Way back in the day I was pulled over for a suspicion of DUI. Cop made me preform the dance of proof of sobriety. It was cold out and windy as f. I was wearing a heavy coat and new shoes hurting my feet. I weighed about 100 lbs at the time and the wind pushed me. I was taken to Lew Sterret Dallas. I needed to pee and they wouldn't allow that. I knew I wasn't legally intoxicated as I was a bartender and was TABC certified. After I passed the humiliating song and dance routine within the walls of the jail center I, was released. But not after I had to force air from my lungs to the computer reading my blood alcohol level. I wasn't drunk. I was finally allowed to pee. The arresting officers had to drive me home. At that point I, started to get not ugly but I definitely was being rude not rude but making fun of them. The next weekend, I was driving to work at the bar in Deep Ellum where I worked and was pulled over by that same cop! He pulled out a pen light and asked me to follow it with my eyes. I asked him if I'm being harassed. He immediately pretended he got a call from dispatch and left. I never got harassed by that butthole again!
I understand why they call it drunk in public but why do they call it legally drunk? It seems to me at that point that the person is actually illegally drunk.
I find this one interesting, you see where I worked as a police officer, the public intoxication laws were overturned back around 1977, I can recall arresting drunks on the street during my first time as a cop in '73 but when I returned from service in the Army, the law had been overturned and alcoholism was proclaimed an illness. Sure we could still take a drunk into custody, however we had to deliver them to an alcohol treatment facility, which consisted of a small secured apartment maned by members of AA who detoxed the individuals, and they were let go. Actually I liked this very much, it was quick, easy, you didn't have to deal with puking drunks in the jail, and there was no court involvement. Also the person who was taken into custody rarely if ever gave any fight, they were happy as hell when informed that they would be dropped off at detox.

I reived a dui in commercial vehical.11 yrs ago.i was drinking in truck while i was on my rest so.because key was in and truck running.i recieved an arrest and charged..in indiana..whem i went back to Pennsylvania.i was arrested for voilation of probation.was in jail for yrs.got out it had been seven yrs.now its 11.i was locked up and extradited back to indiana.they are now still trying to sentence me..but there are statues of limitations right?? Can u give me advise??? Please help

Im not saying your story isn't true and that there is more to the story, but the way you wrote it, nobody would believe that that's all there was to the story. I know there are unbelievable injustices in society, and i sympathize with you tremendously if you were treated unfairly. My only point is to try to help you come across better.

My neighbors call the police that I don't get along with them I'm constantly being harassed the officer did not read me my rights plus I had a seizure and was in the hospital I was so upset and embarrass. I woke up in the hospital what a police officer choking me just happened in Hanford California. I'm disabled I have a history of seizures and I just hit my toe amputated.
if no bac or breath test then where is the burden of proof? i understand there is no set limit like 0.8 for d.u.i. but the word of an officer that "he seemed drunk" is not proof enough as we as humans are fallible. prove to me that he is guilty!

Iowa law is even worse...It does not state BAC and the HUGE misleading factor is ..."impersonating drunk". That means a cop can say "he was acting drunk". Maybe a person was just laughing in public and happend to fall. Well then it my word against the cops.
Sounds like you could be arrested for this at the officer's discretion, even if you didn't have a drop to drink. Scary. The only saving Grace is that if they use it too much they will loose it.
This law gives cops way too much power. Seems like the burden of proof for intoxication should more severe. A cop just saying "he seemed drink" in a dui case would never get a conviction.
I agree. You could have one drink, not be intoxicated at all but still smell like alcohol. I just got arrested for this and I'm pissed off. Wasn't doing anything wrong or out of the way! They treat murderers better
I sure have gotten convictions on the 'he seemed drunk' testimony when the person refused the breath or blood test under informed consent statute. Sure they lost their license, but when it was a case of falling down drunk, puking on my boots drunk, then we went forward with the case and that testimony indeed did result in a conviction.

i haven't seen the whole video yet but if a cop asked you "on a scale from 1 to 10 how impaired do you think you are?" ALWAYS ALWAYS ALWAYS say 0 (zero) if you give any number other than an absolute zero you just confessed to being impaired and can and probably will be charged with a DUI or impaired driving. its another trick question the cops will pull on you to get some sort of answer they are looking for to make an arrest. there has been only once i was pulled over and a cop asked if he could give a breathalyzer test to me. i said its okay only because the last time i had any amount of alcohol was nearly 2 months before that and i just wanted to get to my camp site cause i had an angry wife next to me and a baby that needed a diaper change and was crying. in the area where i was pulled over was a party area for river floaters. DUI is rampant in the town around that river in SW Mizzou. usually if i have had any amount of alcohol when ive been river floating i just walk. id rather get a public intox than a DUI. once i had a cop give me a ride in SW Mizzou to my camp site
I know no shit you say you had one drink before you over when they pull roadblocks I got taken from in a road block and my girlfriend had a big mouth and they told me I didn't tell you to park over there I said I was just backing up sorry and then they took me to jail and they handcuffed me in the in the where the cars are in the garage on a bench
