I notice that brothers don't mind accepting that the circumstances have changed in that example, but they suddenly become very pious when it comes to themselves receiving as much money as possible. Many will not have good intentions, we have all seen families damaged by such in-fighting after the death of parents. It is good that Dr. Shabir Ally talks about the responsibility which was always there for the brother to spend his share on his sisters anyway, and also keep it within the tribe. At the time the Quran was revealed nobody would even think of hoarding the money all to themselves instead of using it to support their sisters. This alone shows how different family economic structures are today, it's unthinkable that Muslims would have needed to argue over this in the past. It should go without saying that there is fairness and justice at its core, and this may take different forms depending on the situation. Dr. Shabir overlooked an important point: while a daughter receives half the share as compared to brother however, as a wife, she is entitled to 1/8th of her husband's property, and if her children predecease her, she inherits 1/6th of their property. This means a woman not only inherits from her father but also from her husband and unmarried children, which helps to balance the difference created by receiving half the share of her brother.
The sons received the inheritance at that time because women were not allowed to work. In todays day and age, the inheritance is just as important for the females as it is for the males which is why it should be shared equally.

With all due respect, I'm going to stick to the mashhur (dominant) opinion of the scholars. I actually know of a number of Muslim brothers who fulfill the role of maintaining and looking after women, this includes myself. I also plan to teach my son that it is his responsibility to look after women not only within in his home, but also broadly within the ummah regardless of how much wealth or status women possess. There is a clear logic as to why this ruling of inheritance still applies today as it did in ancient times.

You cannot WILL more than 30% of your entire possession, neither is it in your place to say who gets what - and your WILL can not go to any of your stipulated inheritors. Allah clearly states in the Qur'an ( chapter 4 verses 11, 12, and 176 ) the correct share that each of your inheritors, based on different scenarios, are entitled to get. The socio milieu you mentioned in Afghanistan is that men takes the charge of sisters, mother, wife,... now if I come to US and my sisters get a job have good payment, so they would now say we want equal, and if they do not get a job in US as we do not like women to work, then we would say take the half of the inheritance. And in Afghanistan there are cases, where some brothers do not even give the sisters the inheritance, because they says you have a rich husband, or what do u do with money. So here the whole social system strucks think, and everyone will be using this verse for his/her benefit. So i think that this verse applies everywhere and every time. Because it had been already analyzed by Allah SWT. So, we should apply it everywhere.

When the situation changes, we need to understand the principles intended behind a rule. We may agree or disagree with Dr Shabir lecture on the ayah, but we need to reflect in the Quran with a deeper look to understand the meanings with different layers. God wants the Ummah to make efforts of Interpretation, otherwise we would become lazy and get left behind by the other communities.
It is fair also because males have a reproduction rate that is half that of females so they need twice the inheritance to have an even chance at reproduction. If one does not need twice the inheritance to find a lifelong partner, one should not resort to applying this law. One should also remember that the man has to pay a dowry when marrying a woman, so the extra inheritance still flows back towards a woman, so if one does not offer a meaningful dowry one should not have upheld this law either.
Most of the time I agree with Dr. Shabir, but I disagree on this one. Quranic verses are perfection! Every verse needs to be examined how it affects the entire world community, societies, local populations and all the way down to individual level. Quranic verses tend to take into account all those aspects in order to ensure communities remain cohesive along with gender roles to ensure children are raised in the most beautiful way possible, such as the man being able to provide for the family and women had less stress and anxiety and well taken care of. In these modern societies, both husband and wife run around trying to provide for the kids, while the kids are left at the mercy of cartoons, cell phones, games etc. Not only are the parents suffering from anxiety, stress and depression, but also the kids are hyper as their developing brains get used to the fast pace of video game characters ignoring their food, nutrition, etc. This is just only ONE aspect of how a family with children can be affected. Now multiply that with many many families going through it, then the whole of community, a country, a continent and the entire world. What kind of societies are we trying to build?

Disagree as well. Latter part of the verse and verse 12states that it applies after debt and will (bequest). Quran encourages one to have a will and will to be fair. The person can allocate the wealth anyway he/she wants in the will. Will is accepted by sharia and by laws of the most countries if not all.

The revelations about Abraham, Moses, David, and Jesus all contain their detailed life stories and the context for their words. God's revelations are clear. But the Quran provides next to zero context for its shadowy author. All of this was filled in centuries later, and I think Dr. Ally is well aware of how reliable all of that really is.

In this case, Khalid has right to write in Bequest, that 50% of my Property will go to my Righteous daughter and other 50% to my Righteous son. And Zero to other daughter and son. Bequest has priority, but (through concocted hadiths) Mullahs have disabled Quranic law of Bequest.
But assume: Khalid suddenly dies in a car accident, and he had no time to write the Will (Bequest). Now, in order to prevent dispute among inheritors; Quranic law of Inheritance will take over.

You cannot WILL more than 30% of your entire possession, neither is it in your place to say who gets what - and your WILL can not go to any of your stipulated inheritors. Allah clearly states in the Qur'an ( chapter 4 verses 11, 12, and 176 ) the correct share that each of your inheritors, based on different scenarios, are entitled to get. The socio milieu you mentioned in Afghanistan is that men takes the charge of sisters, mother, wife,... now if I come to US and my sisters get a job have good payment, so they would now say we want equal, and if they do not get a job in US as we do not like women to work, then we would say take the half of the inheritance. And in Afghanistan there are cases, where some brothers do not even give the sisters the inheritance, because they says you have a rich husband, or what do u do with money. So here the whole social system strucks think, and everyone will be using this verse for his/her benefit. So i think that this verse applies everywhere and every time. Because it had been already analyzed by Allah SWT. So, we should apply it everywhere.

We may agree or disagree with Dr Shabir lecture on the ayah, but we need to reflect in the Quran with a deeper look to understand the meanings with different layers. God wants the Ummah to make efforts of Interpretation, otherwise we would become lazy and get left behind by the other communities.

It's funny people accept change according to their convenience but not of giving property to others .
It is fair also because males have a reproduction rate that is half that of females so they need twice the inheritance to have an even chance at reproduction. If one does not need twice the inheritance to find a lifelong partner, one should not resort to applying this law. One should also remember that the man has to pay a dowry when marrying a woman, so the extra inheritance still flows back towards a woman, so if one does not offer a meaningful dowry one should not have upheld this law either.

Most of the time I agree with Dr. Shabir, but I disagree on this one.
Quranic verses are perfection! Every verse needs to be examined how it affects the entire world community, societies, local populations and all the way down to individual level.
Quranic verses tend to take into account all those aspects in order to ensure communities remain cohesive along with gender roles to ensure children are raised in the most beautiful way possible, such as the man being able to provide for the family and women had less stress and anxiety and well taken care of.
In these modern societies, both husband and wife run around trying to provide for the kids, while the kids are left at the mercy of cartoons, cell phones, games etc.
Not only are the parents suffering from anxiety, stress and depression, but also the kids are hyper as their developing brains get used to the fast pace of video game characters ignoring their food, nutrition, etc.
This is just only ONE aspect of how a family with children can be affected. Now multiply that with many many families going through it, then the whole of community, a country, a continent and the entire world. What kind of societies are we trying to build?

Disagree as well. Latter part of the verse and verse 12states that it applies after debt and will (bequest). Quran encourages one to have a will and will to be fair. The person can allocate the wealth anyway he/she wants in the will. Will is accepted by sharia and by laws of the most countries if not all.

At the time of conquest there was a special exception madefor the daughters of Zelophedad. In the Bible, you see clear stories with historical context. The revelations about Abraham, Moses, David, and Jesus all contain their detailed life stories and the context for their words. God's revelations are clear. But the Quran provides next to zero context for its shadowy author. All of this was filled in centuries later, and I think Dr. Ally is well aware of how reliable all of that really is.
If you mean he’s aware of how unreliable it is, I will agree, hence why his opinion is much like the Qs: A DIFFERING INTERPRETATION EVERYTIME. And yes you’re 1000% right. The Q provides zero context (or sense) for much or rather what little it does say. It’s like a giant game of Mad Libs. Fill in the blanks.
