Very impormative, here's my question, nanyare kc ung case ng data privacy. 2015 pa. Pede ba ako mag habol sa nag disclosed ng personal information ko. Sa bank nayon. Sinabi kc ni attorney na 2016 nag effect ang batas.. Pede ba ako mag habol ngyon 2020. To file a case against them.
Hello. Covered din po ba ng DPA ang "corporate information"? I'm pertaining to the cloud storage by Google, Amazon, Apple, Autodesk, and etc where the private companies subscribed. I know that there are several terms and conditions agreed in prior to subscription but how does this correlate to our DPA 2012?

Hello atty. May tanong po ako pasok po ba sa batas na ito, na kapag ang isang tao ay binuksan ang internet account na walang permission sa totoong may ari ng account. Tapos nangialam siya sa mga messages then she did screenshot and send to the other person.
ang picture po ay naka public post sa facebook, pag ang picture po ba na naka public post ay kinuha ng walang pahintulot o hindi sinabi sa may ari ng pictures na yun at yung pictures na yun ay gagamitin bilang ebidensya sakanya ay pasok po ba sa DataPrivacy Act at hindi ba sya valid bilang ebidensya?
Atty paano pag hindi available iyong recipient paano kukunin iyong package o request halimbawa birth certificate dahil hindi raw accepted iyong authorization? Ano ang mabisa o valid Para iaccept ng agency iyong reason. Salamat po.
Atty., maari ba aqng magtanong?Ang company nmin ay nagcreate ng gmail accounts for each employees para magamit nmin sa communications like email at chats. Is it legal na hingin nila or palitan nila ang password without your permission. Kasi even sila ang gumawa noin, may mga personal at sensitive information parin ang nakalagay dun like private messages sa another employees and alike. Is this subject for data privacy? Thanks po
Atty. paano po kung ang gusto mo kunin eh kopya ng brgy blotter or "minutes" sa hearing sa brgy eh ako naman po ang complainant?.. yan po kasi ang ginagawang rason ni kapitan para hindi daw po ako mabigyan ng kopya ng minutes or blotter.

A customer service personnel refuse to give her name, ..may complaint Kasi Ako SA isang Malaki at known n tindahan hinihingan ko Nang pangalan ang customer service nila .. nag refuse po siya ..tama po b ang ginawa niya or Ako ang Mali.

Good day, our graduation day was streamed live & recorded & uploaded to the website but removed suddenly.. my school does not want to share a copy of it because they say that it is due to data privacy act..are they correct?
If there was a data subject that did not provide consent or even objected to the publication of the content on the website, there's justification to take down the video from the site

1. How to know that there is consent by data subject?
2. In the social media. For example, they disclose thier regular info and some sensitive info like bday. Is it considered as consent from the data subject?
1. Consent has to be explicit. Best if the consent is documented even if obtained through digital means
2. Birthdays, especially when the year of birth is included in the information requested, are sensitive personal information

Pano po yung mga remittance center cebuana or Palawan. Insisting na mag member yung mga may remittance. Data they are requiring is name bday mothers maiden name etc.
I had an experience with cebuana ayaw e release yung remittance ko because I don't want to be a member. Binasa ko kse yung clause, they said if I agree they can share. My data to whoever. Which I don't agree to.

Depending on the content of the photo. It may be covered by cybercrime law or by anti-photo or video voyeurism act if it contains sexual acts of other persons without their consent or contains private parts of person without his/her consent. Surely, the image will not be covered by Data Privacy Act except when such image contains the personal information of a person without his/her consent as discussed in the video.

Depends on the context. Kung recorded ang class discussion niyo for educational purposes (for example in case needed yun in case may student na Di nakaatend ng klase para marining din niya yung discussion nyo) pwede yun. Katulad nga ng sinabi nila, there should be consent from both sides. Dapat informed lahat ng involved and you have the right to remain silent kung ayaw mong marinig ka sa recording. As long as valid ang reason ng recording nila and nag agree lahat sa pagrecord, it is legal for them to record class discussions.

The right of an individual not to have private information about himself disclosed, and to live freely from surveillance and intrusion.
Rule XIII. Penalties
Section 52. Unauthorized Processing of Personal Information and Sensitive Personal Information.
a. A penalty of imprisonment ranging from one (1) year to three (3) years and a fine of not less than Five hundred thousand pesos (Php500,000.00) but not more than Two million pesos (Php2,000,000.00) shall be imposed on persons who process personal information without the consent of the data subject, or without being authorized under the Act or any existing law.
