2014 doesn’t technically constitute as "currently working with" an organization when it's a single donation. "Current" implies contributions being made or services being provided at regular intervals, or within a recent period of time. What the OHF technically did was "previously worked with" the UCSF, which is not the same. I'm going to go out on a limb and say Jirard sees it as an active contribution given how they donated his mother to them, and that they could be to this day still referencing samples that were provided by his mother.
    Still, that single word "current" was not a correct statement. To compound things, Jirard in his response did not note this, and instead the entire statement about his mother came out as random and pandering. AT NO POINT did Jirard ever mention the UCSF or why he was providing an autopsy report, instead leaving it up to people to read the footnotes and figure it out. This is baffling, when the UCSF "partnership" was something that was a large contradiction amid other statements.
    Muta really should have caught this, but Jirard's response was also very lacking.

    My wife worked in non-profit. They want funds to be unrestricted because donors don't actually know what the community needs the most. Her employer did accept restricted funds but she said they almost always achieved nothing.

      I'm curious on this point because I suspect some of Open Hands "restrictions" might be pretty extreme, like free PR or extraneous benefits that would be more for Open Hands benefit than actual research benefits. In your experience, did you ever have donors with so many strings attached that it seems they were more "purchasing" your endorsement than they were actually benefiting your org.?

      Thank you for saying this. Event Muta in his previous video said “restricted funds would keep the money out of charity president’s pockets.” Which stigmatizes charities as needing to be handcuffed by restricted funds to actually get work done.
      We can all think of the big bad ones that engage in that type of activity like Wounded Warriors or Think Pink, but the vast majority of charities work on slim budgets as they dedicate their funds to doing what they actually say. People in charities do hard work as deserve to be compensated for that work. Charities should have the opportunity to hire new employees to expand their operations and do more good. Restricted funds can sometimes get in the way of those activities and painting them as the only right way to give to charities is just wrong.

I thought may be he'll attempt to paint the critics more unreasonable than they are, like how some people jump to the opportunity to claim death threats were made even if they were not, but he didn't.       It was a legit investigation and concern and I wanted answers. Somehow Jirrad thought that was an actual threat by calling out how bad it looks. There's no court that will ever come to a conclusion that this is defamation. I'm not even sure he watched any of the the videos he claims harassment is why kind let alone defamation.

      I think part of it is that a large group of his fans watched him back when they were kids or teenagers, and they grew to love him. So when we found out he is a massive scumbag they couldn't or didn't want to accept it, so they believed Muta and others were liying and the Completionist could do no wrong

      Not to mention how difficult it is for a plaintiff of a defamation suit to win. You have to prove that the actions of the defendant had a real impact on your brand/image. Some hearsay like, "Well, so and so said xyz and I that's bad for my brand..." If you can't prove it, you won't win.
      That said, a lawyer would definitely advise against pursuing a suit, but you're free to ignore their advice. They'll gladly accept payment should you decide to proceed with the defamation suit.

      Idk, I think he and his lawyers seriously underestimate Mutahar and Karl, but these guys showed they top Jirard's lawyers which cost him probably thousands of dollars, LUL. But technically - you're right, if his lawyers he pays that much have any competence - they'll advice against any lawsuits, it's just was PR tactic to spook them off with lawsuit threat - which as expected - didn't work, because Mutahar and Karl ain't stupid guys.
