  • If you anticipate on filing a lawsuit you need to watch this video before you do. It addresses the Plaintiff's approach when writing the Complaint as well as the Court's approach when ruling on the Defendant's Motion to Dismiss. When Plaintiff write the Complaint, he or she is encouraged to do so with the Motion to Dismiss 12(b) Defenses in mind.
    Note Correction: The third element of Retaliation is "Causal" rather than "Casual."

    Can witnesses be added. The mtd dismissed the individual defendants…can I still question them in the trial.

    This is 100% CORRECT!
    I just used all these steps, including FOIA & lack of jurisdiction and the judge & attorney left. I’m finally, after 12 years moving the case to trial.

      @@enjolique367 you can use the FOIA ... because there are documents thats needed.. and things they didn't talk to you about so read all documents and use it against them..

    The severity of the crime. Having all the evidence. You dont dismiss war crimes and torture. When it comes to brady violations have all the evidence on youre side

      Absent a statute that states otherwise, i.e., diversity jurisdiction, a plaintiff can sue an individual in the same state concerning constitutional matters.

    Help! I’ve made a mistake.. I filed my complaint and was granted to proceed forma pauperis but I did not give a thorough complaint. I assumed I could use my EEOC complaint since it said to keep it simple basically on the form.. what should I do??

      Hi. Your question is a good one. The purpose of the Writ of Mandamus is to address injustice. Not getting a ruling from the court nine months after the judge received the parties' motion to dismiss and answer, without more, does not justify a mandamus. However, the decision to file a mandamus is the movant's. Best

I received a CERTIFICATE OF SERVICE OFFER OF SETTLEMENT TO PLAINTIFF PURSSUANT TO OCGA 9-11-68. How can I defend myself against this motion favorably . The offer given to me was absurdly low despite the multiple life changing injuries I received

    I was not sure if going and trying to talk to the person that I have a dispute with was the right thing to do, but I can see now that it is most definitely the right thing to do. I need to try to stay in honor by trying to resolve the dispute before filing a claim by any means possible.

    Family court: Order of protection first, then she filed for divorce.
    1. She said I sent harrassing emails where I asked her family for financial help and so she called the police.
    2. The police called me, and after a few minutes, I realized they did not have the emails, so I asked them to get them from her, and we hung up.
    3. The police called me back and said forget it, because she would not give them the emails.
    4. In a status hearing, I did not know she was going to bring up the emails because the police never acted.
    5. I asked if she gave the emails to the police. Under oath, she said Yes.
    6. After the hearing, I got the police report showing she lied.
    7. I filed a motion for sanctions because of perjury.
    Question:
    How will the judge rule?

    Meant to ask if they try and use Collective bargaining for FMLA.. what if you can prove the breached their contract and intentionally and maliciously hid documents that you can prove using their own Position Statement against them.. would that work?
