You will be happy to know that I used your video as an educational lesson for my 7th grade grandson. This put him a step ahead of his civics class. people are always gonna find a way to protest or criticize anything, no matter how "politics-free" it is. But what's more important is to understand that taking a position is not in and of itself incorrect. There's this bias for neutrality that a lot of people fall into, thinking that just because something is perceived as "neutral" it must be good. That's not always the case.
if you think taking a principled position is a "bias," then I'm afraid you have corrupted the meaning of that word in your mind. Standing against, say for example, discrimination, is not a bias. It's a correct position. This particular video did not have much political relevance, but I remember when Trump signed the travel ban, TED-Ed released a video describing the life of a refugee, and the reasons why they left and couldn't return. To me, that was praiseworthy video because it's a principled position against a quite evident discriminatory executive order. That is being principled, that is being correct, and it also happened to be educational.
Saying an executive order is not a law depends on how vroadly you define law. In law school, we did call it a law. It is distinguished from what Congress does in that it in not a statute. What Courts do is also create law. All 3 branches, as well as the "administrative branch," which is a whole other discussion, create laws. Congress has the broadest power, but the hardest process. The President's law-making power is much narrower, but it is easy to do. The Court's power varies. In the areas where there are no written laws, they create new law by deciding cases based on first principals. That used to be common, but there are few areas still like that today. Niw, they usually interpret written laws, but since amy writing will have some vagueries, there is always room for them to exercise lawmaking power, restricted by the case in controversy requirement and subject to be overruled by changing the text they interpret, whether a stature, executive order, or the Constitution itself.

If it is not a subject already authorized by Congress, the President cannot do it. Executive Orders are really just policies by the President. Contrary to the video, they never have the effect of law, although they may direct the administration to create regulations (another lengthy process) that interpret Congress' laws.

4:16 Couldn't the president just keep making new executive orders that did the same thing and Congress would have to keep making new laws to invalidate the executive orders? Since it takes time for Congress to pass a bill the president could just keep signing different executive orders that did the same thing every time.
One of the ways the Roman empire lasted for 1,000 years is when the ideas of the Senate weren't working the sitting emperor had the entire Senate removed and new Senators were brought in. Could you imagine if a sitting US president issuing an order like that? I'd personally would love to see it

Quick history lesson: We broke away from Great Britain at the end of the 1700s because we didn't like being ruled by a single person who made laws and passed taxes without our consent. Once we formed our own government, we decided to have a system of checks and balances within our government so no 1 person/group of individuals would have total say over what the people can or can't do. Asides from Executive Orders, the only real legislative accomplishment/progress Donald Trump has made as President (that hasn't been an Executive Order) is putting Neil Gorsuch on the Supreme Court, and even then that should have gone in the President Obama column of accomplishments. Also, the rules were changes to 51 votes rather than 60 votes because Mitch McConnell and the Republicans knew they wouldn't have gotten Gorsuch on the Court without it. This is why I have never been a big fan of when Presidents (Democrat or Republican) pass Executive Orders to get things done. Now, I do know that when the Legislative Branch refuses to compromise, the Executive Branch passes them to get things done when the government is in gridlock and Executive Orders can be overturn by the Legislative Branch. But still, while both Parties claim they hate it when the President uses Executive Orders (usually the Republicans complain more than Democrats), they tend to bite their tongues when they are the Party in power. And I'm not saying Executive Orders are all bad, but when in 6 months President Trump has done almost nothing through the Legislative and Judicial Branches (aside from adding a Justice to the Court that belonged to President Obama) and just issued dozens of Executive Orders (which again the Republicans complained about with Obama but don't complain about now) there is a feeling of hypocrisy within our Democracy. Finally, in terms of the Filibuster/60 Senator vote to get things done, I think we do need at least some compromise between the Parties on most legislative decisions made by our government, but because of the actions of Mitch McConnell and other Republicans under President Obama, this sense of bipartisanship in our government could be forever lost should we reduce decisions to just be a simple majority. For example, if the Democrats retake the Senate in 2018 (which is difficult but possible), and another Supreme Court Justice seat opens, all the 51-54 Democratic Senators have to do is say "we demand a Liberal or Moderate Justice nominee from Trump otherwise we will all say no" or if Trump nominates a Justice with less than a year left like Obama did they could say "the Republicans under McConnell said no to Merrick Garland when Obama had a year left so we will do the same with Trump's nominee." With a lack of bipartisanship/compromise and the Republicans in the minority, there will be nothing they can do given how they changed the rules to a simple majority to benefit them when they were in power, but it hurts them when they aren't in power.
Even though it’s not explicitly mentioned in the U.S. Constitution, any Executive Order should not withdraw funds from the U.S. treasury because only Congress is authorized to raise revenue and spend money from the treasury. Also, an Executive Order should not in any way contradict, amend, nor invalidate in whole, or in part, any existing Act of Congress or the Constitution. I think that Roosevelt’s Executive Order in establishing internment camps should have been deemed illegal because the executive branch without prior authorization from Congress, had to have withdrawn funds from the treasury in order to pay for the cost for the establishment and operations of the camps. On the other hand, Lincoln’s Executive Order of emancipating the slaves in rebel states should be legal because neither it contradicted the U.S. Constitution nor any Act of Congress, nor did it require to withdraw funds from the U.S. treasury.
Moral of the story, do not elect a puppet for a president. The office of the president has a lot of power to change the course of history, for better or for worse.
Awesome video! But I still have a couple of questions left after watching it: 1) It has been mentioned that the Congress can pass laws that circumvent Executive orders. But it has also been said that a bill becomes a law only after the President signs it. Wouldn't he/she just be able to not sign any bills that affect his/hers executive orders, therefore nullifying anything that the Congress can do against them? Or is the president required to sign any bills passed by Congress? 2) After the part about judicial review for the executive orders, it was my impression that the orders first go through the overview and only if they pass it will the orders hold any power(and only after the review). But the last sentence of the video mentions that it might take some time to counter an executive order, alluding both to courts and the Congress. Does it only talk about the Congress, where passing a bill understandably take some time? Or was my first impression wrong and the Executive orders can be circumvented by courts, but take effect immediately after being issued by the President?(therefore meaning that any executive order will be active at least for some time before judicial review/some counter laws from congress).
1) Congress can overturn a presidential veto with a 2/3 majority. 2) Executive Orders, like laws, go into affect when the specific law/order says it goes into affect. The people can challenge it in court after it has been signed.

Congress does not usually give agencies the right amount of money any way. Those that get too much money loan it to others that get too little through the treasury. Most US debt is actually held by parts of the federal government against other parts.

Even though it’s not explicitly mentioned in the U.S. Constitution, any Executive Order should not withdraw funds from the U.S. treasury because only Congress is authorized to raise revenue and spend money from the treasury. Also, an Executive Order should not in any way contradict, amend, nor invalidate in whole, or in part, any existing Act of Congress or the Constitution. I think that Roosevelt’s Executive Order in establishing internment camps should have been deemed illegal because the executive branch without prior authorization from Congress, had to have withdrawn funds from the treasury in order to pay for the cost for the establishment and operations of the camps. On the other hand, Lincoln’s Executive Order of emancipating the slaves in rebel states should be legal because neither it contradicted the U.S. Constitution nor any Act of Congress, nor did it require to withdraw funds from the U.S. treasury.

Awesome video! But I still have a couple of questions left after watching it:
1) It has been mentioned that the Congress can pass laws that circumvent Executive orders. But it has also been said that a bill becomes a law only after the President signs it. Wouldn't he/she just be able to not sign any bills that affect his/hers executive orders, therefore nullifying anything that the Congress can do against them? Or is the president required to sign any bills passed by Congress?
2) After the part about judicial review for the executive orders, it was my impression that the orders first go through the overview and only if they pass it will the orders hold any power(and only after the review). But the last sentence of the video mentions that it might take some time to counter an executive order, alluding both to courts and the Congress. Does it only talk about the Congress, where passing a bill understandably take some time? Or was my first impression wrong and the Executive orders can be circumvented by courts, but take effect immediately after being issued by the President?(therefore meaning that any executive order will be active at least for some time before judicial review/some counter laws from congress).
1) Congress can overturn a presidential veto with a 2/3 majority.
2) Executive Orders, like laws, go into affect when the specific law/order says it goes into affect. The people can challenge it in court after it has been signed.

So if exctv orders are implemented w/o congress, how are they financed? Where I'm from (Denmark) everything the government does has to be financed through a "bill". How does the executive order circumvent congress' financial power?
I don't think it can do stuff with finances.
Congress does not usually give agencies the right amount of money any way. Those that get too much money loan it to others that get too little through the treasury. Most US debt is actually held by parts of the federal government against other parts.
