Phil sucks yes. But Nick is protected ONLY because he reported on another person's accusations. The fact of the matter is Phil Heath is a public figure and different rules apply, since he performed due diligence and no harm was malicious or negligent. So, Nick is good to go, but it's a bit more complex than "1st amendment freedom of speech." Had he not met those requirements, it would've been a case.
1st Amendment literally has nothing to do with this. He should still keep it up though because I think he would be ok if it ever went to court and obviously Nick agrees since he posted this video.
