  • November 26, 2019 marks the 70th anniversary of the adoption of the Constitution in 1949.
    It was on this day in 1949 that the Constituent Assembly adopted the Indian Constitution, an important landmark in the country's journey as an independent, sovereign republic.
    One of the oldest and the most enduring, the Indian Constitution and serves as a powerful emancipation proclamation ending centuries of discrimination, economic, political and social exclusion for millions of people.
    It describes the fundamental political code, structure, procedures, powers, and duties of the government institutions. It also explains fundamental rights, directive principles and the duties of citizens.
    On the show today, we'll talk about the Directive Principles of State Policy.
    Mentioned in Part 4 of the constitution from articles 36 to 51, Directive Principles constitute a very comprehensive social, economic and political programme for a modern and welfare state.
    What are the features, classification and amendments to directive principles is what we analyse today. Besides, we also focus on how they affect and direct state policy.

    Dpsp are included in the part 4 of the Indian constitution from article 36 to article 51, and are taken from the Irish constitution they are divided into three parts socialist principles Gandhian principles and liberal intellectual principles, they are non justiciable in nature, they act as a guidelines to the states while framing the law for the citizens.       There division is not given in Constitution. They are divided for our convenience to remember or learn DPSPs.

    21:56 this is wrong actually because in case of conflicts between FR & DPSP
    The Fundamental Rights will only stay and it was a judgement given by the court in Kesavananda Bharathi case as well

      Yes,
      Supreme court gave supremacy to DPSPs over FRs in various cases including Champak Dorairaja Vs State of Madra,
      Balwant Singh vs State of Bihar ( Bihar state land reforms case) and Minerva mills case 1980.
      In reKerala Education case Supreme court held that , there is no conflict between DPDPs and FRs as DPSPs are for social and economic democracy and FRs are for Political democracy . If there araises any conflict then FRs should be given supremacy.

      Article 14 and Article 19 can be nullified if it comes in conflict with law giving primacy to Article 39(b) and Article 39(c) of the DPSP as per article 31(c) that was enacted by 25th Constitutional Amendment Act.Which the SC also upheld in the same case.

    As of now: public demands all these things on a priority basis which is written in DPSP. Government should provide legal right or make compulsory to implement all these things which is written in DPSP. Change DPSP into the basic rights and make it compulsory for government to implement it. It is total nonsense that it is not enforceable by any court. All these things are basic as of now. Elections are also being fought on these issues. So there should be a constitutional amendment in DPSP to make it enforceable.
