How could Jirard simultaneously NOT know the funds arent being donated BUT know that the intent of the organization was to hold the money until it was large enough to make a restricted donation??
@@chanr9531honestly, I'm inclined to believe he is that incompetent. This wouldnt be the first time he bombed a project. NormalBoots and his falling out with his original co-host come to mind.
Because his role isn’t as prominent as people may believe. He was the least involved member of the company. I’m adding this part to my comment to disclose that I haven’t watched this yet and will do so tomorrow, so if Mutahar addresses this in the video, then take this with a pinch of salt.
I wouldnt worry about jirard trying to sue you, based on his actions it'll probably take him 10 years to find the right court room, or lawyer. He might even ask you for some recommendations since it clearly isn't his responsibility
“Your honor, I have to apologize for taking so long to file this lawsuit. It was all due to clerical error, and I’m sorry if you feel misled.” 😂 The jokes write themselves!
I wouldnt worry about him suing because publicly asking for a charity to serve its charitable purpose and/or be investigated by state or federal authorities is the furthest thing from illegal. They were very careful to explain any accusations with legal definitions and not explicitly make claims not backed up by information & statements they had and presented publicly.

"We've now donated the money due to Mutahar's video, after letting it sit for ten years. We're very angry that the money is now in good hands and are going to sue him" 👍
Just imagine for how many more years this would have going on and the amount of money he could have hoarded. Money should have been donated after every event to the Organizations he was making his little speech about, he lied, he stole and I hope people will laugh at him when he tries another Charity grift Event.
2022: Jirard claims he found out the money wasn't going to ANY charities November 2023: Jirard openly lies again about the money going directly to charities That is the definition of charity fraud
Not to mention that as a board serving member, he has a fiduciary duty to know what's going on with the money and foundation. So, either he's lying about what he knows/knew or he's dangerously close to a breach of fiduciary duty along with the charity fraud.
@@cloooud This is a pretty asinine thing to point out as some sort of weird conditional indictment. So what if he's in breach of fidicuiary duty ? it's his family's organisation lol what are they gonna sue him?
@@topcatchillinbytrash Insult me all you want, but you looked like one of plenty of fanboys thinking Jirard has a case. Couldn't tell who you were referring to because you were replying to someone talking about Muta.
As someone who has been on several 501c3 boards, I wanted to mention that it's common practice and used to be a requirement to discuss financials at every meeting. This ensures that the board can fulfill their fiduciary duties in overseeing the funds. Jirard claiming ignorance of the financial records for 8 years is absolutely ridiculous and if it's to be believed, it means he never once attended a board meeting. The fact that he misled donors as a board member is very damning. If he weren't on the board it would be a very different story and his claims of ignorance might hold water.
I think you assume that there was a meeting at all. I feel like this was always going to sit in a bank account and be used as a pool of money to pay people large sums of money under the guise of a salary or to line other peoples back pockets. Also my intuition is screaming that his father has some sort of hand in the bigger picture somehow
@@znido1752 His point is that they should have had board meetings, because they are reporting as a 501(c) foundation/charity. Regardless, Jirard has no excuse for not tracking the money he collected. Ignorance and/or negligence are not valid defenses for his actions, or lack thereof.
Not American but this applies in my country too, pretty much. I feel like it's a standard practice. I was secretary and had to schedule + provide the financials before every meeting
What's hilarious is that theres already people online claiming Karl and Muta "forced" Jirard to gut the charity component of Indieland going forward, not realizing how stupid it would be for Indieland to ask for donations after this utter and sheer catastrophe on Jirard's part.
They're likely just holding indieland next year due to plans and investments already being made, but recognize how awful the PR would be where, mere months after admitting to not donating any money, you then pull a Bernie Sanders and beg the public for donstions

I have been practicing law in The State of California since passing the bar in 1989. Although I am admittedly not a criminal prosecutor, I am still dumbfounded as to how or why Mr. Jirard Khalil’s legal counsel would allow him to make the potentially incriminating statements he chose to make in his now infamous “ My Response “ video. Allow me to explain. Over the past decade Mr. Khalil has repeatedly made the claim during his many charity drives that any and all funds secured through direct donations, Twitch subscriptions, merchandise sales and so on would go directly to, and become the sole property of, a registered charity based in The State of California known as The Open Hand Foundation, of which Mr. Khalil claimed to be both a founding member as well as an active board member. He had stated to his viewing audience that at no time would any of these funds go to, be used by, or be made available, to either himself, his business or any other entity other than that of The Open Hand Foundation to which his donors believed they were donating to in good faith. Yet in the above mentioned video he posted to TH-cam entitled: “My Response“, Mr. Khalil openly and freely admits to illegally allocating large portions of these charitable proceeds to himself and his business ventures in order to offset what he refers to as the “production costs“ related to the “Indieland” webcast program. These cost include, but are not limited to: Air fare costs for himself, his team and select guests of the “Indieland“ webcast program. Hotel accommodations for himself, his team and select guests of the “Indieland“ webcast program. Insurance, security, appearance fees, supplies, food and catering as well as merchandising costs. In this video he makes the claim that the total cost for all items listed under the heading “production costs“ came to a total of $12,000.00 USD. Although it seems highly unlikely that even the most frugal individual could hope to cover all of these rather costly expenses for a mere $12,000.00 USD, this is not exactly the point that has placed Mr. Khalil in jeopardy of facing potential felony criminal charges in the very near future. The real issue here is that once Mr. Khalil had made the statement that at no time would any of the funds secured during his many charity drives go to, or be utilized by, himself, any other person, persons, or entity's other than the charity the funds were raised for, The Open Hand Foundation, he was legally obligated to refrain from accessing and thereby utilizing ANY of those funds for ANY reason. Least of all using the funds, or a portion there-in, to fund his expenses for the Indieland webcast program or ANY other cause, entity or person. In plain English, by using any of the money collected in good faith during any of the previous charity drives, for any other purpose outside of The Open Hand Foundation, after stating to potential charity donors that no such action would be taken, he has, I believe, committed felony embezzlement and felony charity fraud according the laws of The State of California. In eliciting funds generously donated by his audience with the understanding that those funds would not be used by Mr. Khalil personally, he was legally obligated to see to it that at no time would any of said funds be used by Mr. Khalil or any other person or persons other than that of The Open Hand Foundation. It is clear that Mr. Khalil misled his donors into donating funds to a charity which did not receive said funds in total. By making false statements in order to secure donations for himself, his business ventures or even The Open Hand Foundation itself, it is my professional opinion that Mr. Khalil has violated California State law and in doing so has potentially committed felony charity fraud. My son has been a fan of Mr. Khalil for some time which is how I became aware of this sad situation. I know that many of you must feel as though you’ve been used and lied to by someone you trusted and cared about. Just remember that those of you who chose to donate to the cause of finding a cure for Frontotemporal Dementia, you are the true heroes here. Have faith that the legal system will see to it that every dime you generously donated will eventually make it’s way into the hands of doctors and researchers struggling to put an end to this dreadful enemy.
I'm no lawyer but I think to legally be held liable for fraud there needs to be proven intent to commit fraud. (Hence Jirard's emphasis on clerical errors) I don't know if that could easily be proven in Indieland's case (certainly the facts are clear cut as you lay out), but in the grand scheme of things, Indieland using some of the money towards expenses is one of the less problematic things in this entire mess. It does speak to a sloppiness in operating a business though; such a thing could easily have been avoided by procuring sponsorships for the event. The much bigger problem for me is the blatant misrepresentations about Open Hand in order to procure donations. I agree, I don't know why a lawyer would advise/allow Jirard to make such a long-winded and defensive video response. Whether or not some type of fraud conviction could be obtained given that the money was eventually donated and (apparently) wasn't misused (just neglected) - I have no idea - but I wouldn't want to be defending Open Hand in this spot.
@@MichaelJMit’s my understanding intent just means they intended to do the action itself (like they didn’t accidentally spend the money) It doesn’t apply to knowing whether or not the action is a crime.
@@MichaelJM”i didn’t know it was a crime” is not a valid defense for committing multiple felonies. if I steal a car and accidentally kill someone in the process I would be convicted of felony murder, even if murdering someone never crossed my mind.
@MichaelJM It seems clear that as Mr. Khalil was busy soliciting donations which he claimed would become the sole property of The Open Hand Foundation, he was fully aware of his intention to utilize a portion of those funds to assist in covering his out of pocket expenses incurred before, during and after, and related solely to, the Indieland webcast production. If it was his intention to use any of the funds donated in this way Mr. Khalil was obligated under California State law to inform his donors of this fact. As he did not, under State law, his actions could be construed as meeting the definition for both felony embezzlement as well as felony charity fraud. This constitutes intent.
Jirard won't sue. It's an empty threat for one reason. It would open him up to discovery. Good luck having the last 10 years of your charity being dissected more thoroughly by a lawyer than it already has been by TH-camrs.
You people do realize he said he knows he’s getting audited right? He said he welcomes it, idk about y’all but this is a dude that has nothing to lose at this point

I can see this in court. Jirard: “Your honor this man looked at public documents and called me out for lying to everyone and holding on to $600k for about 10 years total. Money we said was actively being donated. So we are suing him.” Judge: “Uh…..what?”

To me the most egregious thing he did in his response video was the use of his mothers death as emotional blackmail. He started with her diagnosis and death and then finished with her death whilst also including her autopsy.. wow
I mean, yeah, why the fuck would he not? For one, it gives credibility to why he would want to start a charity in the first place. For two, his mother's body was donated to scientists to study to help aid in a treatment for dementia. The autopsy is there as proof of that.
In all this and even reading stuff on Reddit and Twitter. No one claimed his mother didn't die of the thing he always said she died of. I wouldn't even know what to call a person who would even falsely claim that about their mother. So yes to bring it up is so he could use it as some kind of messed up victim card. That 600K would have gone to much larger uses had it been spread across an entire department as unrestricted funds, and allowed to have been used for training, education, and small project grants. It would have amplified and increased the field and have raised many people up. He's just ignorant I guess but most people also think that way, it's not the first time you hear similar sentiments towards any project. People think these projects (be they science or art) are some magical hole you throw money in and some result is spit out, truth is the money goes to paying for equipment and staff, but if you ever mention paying someone people will accuse that someone of pocketing the money, happens especially on fundraisers.
And yet, because the universe is a complete circus, I feel like he genuinely thought, due to ignorance and a hint of hubris, that the best thing was to wait until he had a large lump sum.
It's nice that Jirard constantly brings up his dead mother who died of one of the most horrifying human diseases as a shield for his lies. He even dropped her literal autopsy report at the very top of a list of tax documents for a scam charity he was trying to get going in her name. I hope I have a son that loves me that much one day.
Definitely agree with Muta, if Jirard was upfront about his charity stockpiling money for a big donation and if he didn't lie about donating or working with certain charities, this whole thing could have been avoided.
The reason he got all that money included him lying about donating and working with charities. They donated nothing until they where caught. The only way they could have been upfront is by saying "we are scumbag liars."
I think it's ridiculous to say they didn't benefit from all this charity work. Doing that stuff is a good look, builds your reputation, attracts an audience based on the high profile people involved in those drives. Maybe they didn't transfer funds, but it's basically marketing for his brand.
This just makes everything so much worse. He could have benefited while also donating the money to charity. His family could have even taken salaries off the top of the charity for managing the funds. All Jirard had to do was to avoid getting too greedy, and trying to steal the entire fund. Which he did. Or one of his family members did. And everyone else either agreed to participate, or at least they agreed to cover it up. What's crazy is that he's willing to drag his mother's death certificate through the online mud pile, instead of calling out the person responsible for stealing money from a charity. If it was a family member, why not pass the blame to them, for stealing and insulting your mother? His actions make me think he's the main person responsible for this crime.

I think Jirard is trying to spin it as, 'all the money goes to charity(the charity specifically being Open Hand). We don't touch any of it(meaning the Completionist's company). This is insane, he literally said the words “we are one of their main funding support partners.” 15:00 That is one of the most damning statements in this whole thing, there’s no other way to interpret that statement besides “money from the open hand has gone to this organization” even though they had received nothing from open hand
@@blakewhite3131You realize it's still a lie even if he didn't know it was, right? You understand that even if what you're saying is true it's still a lie, don't you? I feel like you're implying that makes it not a lie when that simply isn't the case. This isn't about just Jirard it's about Open Hand which is making false claims in that situation no matter what.
2:25 Muta is 100% on the money right here, that was my first thought after I've watched the video, 'Where are the receipts?'. He just quotes numbers for Indieland and the tournamet without providing any proof of those numbers. And regarding the clerical errors, a good accountant can easily hide some missing money.
For me the fact that he's dodging the actual allegations is the biggest red flag to me. Harping on minor points like the e-signature or dragging up random conspiracy theorists that thought his mother didn't die.
Oh, 100% He's not addressing anything. He's using passive language through the whole thing, he's addressing the obviously fake ones because he cannot admit to the true ones. He seems to be very comfortable deflecting responsibility which makes me think he does it a lot.
@defundhollywood3259 yeah, that's the feeling I'm getting too. It really makes me wonder about some of his older stuff. Like the falling out with his former co-host Greg.
@@mage2105Looked like that was also a matter of business organizational negligence. They fell out as people, Greg left, and there was no contract protecting his contributions to the channel so he had to make demands on the grounds of general copyright law. It's implied by Greg's statements that bc they had fallen out and there were no contracts Jirard and the 'business' they had built together decided to just cut all ties and not take care of him, which is most likely why he ended up demanding they take down the videos with him that Jirard & co. were still presumably making money from.
With Jirard thinking of filing defamation lawsuits for rightfully being called out for holding onto charity money for a whole decade, is actually so scummy, and such a big dick move from him.
Not really... Karl and muta literally said the chairty was a scam.. Not in their initial videos but in the other videos they did.. Theres literally no evidence they did anything wrong with that money yet muta and Karl said openly they were frauds and scamming.people.. Especially with the golf money.. There is absolutely grounds for defamation case.. Not sure if he would actually win it but they shouldn't have called it a scam.. Perfectly ok to call attention to the situation but should have left the scam allegations out of it
I just don't think this can hold in court even if suing for defamation is theoretically possible, it just contradicts logic, and the judges use logic, so 😅
I'm no lawyer, but even I know that slander means very specifically "knowingly making false claims to hurt a person's image", not "mean internet man said mean things about me".
@user-hb7py7xy7b exactly. Muta is also protected by the fact he believes what he is saying, regardless of whether or not its true, a reasonable third party would also come to the same conclusions and thus it isn't slander, libel, defamation or any other pathetic cop-out the hipster beard having dolt wants to use.
Jirard would have to prove actual malice in Mutas and Karl’s report, iirc. That would be a huge hurdle for their suit. Since he won’t be filing anything for 10-12 years anyway, Muta and Karl are both in the stronger position lol.
When you won't share your books, but want to sue based on what your books say, share your books. These will be the first thing that comes out in discovery of your lawsuit, so to not post them and threaten a lawsuit is disingenuous and feels like a tactic to NOT have people see your books. Very sus by Jirad.
Why waste time when both Muta and Karl encouraged people to tell the IRS to audit them, which would require them to show the books anyway? Better to spend the time getting the books ready for the oncoming audit.
I have donated well over 10k over the years, this is such a disappointment. I have been contacted from other 10k + donors about opening a lawsuit against him. After his response, I can tell you without a doubt, we will be moving forward with it.
So, do you and the other $10k donors have a secret club or something where you all chat and eat pizza? "Hello. I noticed that you've donated $10k to this charity. That's good. Let's hang out."
Thank you for bringing this to light, Muta. My uncle died from his LBD nearly four years ago. He was barely 60. It was difficult to watch him slowly deteriorate in both mind and body until he couldn't even walk without assistance. My once 300lb jovial uncle who always smiled turned into this quiet 90lb man who wouldn't say a word to any of my family. He died before my mother and I made it to the hospital. We sat with his body for hours until the coroner came to take him from the hospital and every second was spent wondering if he managed to find peace in his last moments. My Grandma said that before we got there, he had said her name for the first time in a year, and told her he felt like he'd been dreaming and he even managed to smile. I cannot understand how someone who claims to love their mother who died from Dementia, could let funds that could have helped combat the illness, depreciate in a bank account without feeling like the scum of the Earth.
There was so many issues with Jirards "apology" that didn't sit right with me. 1. The appeal to emotion. I get how personal the cause is to Jirard, it was his mom and family that were victim's of the disease, but that does not make it relevant to bring up the donation of her body. That isn't what people are looking for answers too. Also just because it is personal, doesn't mean that they are incapable of wrong doing in their fundraising practices. These aspects should have, in my opinion, been left out of the apology. They were only put in to tug at heart strings and distract from the problem at hand. 2. As addressed in your video, the brushing aside of the lies regarding their partnerships with different organizations and universities. I saw all those original clips, they were not poorly communicated, or misleading statements... those were outright lies. And ultimately Jirard was lying, year after year, until caught red handed. That to me is what makes it hard to take anything he says at face value. 3. Leaving open hand. I find this decision kind of odd for a man who is insisting that they are above board, did nothing illegal, ect. If they haven't done anything wrong, why leave? Continue raising money like you have been, keep doing the fundraiser. To me the decision to distance himself from Open Hand strikes me as very cautionary to avoid future issues. You know, in case of an audit, in case things go south, and it feels very deliberate to protect his brand (and even in the call with Karl and Muta, you can tell he was very much concerned with how all this was going to look for his brand, and what he had built.) 4. The legal threat. This one really did come off as puffing his chest, cause I don't really see how he can come out so confident after he does basically confirmed that they had misled, and mismanaged the money. Also now that we've heard the convo, we really can say that it is thanks to Karl and Muta that the donation was finally given. So people giving Jirard a pat for finally donating and saying "oh well he's done right, lets forgive" ... remember that is only because they investigated him. To me Jirard will have to re-earn that trust back. These were the immediate things that really didn't sit right with me, mind you I did notice when I peeked the files, that it was a whole load of nothing burger, and everything else that was great to hear, was said without showing the receipts. To me Jirard made a very carefully, constructed reply (probably with the help of a legal team) to try and shift public perception on this matter, and simultaneously threaten to try and get the people investigating to back off. Which again, just raised flag for me. Found it so strange to see people giving this apology a pass, but some people really are easy to sway with emotional appeals.
A side note, as I've followed this story, I strongly believe that Jirard's end game strategy for this whole controversy will be to put the blame on his father and brother (and I think they will be A-Okay with that, they will take the bullet for him). I think what I mentioned in my third point is the fist step of this move. Jirard stepping down from Open Hand, and dissociating with the fundraiser. Now thanks to Muta sharing that new clip form their initial interview I'd say the seeds are there as well. There is that mention of dispute with his family regarding the fundraiser and the money. He also had mentioned that he was "in the dark" on the status of the money being donated (finding out in 2022) ... insinuating that another family was the one taking care of that. So again, the seeds were planted to give him an out, that he was unaware, that there was some familial dispute, ect. I think that will be his final plot for an Exit scheme. Like a snake shedding it's tail to escape being caught. His last ditch effort to absolve himself of all responsibility for what happened. Mind you that might be trickier after that legal threat where he seemingly stands by his family's name, and instead chose to use his mothers' death as a shield for any criticism. So wonder what path he will ultimately choose.
Honestly regardless of the intentions gone into the charity itself the way he has been handling things when people have put his feet to the fire over it is very telling. A lot of what you point out seems to indicate that he is mostly upset about his brand with this and is trying as hard as he can to not actually do right but swing the narrative back in his favor and get out of the way. It very much seems like someone that is mad that the screw up was discovered and went instant rage defense mode rather than someone who messed up and is trying to make things right. By his own admission he knew the funds were just sitting there for at least a year and went on to lie and needed his arm twisted to get the money actually donated which is just incredibly sad. The saddest thing honestly is that due to inflation that the donations legitimately went down in value compared to how much it would have helped if donated when they should have been
Except for the parts where muta accused him of commiting multiple serious felonies, his family of the same thing and then directly called for his audiance to flood the local and federal legal system with reports (this is also known as harassment and incitement). But yeah, lets just gloss over that part and focus on the parts that would obviously be silly
As an accountant, I took the book of the sad story of why the Open Hand foundation was founded and tossed it in the trash. Doesn't matter. In the words of Jerry Maguire: Show me the money. Give me bank statements. Give me receipts. Give me e-mail correspondents with these partners you claimed to have been working with.
The fact that Jirard included his mom's autopsy report for whatever reason is beyond wild. Nobody was ever questioning his mom's illness or her death 🤡.
Oddly enough there WERE comments questioning if his mom really died in the first place or if he was lying about it. There weren’t a lot but it does exist
I firmly believe that Jirard thinks him stepping down from his position in OHF will somehow help him wash his hands of this whole debacle, which it obviously won't.
@@brettlawrence9015 yeah I recon he read some of the responses about restricted donations and went with it since it would be a reasonable reason to hold on to the money. But he’s lying cause he spoke to Karl and Modahar and didn’t mention anything like that. He’s back peddling and stepping down because he knows no one will trust him and he thinks he can just get off with no back lash.
I think another aspect is that Jirard does not appreciate the moral conundrum here. He seems to just think if he proves they technically were not doing any legal wrongdoing, he's all good and this is all being blown out of proportion, he's being bullied, etc. Desperate and manipulative people use all the tactics he used. Clouding judgement with emotional hardships, smokescreen by addressing irrelevant, pointless claims, getting visibly angry and threatening a lawsuit to intimidate, apologizing for people "feeling a certain way" instead of addressing the real reason why people are upset....etc. He is so offended people want to look into him when they have legitimate reasons to do so. He acts so fishy it's impressive.
Good point. But I think Jirard is well aware of the moral conundrum. He did make that comment on the discord call that there is the issue of legality vs morality. I think that there is so much more he would want to say but since they've lawyered up, he his has to go off the script. I think a lawyer would have him avoid the moral side because it would imply guilt. But even then I could be wrong because by the end of Jirard's response he leans so far into the "righteous indignation" character, claiming to be the victim himself. He made it so much worse by doubling down, that's for sure...
For Jirard to sue would be legal game ending for him. That's either an empty threat; or a really stupid move. He sues, *everything* will be brought to light. Lawyers will have a field day requesting discovery on everything tied to his charity. Part of me would love to see this happen, if he's serious, lol
@@kobra6660you realize a lawyer will try to account for EVERY cent. And all those "harmless miscalculation" will be completely blown out of proportion (because that's what lawyers do). It'll be easier for a lawyer to argue fraud then for a lawyer to argue defamation

Muta and Karl are responsible for this 600k getting donated at this point. Not the completionist. They put more effort into making it happen than he ever did apparently.
As somone who works with charities, the fact that he has tens of thousands of donated $ *spent and listed* as "administration costs" is insane. My charities costs are high as we are all over my country helping a lot of people. I HAVE TO report every PENNY. This means that when i need food for guests or pay the bills for the workspace or buy something for the work space I MUST get the recipt. attach it and send it to the tax office to be looked over. This means my meals cant be a steak and red wine, i cant buy a 3000$ gaming PC for work etc. P.S Most common way i saw charities steal money is by asking the sponsors to provide them with stuff that they would need for the event. Then proceed to write the cost of those things as if they bought/rented them and pocket that money while showing they have said things.
Way, way back in the day, Jirard had a cohost on the channel. Out of the blue, he one day left without fully explaining why, but it was under not so pleasant circumstances and his opinion on Jirard was clearly soured by the experience. Not to mention the charities he claimed to be connected to can sue Jirard, asking for the money due them based on his misleading statements. There's always records
Every single one of these conmen immediately pull their lawsuit once they realize they have to go through the discovery process. It’s so funny and so telling

The fact his fans on twitter have completely forgiven him and are acting like Karl and Mutahar are merely clout chasers trying to profit from the situation is absolutely mind-boggling. The man lied to the public for a decade and pocketed half a million dollars and people are still jumping through hoops to defend him. Mob mentality is a terrifying thing
He's already been caught making explicitly fraudulent statements, lol. He should have just taken the fuckin L like he said something about in the first video.
There was no ukulele, but this was a classic narcissistic response: bury the real issues under distractions chosen to appear as receipts like the autopsy or links to IRS definitions, distract, deflect, and then claim to be the real victims.
He quite literally said they are legally obligated to use the money for administration costs. Which makes it even more clear why they wanted to make sure the money couldn't be used for anything but the intended purpose by whoever got it. Like he said, an open donation will be used for salaries, expenses, and even bonuses. How much are you willing to bet that at least 50% of that money they were now forced to donate will be used for anything but the intended purpose.
@@tehSunBro and were they legally obligated to spend that much? or to put the money in an interest free account so that it just loses even more money to inflation? and even if the funds aren't used for a specific purpose, as long as they actually managed to find a respectable charity, after 10 years of research they fucking should, the money would still go to helping the charity operate and help it continue to raise money for charity instead of it just sitting in an account losing value. Get better arguments. edit: they also made a restricted donation anyway since the charity published a breakdown of what the money would be going to, again get better arguments.
@@tehSunBro What is intended purpose ?? In this time where we have alot of watchdog organization good rating organization have under 20% admin cost, I didn't bother to look what rating of the org he donate to but if he do his work for at least 30 minutes he can easily achieved your low bar of 50%. But if your intended purpose is where he can pinpoint where every cent goes I guess it is weird and too hard for almost all organization.
@tehSunBro Guess what, brain research and doctor's don't work for free or for cheap, and research centers also need accountants, janitors, receptionists, maintenance workers, security. Also those staff are gonna need staplers, pens, paper, printers, printer ink, desks, cleaning supplies, lab equipment, water and electricity, internet network ect ect. It sucks to feel that part of a donation goes to things like those but that's just how it is and honestly restricted donations marked for a singular purpose make it harder for research organizations to operate.
Im confused on what the point of it wad though. Isn't the type of account the money is set in specifically for charitable donations and wouldn't the IRS (Or the bank, idk) easily track but also in some way be notified were he to take the money?
What was he getting away with? Lying that they made donations? Is that something to get away with?? I truly am having trouble when folks say this as to what exactly he was supposedly gonna do.
@@BullFrogFace Nah, there's not some alert system. If no one reports them to the IRS, then this is what would happen: After the final indieland stream for the 10th anniversary and probably golf tournament, they'd wait for a year, and when everyone had completely forgotten about the charity and it was all in the past, they'd take all the money and split it between them. As long as no one reports you, the IRS literally will never check. They have way more cases then workers. So Jirard and his family would have walked away with a huge payday, easily hundreds of thousands each (they're still lying about how much money they made). They got caught and that's why he's so mad. Because they were almost at the end of the scheme to make them all very rich.
@@MetaSynForYourSoul Imagine, after this year he does his last ever Indieland stream, and the charity permanently shuts down. Then, in a year or two, with no money ever being donated, Jirard and his family go and take it all out of the account and split it between them, making them all very, very rich. If these videos never get made, they never donate. It's clear they never intended on donating a cent. They only donated anything when they got caught, and it 100% is provably not the full amount they said they would donate. So there's still funds that are hidden and not reported. That was the scheme and they almost got away with it. It is only Karl and Mutahar that stopped this from happening. That's what they were getting away with, the exact type of charity fraud that happens across the world every single year. It's not a new scheme. They just got caught in time.
The response on X was so fucking wild. So many people believed this dude, taking every single thing at face value, while not even bothering to read the links he showed. They were all bait. Every single one. The only one that had any merit was the one to change to a public foundation. Linking his mother's autopsy was despicable. I feel so sorry for her.
You know it's bad when fuckin' Keemstar replies to his tweet with a bunch of CAPSLOCK like a 12 year old, and all I can think is "you know what, I agree with keemstar" lol
Jirard becoming visibly angry at the tail end of his response was infuriating af. Not only was he in the wrong to have traded off the back of charities' names, but it comes across as disingenuous, and more that he's angry to have been called out and his squeaky clean rep to have been damaged
Karl and Mutahar dared to not buy his wholesome, happy youtuber persona, and called out his inconsistencies. The "nerve" of that probably pissed him off as he's used to being a lovable youtuber guy.
Him getting angry isn't surprising. Either he's innocent and is mad that they are destroying his reputation for no reason, or he is guilty and pissed that he got caught and called out. Either way, the anger is not a shocking development.
While they were right to bring this to light both mutahar and Karl have brought up points that could have been solved with a little research. There were clear negligence on thier parts when pointing out exactly what he did wrong and it would make anybody mad
It was in your initial interview with him when he defeatedly just said "You're just going to say whatever...." that I got the impression that this isn't just innocent negligence, and that a scammer knew he'd been caught. There's still more to this, I bet
Throughout he was focused on how it all made him look. Not how to fix the problem. Donating the money makes it look like he has something to hide? Really? I'd have thought the opposite. If I were him I'd have donated it, got on the call and said "The money has been donated because I want to make this right. I can't make it 100% right, but I can correct the biggest wrong so far and take steps from here to fix the rest." Continuing to hold onto it just made it look like he cared more about his image than actually helping people.
@@DragonNexus Worrying about how it makes him look only makes sense if he's aware of foul play. @@luisarroyo7656it could also be for legal precedence if he ever does go to court whether against Muda or from the IRS. @@Skylancer727 That's very fair and well put. There were multiple things he could've done to prevent himself being put in the position where he felt he had to make a response video in the first place.
@luisarroyo7656 Like I said, the main things he seemed to target are the claims of embezzlement which were always a huge stretch. Considering the charity was run entirely by his family it's likely they just have no idea what they're doing. 22:34 I just want to point out Muta completely missed why the UCSF keeps getting mentioned by Jirard, which is because that's where his mother's body was donated. That's why he brother described the UCSF as a "historical donation" in his letter, and why Jirard seemingly randomly gave out his mother's autopsy report. However, the single donation back in 2014 doesn’t technically constitute as "currently working with" an organization when it's a single donation. "Current" implies contributions being made or services being provided at regular intervals, or within a recent period of time. What the OHF technically did was "previously worked with" the UCSF, which is not the same. I'm going to go out on a limb and say Jirard sees it as an active contribution given how they donated his mother to them, and that they could be to this day still referencing samples that were provided by his mother. Still, that single word "current" was not a correct statement. To compound things, Jirard in his response did not note this, and instead the entire statement about his mother came out as random and pandering. AT NO POINT did Jirard ever mention the UCSF or why he was providing an autopsy report, instead leaving it up to people to read the footnotes and figure it out. This is baffling, when the UCSF "partnership" was something that was a large contradiction amid other statements. Muta really should have caught this, but Jirard's response was also very lacking.
wait, so my mom dying of cancer, and me signing that piece of paper that said they could donate her tumor and stuff for research allows me to start a charity and pretend im "actively working with them"? wow... to have the gull to be that misleading is some major narcissistic action right there.
My wife worked in non-profit. They want funds to be unrestricted because donors don't actually know what the community needs the most. Her employer did accept restricted funds but she said they almost always achieved nothing.
I'm curious on this point because I suspect some of Open Hands "restrictions" might be pretty extreme, like free PR or extraneous benefits that would be more for Open Hands benefit than actual research benefits. In your experience, did you ever have donors with so many strings attached that it seems they were more "purchasing" your endorsement than they were actually benefiting your org.? Edit: I suppose this question would be for your wife
@@momzwrite This is one point that I think makes more sense to put down to incompetence rather than anything nefarious. It's not like they're saving money by restricting the donation - if they only cared about getting an endorsement, surely they wouldn't care if the donation was unrestricted?
Thank you for saying this. Event Muta in his previous video said “restricted funds would keep the money out of charity president’s pockets.” Which stigmatizes charities as needing to be handcuffed by restricted funds to actually get work done. We can all think of the big bad ones that engage in that type of activity like Wounded Warriors or Think Pink, but the vast majority of charities work on slim budgets as they dedicate their funds to doing what they actually say. People in charities do hard work as deserve to be compensated for that work. Charities should have the opportunity to hire new employees to expand their operations and do more good. Restricted funds can sometimes get in the way of those activities and painting them as the only right way to give to charities is just wrong.
It never achieves anything. You make 600k not go into ceo pockets? Ok they will just take that share from the unrestricted ones... end money distribution is exactly the same.

I thought it was insane they felt they needed to release his mom’s autopsy report…like why would they need to do that at all??? No one was raising questions about his mom’s cause of death whatsoever. Crazy shit.
He's trying to play the sympathy card and also prove his mother had it. What's strange to me is that if they know she had this why was an autopsy performed at all, unless it's a normal thing when someone dies that happens.
I wouldn't be surprised if some took it to the extent of questioning if the cause of death was really dementia. I thought may be he'll attempt to paint the critics more unreasonable than they are, like how some people jump to the opportunity to claim death threats were made even if they were not, but he didn't. There's no court that will ever come to a conclusion that this is defamation. I'm not even sure he watched any of the the videos he claims harassment is why kind let alone defamation.
@@RyukoNWM He literally said "allegations or criticism," and you also called them allegations. I don't see why you got hung up on the word "criticism" when the sentence was a broad condemnation of people using frivolous lawsuits to attack people who do either. If you are an investigator and you are sued either you are about to succeed or you done goofed. And The Mutahar/Karl alliance was careful to avoid goofs.
Two things happened from this whole ordeal, $600k was donated to a charity that otherwise would have never been, and I unsubscribed from the Completionist and subscribed to Karl and Muta
Not to mention how difficult it is for a plaintiff of a defamation suit to win. You have to prove that the actions of the defendant had a real impact on your brand/image. Some hearsay like, "Well, so and so said xyz and I that's bad for my brand..." If you can't prove it, you won't win. That said, a lawyer would definitely advise against pursuing a suit, but you're free to ignore their advice. They'll gladly accept payment should you decide to proceed with the defamation suit.

@@ashandari1 Legal action is worse than any amount of death threats.
@@MichaelJMit’s my understanding intent just means they intended to do the action itself (like they didn’t accidentally spend the money)
It doesn’t apply to knowing whether or not the action is a crime.
@@MichaelJM”i didn’t know it was a crime” is not a valid defense for committing multiple felonies. if I steal a car and accidentally kill someone in the process I would be convicted of felony murder, even if murdering someone never crossed my mind.
@@quin_e You would be correct.

You know, in case of an audit, in case things go south, and it feels very deliberate to protect his brand (and even in the call with Karl and Muta, you can tell he was very much concerned with how all this was going to look for his brand, and what he had built.)
@@the_maverickk I think you're spot on; especially about his emotional manipulation & exit strategy.

P.S
Most common way i saw charities steal money is by asking the sponsors to provide them with stuff that they would need for the event. Then proceed to write the cost of those things as if they bought/rented them and pocket that money while showing they have said things.

For someone so vehemently opposed to charity admin costs, they sure don't seem to mind claiming some fairly hefty admin costs of their own.
He quite literally said they are legally obligated to use the money for administration costs.
Which makes it even more clear why they wanted to make sure the money couldn't be used for anything but the intended purpose by whoever got it. Like he said, an open donation will be used for salaries, expenses, and even bonuses.

As long as no one reports you, the IRS literally will never check. They have way more cases then workers. So Jirard and his family would have walked away with a huge payday, easily hundreds of thousands each (they're still lying about how much money they made). They got caught and that's why he's so mad.
