      Playing devil's advocate here..I'm old enough to remember when thievery would get you arrested and charged. Now a certain political party says it's no big deal. The police in smaller towns don't want that spilling over into their jurisdictions, and their constituents demand a high level of over policing. They don't stop to think of the repercussions. That they're going to be subjected to the boot heel by being out after an imaginary, though de facto, after sunset curfew, when they're walking Fido.
      Personally, I think that if someone is walking down the street at midnight carrying a crowbar, they're not doing anything illegal. But I do understand why a cop would approach them. Suspicion is a thing, but if there is no actual crime, then know when to make a note of it and drive away.

      I don't know if anyone noticed the last two years but there's hardly ever a cop during the day you see most of the harassment going on at night time and I'd like to know why they are pushing for people to be in their homes at dark what are they doing in our towns at dark time that they don't want us to see? they're making it so difficult for us to be on the roads at dark I've seen it for the last 45 years and it's getting worse the last two much much worse

    The officer already knew exactly who she was. He probably ran her plates and saw her picture and name before he stepped out the car. I especially think this is harassment because of this fact. I can’t believe this case even made it to court and is pending!!!

      They might have some comprehension disability. Talking about semantics of "you're suspicious" and "suspicious activity", and "I'm suspecting". If they don't even understand simple language like this, how are they supposed to do their job? It's also extremely manipulative and gaslighting to blame her for it. What a freak show. Then there's the disconnect in their other statements as well. They say she's not doing anything wrong, yet she's accused of loitering, yet she's not alleged of a crime, yet she's supposed to give ID, yet they say it's a consensual encounter. The interaction should have ended when she said that she's just going down the road enjoying the view. At this time, completely normal activity. Given their cognitive disabilities, it's not unsurprising that they don't understand RAS. They think that someone who shows ID can't be a criminal but someone who doesn't must be a criminal. How is the act of showing ID relevant to the criminal activity? It's delusional to believe that people who show ID are better people. They also seem to believe that the ID contains the business address. What if she's an employee and her name isn't on any official business records? Are employees second class citizens who must be criminals even if they show ID? Or maybe it's just their ID addiction that makes their thoughts unclear. Addicts shouldn't be cops.

      Ever notice how they hound people for ID who haven't been charged with a crime? Cops know full-well that obtaining their ID won't implement them in a crime, but it is their final opportunity to lawfully arrest someone in the chance they have a warrant which can only be done if they know the person's name.
      The one's who have been caught breaking the law or have RAS against them are arrested on the spot and their identity is either figured out immediately on demand or later on down at the station, but police won't stand there for 15 minutes trying to squeeze ID out of a guilty person.

      They're hoping you have an outstanding warrant so they can just cut to the chase and arrest you. That takes away any prospect of a lawsuit.
      Contrary to what Lack says, courts have indeed ruled that being in a "high crime" area is part of establishing RAS.
      Judges and police want everyone to be only in places and at times that make sense to them, and engaged in an appropriate activity for that time and place. That and backing up this notion that you must carry your identity papers at all times is the very definition of a Police State.
      Meanwhile, crimes are still committed left and right, and the same judges refuse to throw the book at repeat offenders. In fact, charges are often dropped and plea deals made.
      Prisons are becoming luxuries we will no longer be able to afford. But, they will _always_ find ways to make accomodations for political offenders if need be.

    The fact that they knew who she was and seems to have followed her to the crime scene shows me that not only this was retaliation, but since the police refused to take a report of the burglary, definitely makes it more suspicious, like the previous comments, that the police may be the culprits of the burglary or at minimum knows who it was. This is one case I would love to see updated on

      Even better, the ID doesn't tell the officer what your doing either. The officers repeatedly said what she was doing.. looking in windows of closed business's. Which she has the the constitutional right to do, hell she could even whip out a camera and video tape the businesses all she wants. If you are on public property you are legally allowed to have your head facing in any direction so long as you are still on public property anything you can see from public property is okay to be seen.. its once you trespass that you have problems. She was absolutely being harassed by these cops who kept telling her not to lie, when she clearly isn't lying. Even the cops own words make this whole situation bizzar like they totally admitted what she was doing and it was legal.. they need to be fired, jailed, to fullest extend of law.

      I've read a lot about it. People weren't harassed in Germany anymore than the US and other countries in the 1930s. In fact, the Nazis knew they did not have majority support so made sure to not lean on their citizenry too much. There were no routine checkpoints within the country, only at certain borders, which was normal everywhere.
      In short, this "your papers please" meme comes from Hollywood. It gives us the illusion that the US had super high amounts of freedom. Notice how Hollywood never wanted to talk about how life was in the Soviet Union back then. Our "Allies".
      In fact, people in the US, Canada, and the UK were rounded up and put into camps.
      One lie after another.

      It's also BS.
      My PD called me in the middle of the night when I left my headlights on in my lot. [Whoops. 🙄 It was a long night.] (It's not illegal to leave your back gate half open and headlights on. But it is unusual...) So they investigated by calling me, before even knocking. I dispelled RAS and they left without asking for ID.
      Think about how much safer everyone was, KNOWING the person inside is permitted.
      Their job is to investigate.

      Not enough here for a lawsuit. Cops can argue RAS, and the judge will believe it. They have immunity. Cops are allowed to lie during questioning.

    This is why its so important to remain silent when accosted by cops. She disclosed that she was a business owner and that it was opening soon. That info prompted the thugs to retaliate. She owned them twice with a classic ID refusal and she gonna get paid for the deprivation of rights.

    Wow, this is an obscene abuse of power. The first officer tried to tell her it’s illegal to window shop when a shop is shut. How ludicrous?! And they were all trying to gaslight her. Unfortunately she lacked the necessary vocabulary to pin point precisely why it was so egregious. She has to take this all the way and get a big fat payout. And an apology. And these cops need to be fired.

    Thankfully the officer made it very clear that his primary intention was to harass her when he admitted to knowing exactly who she was from the last encounter just after demanding her I.D, and shortly before arresting her for failing to identify herself. These cops are clowns and if they're this bad with body cams, imagine how awful they were before

    The fact the cop who walked away to clear his throat new her and remembered interacting with her lends credit that this was retaliatory behavior. Given the fact that the department got rid of the complaint is probably only one instance of a larger pattern of corruption. Find anyone else who complained and it was "lost" and you have collusion and abuse of authority.

    She really thought his buddy officer would reason with logic. I feel so bad for her. This is small town energy where one guy is the judge, sheriff and mayor.

    During the first encounter, they accused her of doing everything they were guilty of doing. Accused her of lying and twisting things when that's exactly what they were doing to her.
    And I'm surprised the officers use of the word "profiling" wasn't talked about more. She made absolutely NO implications about race, and the officer, out of nowhere, claims she is accusing him of profiling her. To me, that seems like an admission that maybe they did in fact profile her.
    She was extremely patient. This had me so aggravated and the more I watched, the more annoyed I felt. I'm so glad she handled herself so calmly and even respectfully. It'll only help her case. But I wouldn't have blamed her if she had lost her cool because good grief....

    This was in every way a retaliatory act for daring to file a complaint against the officer in her previous encounter . They knew who she was from the previous stop and even mentioned it . No officer complaints in the last year ??? I don't doubt it since chief said her complaint won't go anywhere . Isn't obstruction a physical act of hindering ??? She didn't look like she was being physical to me . No crime , no ID !!!

      Grab the popcorn! The civil trial should be fun. Her identity was known to the officer arresting her for failing to ID (with no RAS), they have no way of knowing who owns the business she is in front of (not even from the burglary report they are investigating?). And the Chief on record in court saying he wants to teach her a lesson, but he's also on tape saying if she files a complaint it will go nowhere (and sure enough, no record of any complaint).

      Problem is we as a society consistently hire folks looking to feel tough and exert the control over citizens that particular costume has historically afforded thugs. I know profiling is "bad" but maybe we, as the citizens, need to do a little bit of it when hiring for law enforcement. I think it's important to question the motivation, mental status and intentions of someone gung-ho about being a cop, personally I think it a huge red flag. I'm willing to bet there's some serious narcissism and anger issues, among other more dangerous psychological and personality disorders present in a huge percentage of our police forces because they consistently hire damaged folks who are there for the thuggery and not the honorable service we want and expect, but it seems, our police departments just don't bother to require from their officers.

    The fact that he know her from a prior incident negates his need for Identification. He further negates their need for the arrest while claiming prior burglaries because he said they were not there for that.

    When a cop makes the comment about recent thefts in an area where they are harassing a citizen maybe we need to start requesting/ demanding to see the police reports on these alleged crimes. If there are in fact no records of these crimes, we need to call them out for their lies and bring the receipts!

    The fact that the superior officer she was filing a report with repeatedly said “Yer youtubin” is hilarious but sad. She understood her constitutional rights and he assumed that she learned it from TH-cam because that is critical information that the majority of the public did not understand for far too long but has become more common knowledge thanks to channels like this.
