Thank you Ms.Jackie for taking time to provide us information in applying for U.S citizenship. My concern is, I am married to a U.S citizen for 10 years and we have two children. But we got divorced 2 years ago. I have my green card since 2017. Can I still apply for U.S citizen? And regarding taxes, my Ex-husband work's overseas . So he never filed taxes here in the U.S. But after my divorce, I started working and since then, I filed my own taxes separately.
You can apply under 5-year eligibility. Regarding taxes, as a US citizen, you always have to file taxes even if you are overseas. I will suggest to consult a tax accountant and sort that our before your interview.

That's a valid reason. If possible, bring the tax return transcripts to show that your father claimed you as a dependent for that year. You should be ok.

What if my LLC company on my name owes taxes? Will they link my personal taxes to the company? I file my personal every time and I don’t owe taxes but the company on my name owes and my company been forfeited the past 2 years. I can’t keep up with payments and I’m still looking for a job been two weeks now and I’m just worried if that would get my application denied.
You need to provide proof that your LLC doesn't owe any taxes either. if you have overdue taxes, then you need to have a payment plan set up with the IRS.

I talked to my accountant and did an amendment tax return and printed it night before my interview. it’s so overwhelming to do but the day on my interview officer didn’t ask for it. But Thank God I have a plan B in case they ask me. I hope you fix yours while it’s early. Please don’t take my advice as legal It’s just my experience. Please talk to an accountant and lawyer if you can. Goodluck you can do it!

@@mkahraman82 I answered yes to the question and when I had my interview I said I haven’t always made my taxes and briefly asked did you do your taxes when you needed to ind I firefly said yes and that was it. I was a legal resident for 30 years I am now 50 yrs old and I am guessing that she understood that I didn’t always work every single year. I guess every situation is different. I hope this help. And I did pass my citizenship test and interview.
Hi Jackie! I have a question. A little backstory, I applied for n400 last october 2022 and now have an interview scheduled. We didn’t owe taxes then but we just filed our 2022 taxes and found out that owe, do I need to disclose that during the interview? Especially when asked that question? I have already set up a payment plan w/ the irs and planning to bring that proof to the interview. Hope to hear from you soon 🤗
Yes. You need to disclose it if you owe any taxes at the day of the interview. Bring payment plan and if possible, make some payments to show you are paying. Good luck!

Do senior LPR holders over 65 years have to file tax returns for naturalization if they don't work and live with their offspring who sponsored them? Asking for my Mom who came here 3 months ago as LPR holder. Not sure yet whether I should claim her as dependent for tax purpose next year.
As long as you have a valid reason not to file taxes, that is not an issue. Just make sure to bring supporting documents such as you claiming her as a dependent on your tax returns.

Hi Jackie, IRS website is so backed up and I am unable to download the tax transcript from their site. I have asked it to be mailed to my home. IRS gives 3 years worth of transcripts. My interview is on March 14th and I am unsure if the IRS can mail it on time. I am wondering if I can simply bring my tax returns for the past 5 years instead of transcripts? I can also show the bank statement showing the refund from IRS as an evidence of returns accepted by IRS?

I contacted a tax firm who said not to file tax return for such a small income. My interview is in November. What should be my credible reply why I didn't file 2017 tax return.

Okay but! You didn't answer the question... can you be denied if your owe overdue taxes? Even if you are paying with an agreement and haven't failed any payments?
If you have an agreement in place and your payments are up to date, then there's nothing to worry about, just bring agreement and proof of payments to the interview.

And I concern about this topic I have known someone who are at the age of 65 and 66 and they’re waiting for their interview soon… they didn’t file a tax bc they never work here in America but they’ve been living here for 10years. They don’t have tax documents to show. What should they do? Thanks for the response.
As long as they have a valid reason, e.g. income is below the threshold of filing or they are a depended on someone's tax return, that that should be fine. If they have to file taxes but didn't, I would suggest to contact a tax accountant and get that taken care of BEFORE the interview.

You have to answer "Yes" and the reason is because you are unemployed and don't have taxable income.

Thank you Ms.Jackie for taking time to provide us information in applying for U.S citizenship. My concern is, I am married to a U.S citizen for 10 years and we have two children. But we got divorced 2 years ago. I have my green card since 2017. Can I still apply for U.S citizen? And regarding taxes, my Ex-husband work's overseas . So he never filed taxes here in the U.S. But after my divorce, I started working and since then, I filed my own taxes separately.
You can apply under 5-year eligibility.
Regarding taxes, as a US citizen, you always have to file taxes even if you are overseas. I will suggest to consult a tax accountant and sort that our before your interview.

That's a valid reason. If possible, bring the tax return transcripts to show that your father claimed you as a dependent for that year. You should be ok.

not a big deal. Just mention that to the officer and if possible, bring your brother's tax return transcripts with you. good luck!

What if my LLC company on my name owes taxes? Will they link my personal taxes to the company? I file my personal every time and I don’t owe taxes but the company on my name owes and my company been forfeited the past 2 years. You need to provide proof that your LLC doesn't owe any taxes either.
if you have overdue taxes, then you need to have a payment plan set up with the IRS.

I talked to my accountant and did an amendment tax return and printed it night before my interview. it’s so overwhelming to do but the day on my interview officer didn’t ask for it. But Thank God I have a plan B in case they ask me. I hope you fix yours while it’s early. Please don’t take my advice as legal It’s just my experience. Please talk to an accountant and lawyer if you can. Goodluck you can do it!

@@mkahraman82 I answered yes to the question and when I had my interview I said I haven’t always made my taxes and briefly asked did you do your taxes when you needed to ind I firefly said yes and that was it. I was a legal resident for 30 years I am now 50 yrs old and I am guessing that she understood that I didn’t always work every single year. I guess every situation is different. I hope this help. And I did pass my citizenship test and interview.

Hi Jackie! I have a question. A little backstory, I applied for n400 last october 2022 and now have an interview scheduled. We didn’t owe taxes then but we just filed our 2022 taxes and found out that owe, do I need to disclose that during the interview? Especially when asked that question?
I have already set up a payment plan w/ the irs and planning to bring that proof to the interview.

If you are not applying under marriage based and filed the tax returns properly, then there should be no issue.

Do senior LPR holders over 65 years have to file tax returns for naturalization if they don't work and live with their offspring who sponsored them? Asking for my Mom who came here 3 months ago as LPR holder. Not sure yet whether I should claim her as dependent for tax purpose next year.
As long as you have a valid reason not to file taxes, that is not an issue. Just make sure to bring supporting documents such as you claiming her as a dependent on your tax returns.

Yes you can, but if you apply through marriage, you need to provide other documents to show your marriage is real.

That's not a problem at all. I will suggest to bring 3/5 prior years of tax transcripts/returns.
Hi Jackie, IRS website is so backed up and I am unable to download the tax transcript from their site. I have asked it to be mailed to my home. IRS gives 3 years worth of transcripts. My interview is on March 14th and I am unsure if the IRS can mail it on time. I am wondering if I can simply bring my tax returns for the past 5 years instead of transcripts? I can also show the bank statement showing the refund from IRS as an evidence of returns accepted by IRS?

Federal taxes should be sufficient. However, if the Officer has doubt, he/she can always request for additional information including state taxes.

I contacted a tax firm who said not to file tax return for such a small income. My interview is in November. What should be my credible reply why I didn't file 2017 tax return.

Okay but! You didn't answer the question... can you be denied if your owe overdue taxes? Even if you are paying with an agreement and haven't failed any payments?
If you have an agreement in place and your payments are up to date, then there's nothing to worry about, just bring agreement and proof of payments to the interview.

And I concern about this topic I have known someone who are at the age of 65 and 66 and they’re waiting for their interview soon… they didn’t file a tax bc they never work here in America but they’ve been living here for 10years. They don’t have tax documents to show. What should they do? Thanks for the response.
As long as they have a valid reason, e.g. income is below the threshold of filing or they are a depended on someone's tax return, that that should be fine.
If they have to file taxes but didn't, I would suggest to contact a tax accountant and get that taken care of BEFORE the interview.
