Application is not filed under section 156(3) of CrPC, it is filed under section 200 read with 2(d) so that court can order for a. 156(3) b. 190(1)(a) or 204. And Affidavit is filed as per SC case Priyanka Srivastava.
It can be filed in both sections 156(3) and 200 CrPC
