Hey everyone! A few things to explain here that I thought were clear in the video.
    1. Dean Guitars owns the ML shape. This video does not focus on the guitar shape that was designed by Dean Zelinski when he founded/owned Dean Guitars, nor does it focus on any original dimebag guitar shapes.
    2. This video focuses on the paint/finish choices for these guitars; specifically the blue/black fade (Dean from Hell paint scheme without the lightning graphic) & slime (originally from the Washburn D3/333 Dime-Slime which was released in 1995 and discontinued in 2005, the brought back by Dean in 2006 onward).
3.Yes, the tobacco burst was around before Dime started playing Dean guitars, although it has been a go-to Far Beyond Driven (FBD) build template for a lot of Dimebag fans as Dime used a 1979 Dean ML with that paint scheme in Pantera. This was also the same colour as the production FBD models (both import and USA) when Dean was able to make them.
    4. I focused on the points in #2 because of the Dimebag Estate leaving Dean Guitars and sueing them. Then Dean Guitars brought these finishes back when the artist and estate associated with these paint schemes are no longer with the brand.
    5. Dean can paint or build any guitar the way the choose. I did not say they should not build these guitars, nor paint them how they choose to. The ML is a fantastic guitar, and is one of my favourites. The slime is also one of my favourite finishes.
    6. I thought the launch of these finishes was questionable given the ongoing issue between Dean Guitars and the Dimebag Estate. I know a lot of Dime/Pantera fans thought the same way. That's it.
I hope this clears it up, and I apologize if parts may have been unclear!
Keep it clean in the comments!

Not to say Dean was about to go under, but it definitely wasn't looking great from booting THE REASON your guitar company even still exists and then also dealing with the lawsuit Gibson Lawsuit.

Dean Zelinkski created the ML in 1977. He named it after a childhood friend Matt Lynn who died of cancer. As far as the finishes... I don't see an issue. Many companies use similar finishes and have even done them as a tribute to Dime. Really, as long as they aren't using Dimebag's name, I have no issues...the body shape was theirs to begin with. Yes, we all associate the ML with Dime, but he didn't create it. We can't expect a manufacturer to stop making a specific body style because an artist that became associated with it moves on from the company. As for colors...you can't copyright or trademark a color. Now if they were still producing one with the lightning bolt graphic on it, or calling the slime the "Dime Slime", then I'd take issue with it.

The Razorback was Dime's design. They aren't making those. However, the ML is Dean's design. I love Dimebag. But, they can't trademark a color that is used by other guitar companies, not just Dean. Plus, the most iconic of Dimebag's guitars was a Dean ML with the lightning bolt. They are not making that. Simple. Darrell Abbott didn't have ANYTHING to do with the design of the ML. Just a color cannot be copywitten or trademarked; that would be insane. The first ML shown has been around since the inception of the Dean brand, it's called Brazilliaburst. The others may look similar in the colorways only, however, the ability to see colors are God given, so I don't see any problem. Everybody loves Dime so they all want to point the finger back at Dean but we don't know what's going on behind the scenes. There's two sides to every story. From what I can see in the footage there is nothing technically improper going on here. Yes, Dean has gone down as a brand. Elliot's son messed things up. However, if Dime's estate does not own the rights to blue fade, brown burst and slime green then nobody can complain. Those are generic burst finishes that anyone can do. And the slime finish was not even originally on a Dean guitar. It was one of the Washburns. The ML shape pre dates Dime by years; so Dean are in their right to use the shape that put them on the map. I also did not see any of the Stealth and Razorback shapes or the Lightning and Concrete Sledge graphics displayed in the footage. As a side note, when Dime was using Washburn, they were using the ML shape for the body and the headstock. Then they expanded to the Stealth shape which was already being used by other companies but somehow Dime got the rights to it. Who knows if Washburn was using the ML shape legally while Dean was out of business in the 90s? The point is everything is borrowed from one thing to the next. There would be no Stealth and Razorback shapes if the ML did not come first. And there would be no ML if the Gibson Explorer and Flying V did not come first. So for all of the butt hurt Dimebag fans blaming Dean at every possible chance; look at the evidence that is available to us. There's a point when all of this trademark bullshit gets annoying

But it’s just something, I think for me the iconic shape was dime and zz. But yeah, it’s just an interesting time. In no way shape or form is anybody disputing if Dean can use the ML shape or not.
    It's their shape.
It's the Dean from Hell lightning bolt delete graphic that's just gross.
If anybody knows anything about Dean guitars and Dime they knew what they were was trying to do with that finish.
They said was washed up and his guitars weren't big sellers. Than why used two finishes that are directly related to him?
The tobacco Burst is standard for almost every guitar company so no gripe there.

I see absolutely nothing wrong with what Dean is doing. Dime's guitars were just stock Dean guitars at one point. Save for a couple of custom finishes, Dean owns the proprietary rights to their original designs. This lawsuit is a shameful money grab by Rita/Dime's Estate, that they will lose.

I even talk to a guy who talk to someone from Dean because I was looking at purchasing another ML online and they basically said that they technically can’t make one, but if I wanted one, they could spec it out to one, but it won’t be a signature model, so it all fell down to a branding issue.

I totally understand your feelings (mixed feelings) about this. I've loved Dean guitars, but yet, not for the same models that you highlight here, but for some other general guitars (the EVO, the Vendetta, and a few others). Still though, the whole business model seems confusing to me for exactly the reasons that you mention, and I'm right there with you. There is another aspect though, that I've not been familiar with in the past. I have a really good friend that is a patent attorney. He's been notoriously successful, and I could name two products that you've owned and that everyone has owned, that my friend owns multiple patents for. Bearing in mind that all guitar companies are, at their heart, a company, meaning that their purpose, in addition to whatever else may motivate them, is to make money. If you do patent research you find that I can produce an item that looks, feels, sounds, smells, tastes almost identical to another item, all the while, without violating anyone's intellectual property, based on the very exact specifications of the patents involved. Example: Another friend of mine owns 9 patents on where your eyes are looking at..... if you are flying in an attack helicopter. But somehow, although what seems like the same exact patents are at play in competitors flying platforms. And in ways that I just really don't always agree with, no laws are violated, no lawsuits resulting. If you go to Aldi's market and buy a box of what looks like honey-nut cheerios, and if you look at the box carefully, you'll find that the brand is a totally different name. But if you compare the boxes side-by-side, it will be outrageously clear that they had a graphic designer basically steal the heart and soul of the product, but not get sued because they've researched the trademarks, patents, copyrights, and made very exacting changes that fool the eye with some visual psychological judo. In my mind, I feel like it is kind of dirty, deceiving and morally wrong, but the lawyers, who we joke just may not have souls, they are the masters of deception. So guys like you and me, well, just have to sit and stare and wonder how this all happens. Great video, appreciate your honesty and your sincerity!

Unless your position is Haney is just 100% altruistic and the dispute has nothing to do with simple beliefs about who should get how much money, based on contract interpretation or otherwise, then it's the obvious move to make. No one is making Dime guitars right now. Haney's pocketbook matters, sure, but it's not the only way for fans to honor the legend. Buying the shape he played in a color he played by the manufacturer that designed the shape is fine. And it is in no way a finger to Zelinsky; it has nothing to do with him.

And the Razorback...even though we know he never played it, but Dean made it. But that's all...the legacy guitars. The Slime is kinda caught in the middle...nothing will ever match a Washburn Slime. Even if Dime Guitarz make a Stealth shape, you just know they will tacky it up with the DBZ influence.
And even though you can get a blue and black ML from Dean, who is going to paint a lightning bolt over the clearcoat? It's just dumb, and probably just a Namm publicity stunt for that model (it doesn't even have a Floyd) Maybe Dean's next move it to make peace with Buddy Blaze to use the DFH graphic😂

So maybe you realized now since you are a Dimebag fan but they have been doing this shady thing for years even before the pandemic. I don´t know the details because the artists were never vocal about it but when Rusty Cooley was kicked out of Dean guitars (or at least looks that way), they kept the shape that he desinged with his specs and rebranded it, same thing with Michael Angelo Batio and Dave Mustaine and I´m sure others.
It looks they were kicked out since not only they went silent on that but also they rebranded some of them with very suspicious names that seem to just be bad taste.
Rusty Cooleys shape is now "Exile".
Dave Mustaine V is now "Vengance" and Zero is still Zero but they use the "Zero F*cks Given" slogan to sell it.
Michael Angelo´s Shape is lost and maybe he just didn´t let them go on with it.

    • @EricMorettin
      @EricMorettin  11 หลายเดือนก่อน

Rusty wasn't "kicked out" of Dean. He left, along with MAB and Dave Mustaine. Unless those artists trademarked the shapes, Dean (or any company) has full reign to use the shape at their will.
Yes, Dean rebranded and changed some of their older signature models into regular production models with slight modifications to avoid copyright infringement (VMNT became the Vengeance).
It's unfortunate, and there are a lot of questionable moves from the company, although there's not much we can really do about it outside of not buying the guitars - if you feel that strong about what's going on.
