Ive have had 2 expungements about 2 years prior to moving to a neighboring state and they still showed up on a background check so i had to write a letter explaining it which was super awkward and upsetting because WTF

This occurred 10yr ago. I got the job and continue to be employed with them. I guess in most cases the expunged records won't appear but if you have a level 2 background check and work with vulnerable populations then sealed or expunged records will still show up; A fingerprinting background check will still show them and 3rd party background check companies may also show it. I just remember when I got the expungement the courts made it sound like an expungement was supposed to be like it never happened.
What if the expungement was a felony more than 19 years ago and expunged 17 years ago? Keep in mind I work for a government agency and the check will be done through the county sheriff. Will the expungement or arrest still show?

Such as Canada Canada does not allow a entry or residency to anyone that is a felon. Are they going to check for that when you get off the plane who knows but if they find out you are a felon they do have the right to exclude you because it is part of their own laws. US law only applies to the US and a country can deny you entry for any reason they so choose up to and including criminal records. You only need a passport if you are traveling and only because they don't do criminal background checks to simply go site seeing in a country; but if you are trying to establish residency; they can background check you, and they can decline.

If it is important to you to be able to vote, why don't you get an attorney. I'd say it is a two-step process. An expungement prolly does not automatically lead to a restoration of your voting rights. They may have to be applied for thru a different process.

I had a couple hints from a coworkers wife who was a paralegal but I did all the legwork, including filing and finding my case numbers from the prosecutors office when they didn't want to help in the least. The whole process and language used is meant to be confusing and discouraging to keep us regular folk out of the courtrooms unless its as a defendant. But filing simple motions like expungements are basically an eligibility based motion. You're either eligible or not there's nothing to judge other than whether the petitioner of the court meets the states requirements and is therefore eliglble. ..whichis, with a little determination, totally feasible for the legally challenged layman. The DMV refuses to expunge DUIs, which is what an employer can request.
