When I was in jail we had a young Muslim woman come in one day. She had her hijab and at first she would always wear it, she almost kind of hid under it, stayed in her cell a lot and kept to herself. But after a month or so getting to know the other girls, she wouldn't even wear it over her head anymore (this was a woman's pod and we only had female guards), she just let it kind of hang loosely over her shoulders so if for some reason a dude walked into the pod ( like a nurse, a trustee, a supervisor), the first to see them would yell "Male in the pod!" to let her know and then in a flash she'd just put it back on over her head. As much as she hated jail, she did once tell me that there was something freeing how about being able to go without her head scarf around so many people, she wished that there were more all-female gathering opportunities in the outside world. EDIT: People keep asking me why I was in jail, and why she was in jail. I tried replying a few times, but for some reason it keeps getting deleted, so here goes: as I recall, she was being held in county jail waiting to be picked up by ICE (immigration). As for me, I was a heroin/fentanyl addict for years, I ended up in jail (many times) and prison (once) for possession and stealing (I would shoplift stuff like CDs and DVDs to sell for money to buy drugs) initially, but mostly for probation violations for not being clean. The last time I was locked up was right before the pandemic hit, 6 months of quarantine which basically constituted solitary confinement gave me a lot of time to think about how I never wanted to be there ever again. Now 4 years later, I'm sitting on my couch in my own house watching the Olympics with my wonderful and supportive boyfriend, our much loved dog, and our precious amazing 2 year old little girl. We do recover!
It’s actually law due to PREA (Prison Rape Elimination Act) that it must be announced when a male or female staff enter into an area. It wasn’t specifically to protect her.
I can explain why she put it back on when there was a male in the pod. I've been told that Islam teaches that women are not supposed to show their hair to anyone except their husband, their brother or their father. They don't have to wear the hijab until they get their first menstrual cycle. I was talking to a guy who was actually from Iraq yesterday. He was telling me that they don't enforce it anymore. It's an optional thing. It's just about modesty and vanity. They believe that no one should see your body except for your husband which I can kind of get behind. I can see where they're coming from. I'm not downing anybody who chooses to live a free lifestyle let's just say but while I don't like the restrictions that are placed on women in Middle Eastern countries, I can get behind what they're about with doing that. There was this girl at my school and she was a Muslim. She has gotten tino an argument and a few girls snatched off her whole hijab. Everyone started looking and I’ll admit, I looked too but felt horrible after seeing how she reacted. Since then I’ve apologized many times to her and even gave her gifts as an apology cause that must’ve been very traumatizing. We aren’t friends but I still respect her when I see her.

@Anabyakhkaq They would have to figure it out with the sun, they can make wudu and they can pray without a prayer rug if needed but upon request prisons allow people to have bibles so they should allow Muslims to have prayer rugs and Qurans.
@@meggiemills3602 I have heard through another party (so I can't really verify the accuracy) of at least one U.S. jail that has prayer mats available only if purchased through commissary, at least circa 2022. I fully agree they should be provided if requested in all institutions.
Not exactly in jail, but there was a muslim gal in the psych ward I was in who wasn't allowed an hijab, nor did they have a Quaron in the small book section (they had atleast 3 bibles) She requested one as much as she could, and thankfully a nurse used their own money to buy her one. I've always found that such a sweet gesture, even as an athiest, I know religion is a massive comfort to many people.

They should offer lots of books, nature, etc. This treatment is so ill. I know some individuals are working on improving the clothing allowed in psych wards. I've been studying some of the psychology done in the 9th century by Muslims. There was no disparity between mental and physical illnesses. They'd use nature as part of the healing. There is also some Islamic psychology practiced today (not limited to Muslims). In the US, there are some universities that have different faithed-patients. May you and that Muslim gal find health and healing. May peace be upon you.

A Velcro close would work fine and make it short enough to be safety compliant. A swim hijab might work. Or at least a beanie or something for her to tuck most of her hair into!!! It's not that deep and you act like in real life most people would know it's religious and not just a head scarf if you gonna commit crimes you don't care about your religion enough any way and they shouldn't risk other people's safety and let then wear it in jail anyway

As a muslim it's fine to do a strip search but it has to be another woman who does it, the only reason we wear the hijab and cover up is to protect our image from strange men and be closer to our god, it's fine for other women to see us, thanks for the informative video too! @@catsarecute-ps8zw I thought that you had a right to be strip-searched by an officer of the same gender, but I looked it up and it's not the case at every prison. I would be so scared if they had a man strip search me and I couldn't do anything about it. The right to a same-sex strip search should be federal law, and not just from a religious perspective. Also as basic human rights. Committing a crime doesn't mean the state can treat you like an object with no feelings or dignity.

I'm a devout Christian but if the headscarf is part of their religion yes they have to take it off for searches and stuff like that. But there's no reason they should have to be photographed without it. That is a huge disrespect. I mean it's not like the jail guards. Don't know what you look like

I’m not a Muslim but I respect them and also see no reason why they should be removed while taking the mugshot. I agree that it needs to be removed while doing a strip search as it could be easy to hide contraband in it, but I think it should be in a private room with only the inmate and a female CO. Sure, they’re criminals but at least give them some respect.

Personally, I’m not religious/any time of hat/head wrap person, so I don’t understand wearing them (I respect it, but glad I have the right not to of I don’t want to) however, if they are worn for religious reasons, and they have to have them remove their head covering, I do feel like it should be in private, so it’s just the inmate and a CO. Sure, you broke the law, but give them SOME privacy for this Eta- I’m sorry if I offended anyone with my choice of words. I know wearing a hijab isn’t mandatory (except in a few places), and it’s completely their choice to wear it! I just meant that I *_PERSONALLY_* am glad I don’t have to wear one. Something to mention is that being a hijabi is a choice too! They wear the hijab only if they want to, to feel closer connected to their religion and god. Unless they’re in a country where it’s mandatory, but obviously not the case here
wearing hijab is a choice - just like how some jewish men wear a kippah/yarmulke, some sikhs grow their hair long and wear a turban, or some nuns wear a christian habit. usually it denotes that a person has come of age, or passed through some training within their religion. i know for some religions, a head covering is a sign of awe before their god. generally head coverings can be found in most religions, certainly all abrahamic religions! hope this helps! 😁

@daand.1042 With Christian headcovering it isn't about not showing hair, it's more about having some kind of hat/scarf/doily/hankerchief that covers at least part of the top of the head 😊 but it also depends on the woman's personal style, some ladies cover all hair and some just wear a kerchief 😁

I worked in a male prison. And this was talked about among staff, from my understanding they try really hard to make it only females who do these kind of searches with Muslim women. That way, they don't have to be seen by a man.
The only problem rn in the economy and why some don't respect religious rights is because now some are abusing it to change laws. I do respect the rights to wear a hijabi and I do believe that people wearing it should not be disrespected. However lately in the pro palestine protests people have been making it so that religious right may be taken due to so many assaults and other serious crimes being committed by those wearing a face covering or hijabi. You can’t just be pardoned because of that. You could be hiding anything inside of a hijab. You have to take it off for a strip search. It can be done with a female guard so that it’s not a male searching you. That should be protocol anyways for female inmates

In the UK regardless of your religion youre allowed to ask for a same sex or same gender officer if you are required to be searched and you can be asked to do it in a private place eg the back of a police van (whether thats stop or search on the streets etc). I find it crazy to me that in America if you are a hijabi woman youre not even allowed that privacy or respect
I am American, and I will tell you, the guard was not following our laws. Religion is protected for all citizens, as it is in our constitution, and not even prison should be disrespectful like this. She should be allowed to keep her Hijab for photos and for walking around, and when being searched, she should be given a female guard to search her. It is important to respect people’s religions, and this guard was not following the constitution, they disrespected her rights, and should be removed from their job as a guard.

This happened to two of my friends! Only after lawyers got involved, they were given tshirts to put on their heads, which barely works. They were also denied halal meals and again had to get their lawyers involved to be given vegetarian food. Thank you for highlighting this issue!!!

You realize the searches are to protect that inmate and the other inmates. People smuggle or try to smuggle in weapons/drugs/cell phones and got knows what....thus the need for strip searches. Doesn't matter if a goddess got jail time they are still gonna search here EVERYWHERE including in her hair....jail is not a joke and once there they control every bit of your life

As a person who believes in Jesus I can’t help but have a sense of understanding for this type of behaviour. If you’re a criminal, you sometimes have to be treated like a criminal. Due to lack of trust, police are required to do these “de humanizing” actions because it’s always risk of smuggling. They always have to take cautions because they can’t trust everyone who is religious. This is just my point of view, sorry if you don’t agree with it

I thought that the hijab was allowed to be off in the space of women and family. Wouldn't the strip search and checks be normal to take it off? The picture i get because hair colour should be on a chart and the mugshot is for facial recognition.
Female prisons don't always have female COs. Most are men and laws regarding male cos strip searching, patting down, watching them bathe, etc to female prisoners are primarily dependent on state law in the U.S. The problem with the photograph is it will be swiped through multiple people and the sex of the viewer won't be considered, including men, so it goes against her religion.

I can understand why some Jails wouldn't allow it, as some people are definitely smart enough to sneak in small blades or such that could be dangerous for other cellmates and officers

Not surprised if they force her to in front of men too tho. One note: If they are doing a strip search and taking off all her clothes then Hijab isn’t an issue, if the entire body is nude then it doesn’t matter if t he hijabs off as everything is visible haha but I LOVE how you captured the huge importance of the Hijab that it has to many Muslim women.

Thank you for doing this. I practice Wicca and I can't tell you how many times I've been discriminated against because of it. I've had people ask me stupid ass questions like do I have delusions. The thing people forget: when you are admitted into prison, you lose ALL RIGHTS, that means including freedom of religion. Except we already know that's flawed logic and bad prison conditions don't make criminals less likely to go back or for people to not do crime in the first place. Efficient policies to accommodate faith is not hard.
Its jail, not prison. U don't know how she got in jail. U dont have to commit a crime to go to jail, you're accused. It isn't special treatment. There are laws, admendments, & rights that protect the prisoners right to practice the religion of their choice. Even in jail. There are lawsuits bc of this exact thing. How is it excusable or justifiable for any jail to break laws, admendments, or rights when we're ALL supposed to & expected to abide by them? There are better ways to handle this & to keep everyone safe.

Jail and prison isn't fun. You have to follow the rules set and we don't make special rules for special groups of people's. We do general rules The point of jail being so terrible is to encourage people not to go back do not break our laws. I mean you're not supposed to go in there and have a holiday.

That's all the respect you're entitled to in prison or jail. She doesn't like the conditions in prison don't go to prison. If you're waiting for transfer or just to go to court sorry but you're going to have to suck it up for however long you're waiting until the situation is cleared up and you're released. Inside We had a girl with a hijab. Honestly it set her apart from the other gurlz and we did question why it was allowed. The whole idea of jail is that we ALL appear the same, smell the same and act the same 💜🤗🇦🇺🇦🇺🇦🇺

There are many crimes that religion says nothing about. And not everyone in jail (pre trial) is even guilty, dude. Let's take the easiest, most common one: addiction. If this woman had surgery, got addicted to her opioids, and then got caught with pills, she would go to jail. That doesn't actually mean she "disrespected her religion" by having a chemical response to her medication and becoming physically ill if she didn't have it- it means the medical and legal system in the US are shit

Not everyone who goes to jail is guilty... or it's something stupid. I had to go to jail because my car started acting up, and when I was pulled over, it was late, and a cop pulled over, and at the same time, I tripped and fell. He insisted I was under the influence. passed all tests, still took me to jail. My 5 yr old daughter had just died the day before, and they had given me anxiety meds prescribed and taken the day before. He was so aggressive that I had a panic attack and was accused of "tweaking." So my medication came up in the ua and blood testat a .001% . Still, I got sent to jail. The judge told me that when peoples children die they commit crimes. Still ended up doing 3 days in jail... but I did nothing besides driving a shitty car late at night to go pick up family from the airport and had an anxiety attack because I was scared. I did not deserve to go to jail...

When I was in jail we had a young Muslim woman come in one day. She had her hijab and at first she would always wear it, she almost kind of hid under it, stayed in her cell a lot and kept to herself. But after a month or so getting to know the other girls, she wouldn't even wear it over her head anymore (this was a woman's pod and we only had female guards), she just let it kind of hang loosely over her shoulders so if for some reason a dude walked into the pod ( like a nurse, a trustee, a supervisor), the first to see them would yell "Male in the pod!" to let her know and then in a flash she'd just put it back on over her head. As much as she hated jail, she did once tell me that there was something freeing how about being able to go without her head scarf around so many people, she wished that there were more all-female gathering opportunities in the outside world.
EDIT: People keep asking me why I was in jail, and why she was in jail. I tried replying a few times, but for some reason it keeps getting deleted, so here goes: as I recall, she was being held in county jail waiting to be picked up by ICE (immigration). As for me, I was a heroin/fentanyl addict for years, I ended up in jail (many times) and prison (once) for possession and stealing (I would shoplift stuff like CDs and DVDs to sell for money to buy drugs) initially, but mostly for probation violations for not being clean. The last time I was locked up was right before the pandemic hit, 6 months of quarantine which basically constituted solitary confinement gave me a lot of time to think about how I never wanted to be there ever again. Now 4 years later, I'm sitting on my couch in my own house watching the Olympics with my wonderful and supportive boyfriend, our much loved dog, and our precious amazing 2 year old little girl. We do recover!

It’s actually law due to PREA (Prison Rape Elimination Act) that it must be announced when a male or female staff enter into an area. It wasn’t specifically to protect her.
I can explain why she put it back on when there was a male in the pod. I've been told that Islam teaches that women are not supposed to show their hair to anyone except their husband, their brother or their father. They don't have to wear the hijab until they get their first menstrual cycle. I was talking to a guy who was actually from Iraq yesterday. He was telling me that they don't enforce it anymore. It's an optional thing. It's just about modesty and vanity. They believe that no one should see your body except for your husband which I can kind of get behind. I can see where they're coming from. I'm not downing anybody who chooses to live a free lifestyle let's just say but while I don't like the restrictions that are placed on women in Middle Eastern countries, I can get behind what they're about with doing that. Thank you for addressing this issue.
There was this girl at my school and she was a Muslim. She has gotten tino an argument and a few girls snatched off her whole hijab. Everyone started looking and I’ll admit, I looked too but felt horrible after seeing how she reacted. Since then I’ve apologized many times to her and even gave her gifts as an apology cause that must’ve been very traumatizing. We aren’t friends but I still respect her when I see her.

Not exactly in jail, but there was a muslim gal in the psych ward I was in who wasn't allowed an hijab, nor did they have a Quaron in the small book section (they had atleast 3 bibles)
She requested one as much as she could, and thankfully a nurse used their own money to buy her one. I've always found that such a sweet gesture, even as an athiest, I know religion is a massive comfort to many people.

As someone going into the field, something like one's belief is the one thing that no one can take away from you. They should offer lots of books, nature, etc. This treatment is so ill. I know some individuals are working on improving the clothing allowed in psych wards. I've been studying some of the psychology done in the 9th century by Muslims. There was no disparity between mental and physical illnesses. They'd use nature as part of the healing. There is also some Islamic psychology practiced today (not limited to Muslims). In the US, there are some universities that have different faithed-patients.

Personally, I’m not religious/any time of hat/head wrap person, so I don’t understand wearing them (I respect it, but glad I have the right not to of I don’t want to) however, if they are worn for religious reasons, and they have to have them remove their head covering, I do feel like it should be in private, so it’s just the inmate and a CO. Something to mention is that being a hijabi is a choice too! They wear the hijab only if they want to, to feel closer connected to their religion and god. Unless they’re in a country where it’s mandatory, but obviously not the case here
wearing hijab is a choice - just like how some jewish men wear a kippah/yarmulke, some sikhs grow their hair long and wear a turban, or some nuns wear a christian habit. usually it denotes that a person has come of age, or passed through some training within their religion.
i know for some religions, a head covering is a sign of awe before their god. generally head coverings can be found in most religions, certainly all abrahamic religions! hope this helps! 😁

@daand.1042 With Christian headcovering it isn't about not showing hair, it's more about having some kind of hat/scarf/doily/hankerchief that covers at least part of the top of the head 😊 but it also depends on the woman's personal style, some ladies cover all hair and some just wear a kerchief 😁

I worked in a male prison. And this was talked about among staff, from my understanding they try really hard to make it only females who do these kind of searches with Muslim women. That way, they don't have to be seen by a man.

In the UK regardless of your religion youre allowed to ask for a same sex or same gender officer if you are required to be searched and you can be asked to do it in a private place eg the back of a police van (whether thats stop or search on the streets etc). I find it crazy to me that in America if you are a hijabi woman youre not even allowed that privacy or respect
I am American, and I will tell you, the guard was not following our laws. Religion is protected for all citizens, as it is in our constitution, and not even prison should be disrespectful like this. She should be allowed to keep her Hijab for photos and for walking around, and when being searched, she should be given a female guard to search her. It is important to respect people’s religions, and this guard was not following the constitution, they disrespected her rights, and should be removed from their job as a guard.

This happened to two of my friends! Only after lawyers got involved, they were given tshirts to put on their heads, which barely works. They were also denied halal meals and again had to get their lawyers involved to be given vegetarian food. Thank you for highlighting this issue!!!

You realize the searches are to protect that inmate and the other inmates. People smuggle or try to smuggle in weapons/drugs/cell phones and got knows what....thus the need for strip searches. Doesn't matter if a goddess got jail time they are still gonna search here EVERYWHERE including in her hair....jail is not a joke and once there they control every bit of your life

As a person who believes in Jesus I can’t help but have a sense of understanding for this type of behaviour. If you’re a criminal, you sometimes have to be treated like a criminal. Due to lack of trust, police are required to do these “de humanizing” actions because it’s always risk of smuggling. They always have to take cautions because they can’t trust everyone who is religious. This is just my point of view, sorry if you don’t agree with it

I thought that the hijab was allowed to be off in the space of women and family. Wouldn't the strip search and checks be normal to take it off? The picture i get because hair colour should be on a chart and the mugshot is for facial recognition.
Female prisons don't always have female COs. Most are men and laws regarding male cos strip searching, patting down, watching them bathe, etc to female prisoners are primarily dependent on state law in the U.S.
The problem with the photograph is it will be swiped through multiple people and the sex of the viewer won't be considered, including men, so it goes against her religion.
And she won't even be recognised with her hair because she would just be hiding it all of the time

I’m glad at least in most of these cases its an all woman/staff prison so the Hijabi would religion-wise be allowed to take it off. Not surprised if they force her to in front of men too tho.
One note: If they are doing a strip search and taking off all her clothes then Hijab isn’t an issue, if the entire body is nude then it doesn’t matter if t he hijabs off as everything is visible haha but I LOVE how you captured the huge importance of the Hijab that it has to many Muslim women.
Where I was in prison we had majority male COs so I wore my hijab when leaving my bunk area (we didn’t have cells it was dorm style )

There are laws, admendments, & rights that protect the prisoners right to practice the religion of their choice. Even in jail. There are lawsuits bc of this exact thing. How is it excusable or justifiable for any jail to break laws, admendments, or rights when we're ALL supposed to & expected to abide by them? There are better ways to handle this & to keep everyone safe.

Jail and prison isn't fun. You have to follow the rules set and we don't make special rules for special groups of people's. We do general rules The point of jail being so terrible is to encourage people not to go back do not break our laws. I mean you're not supposed to go in there and have a holiday.

That's all the respect you're entitled to in prison or jail. She doesn't like the conditions in prison don't go to prison. If you're waiting for transfer or just to go to court sorry but you're going to have to suck it up for however long you're waiting until the situation is cleared up and you're released. Again nobody's denying them their religious freedom they're just asking them to comply with searches.

Let's take the easiest, most common one: addiction. If this woman had surgery, got addicted to her opioids, and then got caught with pills, she would go to jail. That doesn't actually mean she "disrespected her religion" by having a chemical response to her medication and becoming physically ill if she didn't have it- it means the medical and legal system in the US are shit

I had to go to jail because my car started acting up, and when I was pulled over, it was late, and a cop pulled over, and at the same time, I tripped and fell. He insisted I was under the influence. passed all tests, still took me to jail. My 5 yr old daughter had just died the day before, and they had given me anxiety meds prescribed and taken the day before. He was so aggressive that I had a panic attack and was accused of "tweaking." So my medication came up in the ua and blood testat a .001% . Still, I got sent to jail. The judge told me that when peoples children die they commit crimes. Still ended up doing 3 days in jail...
but I did nothing besides driving a shitty car late at night to go pick up family from the airport and had an anxiety attack because I was scared.
I did not deserve to go to jail...
