I worked retail in college, and at the store I worked at, we absolutely inspected every single item that came into the store before putting it out on the shelves. And we signed off on a form that we inspected the merchandise. We sold crystal and fine china. When you’re dealing with fragile merchandise, you inspect it. No doubt a small electronics store inspects everything.
This is why unfortunately you dont ever buy electronics from small local retailers. If this happened at Costco you’d have a new TV, an apology and probably a free pizza for your time.
YES! My mom got a TV from Costco and the employee jammed it in her truck, she took it home, plugged it in, broken. Immediately took it back and got a brand new tv. No questions asked

Stores don't take out each TV and plug them in to make sure they work and if they did it would make sense that it is like the plaintiff states that the box didn't show damage but the TV was damaged on the inside probably from the person that tested it putting in back in the box. Outrageous. I want to give the plaintiff one of my TV's. But now a 43" inch 4k LG is so inexpensive. I have a 55" LG 4K SmartTV in my bedroom that I never turn on and when I do turn it on, it has been off so long that I have to Update the LG software and that takes forever that I eventually just turn it back off and go to bed.
Agreed, but the plaintiff has the burden of proving it was broken before purchase. I don't believe the defendant either. It's irrelevant though. Even if the defendant admitted they do no inspection at all, very doubtful the plaintiff could win her case. I actually wish the plaintiff could have won, but she has no proof.

If it’s a small electronics store then they will often open the boxes to check the serial numbers and enter them into their inventory system. My dad would stay in the store and get them to test everything he bought, including the lawnmower. The owner expected it because many people did the same thing. The only thing he didn’t test was the stove and my dad didn’t let the delivery men leave until he had it hooked up and working. Same with furniture. If it’s delivered then it’s checked for damage and if it’s electric then it’s plugged in. My couch has usb ports and they were tested with the delivery guys standing beside it.

The judge got it wrong this time, the plaintiff said she was leaving and she was coming back so that she could pick the tv up herself, she didn't even want them to deliver it. They went ahead and packed it up on the truck while she was gone because they knew the tv was broken and they knew the chances of her opening it up and inspecting it were slim to none. They were scamming a poor lady and judge Milian just let them get away with it. 😠

Maybe that's not how it works in the US, but here I have never been able to buy an appliance (be it a tv, a computer monitor, even a fridge or washer) without them opening the box in front of me to both inspect it and show the status of the appliance itself, and I've been to various appliance stores. Only after that do they make the transaction, give you the receipt and have you sign a paper where you aknowledge that the item had no exterior damage (and in the case of TVs or Monitors, that it turned on and the screen was fine). After that, if you open the box and there is damage, it is the delivery people fault. Any nonfunctioning of the appliance itself is covered under warranty, that every product has. So... i'ts not that crazy to think about.

Imagine inspecting everything (tvs, computers, vacuums, radios, headphones, etc.) before you leave the store. It could bring a store to a crawl. They would need an employee witness for every item opened. And what if you opened it and then decided not to buy it? The judge has lost her mind.

I have never known anyone to pull a new tv out the box to inspect it. No one does this. It’s incredibly difficult to get it back inside it anyway. On,y time I’ve seen this is when it’s delivered and installed. I think defendant is lying about opening each box to inspect it. That’s probably why it was so cheap in first place. I’ll stick with big box stores for electronics.
Large retailers would have refunded or swapped it out. I don't believe the sellers inspect the TV just as much as the customer does not. Hopefully she learned a lesson abt shopping at mom and pops stores. I wanted her to get her money back 😫

This happened to me, the employee brung the Tv to the store exit. I went home and same crack on the tv screen. A technician came and said that i was in good faith, The crack was from The store. Finally i got the 499 € refound, because the law in France is clear : if you buy something and you can't use it ( Tv, owen, washing machine, etc.), a full refound must be returned immediately. 😊 Sorry for the Lady, Judge is wrong here.

I found a Cyber Electronics Inc online in the Bronx NY. If it Is the same company it looks like a trashy hole in the wall. About the size of a public restroom and records say they make just over 70k a year with 2 employees . I wouldn’t buy a bag of skittles there let alone a television.

He should of replaced the TV. Sent the Tv back for a RA. LG’s 43” was coming in cracked from the manufacturer. That particular year and size I had five come off the truck and to a customers home damaged without the box or packaging damaged.

As soon as I heard the case being introduced, I knew she had lost. She was not going to be able to prove they did something wrong. It was impossible to win unless they admitted it. And if that was the case, they wouldn't be at the people's court.

We also inspected every item at the time of sale and made sure the customer saw it. This is protocol at small retailers that sell expensive merchandise. I don’t know why so many of you doubt that the store inspects TVs upon arrival. Something like 10% of TVs arrive damaged. A small business cannot eat that loss.

The judge doesn't always understand established Customer retail acceptance and inspection requirements in certain commercial retail industries. This was a TV judgement. And did not properly educate. The third party reseller has certain warranties and limitations of liability. The judge was unreasonable.

If I went to a store and bought a tv and they brought one out in an open box I would be demanding to inspect it and a discount because to me it is a used tv. For a tv I would be buying from a larger store or from Amazon for protection. I bought a 34 inch computer monitor during the last Black Friday from Amazon and it had a black band about 6 inches wide from the left edge of the screen. I contacted the manufacturer for advice, we ran through a bunch of different tests none of which worked. Amazon had sold all the stock they had so couldn't replace it, the manufacturer arranged with Amazon to take it back and they sent me another from their stock. The manufacturer was new to Australia, so they were probably hoping for some positive reviews, but I was happy to do that.
Honesty, in Trinidad, the item is checked before you leave the store, then you sign for receiving in good condition. Even if the item is delivered to you, it is inspected beforw they leave

They argued us down that it was brand new . The motorcycle we saw on the floor was brand new, but the one they delivered to us was scratched up. We eventually got a brand new one, but we had to go through a whole bunch of bullshit just to get it they accused us of scratching it. We did not the person who delivered it, brought it straight into the apartment and that’s where it stayed and we examined it and saw that it was scratched up. Never buy anything in your town little stores.

Smart ones.Making sure there are no manufacturing defects or to make sure it didn’t get damaged when the manufacturer shipped it.Because if they find damage at that point the manufacturer will cover tte loss.

I have bought numerous electronics from tvs to washers and dryers and NOT ONCE have I EVER either opened it in the store or as you claim fully inspected things before the delivery driver left thereby wasting their time and cutting into other deliveries they have to make. This owner, all though he claims he's making sure nothing is broken is doing more harm than good by opening boxes before they are purchased. Lord knows if I new the box had been opened by him prior to my purching it I would demand a price reduction because it is now considered an opened box and not brand new. Also she at no point said she carried it upstairs so she likely had help with then AND of something had happened to it in her possession the box would have been damaged. More likely that it was damaged at the store during their "inspection" that shouldn't have taken place. You want people to take responsibility for their actions AND the actions of other people, how about EVERYONE take responsibility for their OWN actions, oh and stop BSing about crap that you know you don't do, you just say you do to make yourself sound superior when you're literally just like everyone else
Judge is wrong on this one, no one inspects the TV at the store, everyone does when they arrive at home to put it up. It’s logical to think the store is at fault for damage when it happened right when the lady got home.
It's just as logical to blame her. She could've dropped it when she got home.
Maybe that's not how it works in the US, but here I have never been able to buy an appliance (be it a tv, a computer monitor, even a fridge or washer) without them opening the box in front of me to both inspect it and show the status of the appliance itself, and I've been to various appliance stores. Only after that do they make the transaction, give you the receipt and have you sign a paper where you aknowledge that the item had no exterior damage (and in the case of TVs or Monitors, that it turned on and the screen was fine). After that, if you open the box and there is damage, it is the delivery people fault. Any nonfunctioning of the appliance itself is covered under warranty, that every product has. So... i'ts not that crazy to think about.

I’ve only ever bought TVs from Walmart but they usually have a policy where they can be returned within so many days as long as you have the receipt.

Imagine inspecting everything (tvs, computers, vacuums, radios, headphones, etc.) before you leave the store. It could bring a store to a crawl. They would need an employee witness for every item opened. And what if you opened it and then decided not to buy it? The judge has lost her mind.

I have a brother who had to inspect EVERYTHING before he took it out of the store - LITERALLY!!! It was so bad, & took so long, even I refused to go shopping with him!!! I'm the one who would probably be the same as this lady. But after watching this show for so long, I am convinced my brother was probably right! ☺

I have never known anyone to pull a new tv out the box to inspect it. No one does this. It’s incredibly difficult to get it back inside it anyway. On,y time I’ve seen this is when it’s delivered and installed. I think defendant is lying about opening each box to inspect it. That’s probably why it was so cheap in first place. I’ll stick with big box stores for electronics.
Large retailers would have refunded or swapped it out. I don't believe the sellers inspect the TV just as much as the customer does not. Hopefully she learned a lesson abt shopping at mom and pops stores. I wanted her to get her money back 😫

I disagree the defendant should show respect to his customers and exchange the product it won’t cost him anything the manufacturer will change it at no cost, this was unfair, a bit sly why didn’t he insist the customer sees the TV before he transporting it, not a good call on this one judge. Good to know the store policy before making a purchase. JM's point about examining her car before letting a valet park it wouldn't stand up in court unless she has pictures that the car wasn't damaged before they park it. Just saying! I think she just means she makes sure there’s no damage before she leaves and if there is she can make a complaint right there on the spot so the valet can’t say she drove away and who knows when the damage happened.But yeah she would still have to prove it wasn’t like that .But it’s better into find damage there before you leave.

Maybe they don’t but maybe everyone should.the judge is ruling on the law.There has to be proof where/when the damage occurred and it’s the plaintiffs burden.What if the security guard dropped it while he was carrying it.That wouldn’t be fair to make tte business owner pay.But I do think most businesses would make the decision to take the loss to satisfy the customer .But this one wouldn’t so the judge has to rule on the law and she can’t know for sure when the tv was damaged.

This happened to me, the employee brung the Tv to the store exit. I went home and same crack on the tv screen. A technician came and said that i was in good faith, The crack was from The store. Finally i got the 499 € refound, because the law in France is clear : if you buy something and you can't use it ( Tv, owen, washing machine, etc.), a full refound must be returned immediately. 😊 Sorry for the Lady, Judge is wrong here.
I believe the lady about what the manufacturer said. The defendants face said yes why his mouth said no. It would make sense that they give her another tv and deal with lg directly. They just didn't want the hassle. I bet they slowly went out of business after that episode aired. How could they not won't to make a customer happy with such an easy fix. Whether she broke it or it was already broken, it would seem like a better business move to have just replaced a $400 television. The loss would have been far less than losing a customer's future business. That's just my opinion.

I found a Cyber Electronics Inc online in the Bronx NY. If it Is the same company it looks like a trashy hole in the wall. About the size of a public restroom and records say they make just over 70k a year with 2 employees . I wouldn’t buy a bag of skittles there let alone a television.

Who ever is at fault, (I personally think it is the 'tester' who damaged it and simply put it back in the box), the company has an insurance that would cover their loss, whereas this lady is now completely out of pocket. And who has every heard of buying something that comes in a pre-opened box. I would immediately ask for one in a factory sealed box...

I don't know too many people who open up a box for a brand new TV to inspect to make sure the TV's not broken if the box is perfectly fine. I know myself personally if the box isn't damaged I'm not checking to make sure the TV is damaged

He should of replaced the TV. Sent the Tv back for a RA. LG’s 43” was coming in cracked from the manufacturer. That particular year and size I had five come off the truck and to a customers home damaged without the box or packaging damaged.

As soon as I heard the case being introduced, I knew she had lost. She was not going to be able to prove they did something wrong.
It was impossible to win unless they admitted it. And if that was the case, they wouldn't be at the people's court.

I worked at a small retailer in college that sold crystal and fine china. We inspected every item when it arrived (and signed a form acknowledging that we inspected it). We also inspected every item at the time of sale and made sure the customer saw it. This is protocol at small retailers that sell expensive merchandise. I don’t know why so many of you doubt that the store inspects TVs upon arrival. Something like 10% of TVs arrive damaged. A small business cannot eat that loss.
I couldn't understand how JM was able to keep her job on "The People's Court" for so long. Her contract must've been (Rock Solid). She's an absolutely horrible judge. She has no common sense 😕.
The judge doesn't always understand established Customer retail acceptance and inspection requirements in certain commercial retail industries. This was a TV judgement. And did not properly educate. The third party reseller has certain warranties and limitations of liability. The judge was unreasonable.

If I went to a store and bought a tv and they brought one out in an open box I would be demanding to inspect it and a discount because to me it is a used tv. For a tv I would be buying from a larger store or from Amazon for protection. I bought a 34 inch computer monitor during the last Black Friday from Amazon and it had a black band about 6 inches wide from the left edge of the screen. I contacted the manufacturer for advice, we ran through a bunch of different tests none of which worked. Amazon had sold all the stock they had so couldn't replace it, the manufacturer arranged with Amazon to take it back and they sent me another from their stock. The manufacturer was new to Australia, so they were probably hoping for some positive reviews, but I was happy to do that.
Honesty, in Trinidad, the item is checked before you leave the store, then you sign for receiving in good condition. Even if the item is delivered to you, it is inspected beforw they leave

I'm still not going to check unless it's something small, like a DVD player. In Reality, I buy most of my expensive things online. And they are guaranteed to be replaced if they are found to be defective in any way within 30 days. And of course, free return delivery & pickup at the house.

That happened to my bf just last month, he bought one of those electric motorcycles, it was suppose to be spanking brand new and it was scratched up bad as if it was pre-owned. They argued us down that it was brand new . The motorcycle we saw on the floor was brand new, but the one they delivered to us was scratched up. We eventually got a brand new one, but we had to go through a whole bunch of bullshit just to get it they accused us of scratching it. We did not the person who delivered it, brought it straight into the apartment and that’s where it stayed and we examined it and saw that it was scratched up. Never buy anything in your town little stores.
