Jai Hind sir 🇮🇳 ⭐=>न्यायिक समीक्षा और न्यायिक सक्रियता के मध्य अंतर। 🌼न्यायिक समीक्षा एवम न्यायिक सक्रियता की अवधारणा एक दूसरे से जुड़ी है परंतु इन दोनो के बीच निम्नवत अंतर है ÷ 1-न्यायिक समीक्षा के ही एक रूप को अमेरिका मे न्यायिक सक्रियता के नाम से जाना जाता है। न्यायिक सक्रियता; न्यायिक समीक्षा का वह रूप है जिसमे न्यायाधीश न केवल विधि निर्माण की प्रक्रिया को देखते है बल्कि विधि विधानों की रक्षा तथा कायम भी रखते हैं। मूल अधिकारों के हनन होने पर संवैधानिक प्रावधानों को अवैध भी घोषित करते हैं। 2-न्यायिक सक्रियता, न्यायिक समीक्षा मे ही निहित है।न्यायालयों को संविधान को कायम रखने या संविधान के लिए अनुपयोगी प्रावधानों को निरस्त करने की भी शक्ति है। न्यायिक सक्रियता सरकार के अन्य अंगों को कर्तव्यशीलता एवम् सक्रियता के लिए जरूरी है। 3 - न्यायिक सक्रियता; न्यायिक समीक्षा तथा मूलभूत अधिकारों की रक्षा के लिए न्यायपालिका के महत्व पर जोर देता है। 4-संसद और विधायिका द्वारा पारित किए गए कानून यदि नागरिकों के मूल अधिकारों का उलंघन कर रही है तो न्यायपालिका को हस्तक्षेप करने का पूरा अधिकार है तथा संवैधानिक मामलो को निरस्त करने की भी शक्ति है। "यदि हमारी न्यायपालिका अपने कर्तव्यों का निर्वहन करने में असफल रहती है तो भारत के नागरिकों के मौलिक अधिकार आडंबर मात्र बन कर रह जाएंगे। और उपचार के बिना अधिकार पानी पर लिखाई जैसा ही होगा।नियंत्रित संविधान अनियंत्रित हो जाएगा "

⭐=>न्यायिक समीक्षा और न्यायिक सक्रियता के मध्य अंतर। 🌼न्यायिक समीक्षा एवम न्यायिक सक्रियता की अवधारणा एक दूसरे से जुड़ी है परंतु इन दोनो के बीच निम्नवत अंतर है ÷
1-न्यायिक समीक्षा के ही एक रूप को अमेरिका मे न्यायिक सक्रियता के नाम से जाना जाता है। न्यायिक सक्रियता; न्यायिक समीक्षा का वह रूप है जिसमे न्यायाधीश न केवल विधि निर्माण की प्रक्रिया को देखते है बल्कि विधि विधानों की रक्षा तथा कायम भी रखते हैं। मूल अधिकारों के हनन होने पर संवैधानिक प्रावधानों को अवैध भी घोषित करते हैं।
2-न्यायिक सक्रियता, न्यायिक समीक्षा मे ही निहित है।न्यायालयों को संविधान को कायम रखने या संविधान के लिए अनुपयोगी प्रावधानों को निरस्त करने की भी शक्ति है। न्यायिक सक्रियता सरकार के अन्य अंगों को कर्तव्यशीलता एवम् सक्रियता के लिए जरूरी है।
3 - न्यायिक सक्रियता; न्यायिक समीक्षा तथा मूलभूत अधिकारों की रक्षा के लिए न्यायपालिका के महत्व पर जोर देता है।
4-संसद और विधायिका द्वारा पारित किए गए कानून यदि नागरिकों के मूल अधिकारों का उलंघन कर रही है तो न्यायपालिका को हस्तक्षेप करने का पूरा अधिकार है तथा संवैधानिक मामलो को निरस्त करने की भी शक्ति है।
"यदि हमारी न्यायपालिका अपने कर्तव्यों का निर्वहन करने में असफल रहती है तो भारत के नागरिकों के मौलिक अधिकार आडंबर मात्र बन कर रह जाएंगे। और उपचार के बिना अधिकार पानी पर लिखाई जैसा ही होगा।नियंत्रित संविधान अनियंत्रित हो जाएगा "

Judicial overreach:It refers to the situation where a court or judicial body exceeds its legal authority or jurisdiction, typically by making decisions that should properly be made by other branches of government.
Judicial overreach can be controversial, as it can lead to conflicts between the different branches of government and can undermine the separation of powers which is an important principle in many democratic systems.
