CJI Chandrachud & SG Mehta Weigh In On Wealth Redistribution During Constitutional Bench Hearing

  • There was an interesting conversation between CJI Chandrachud and the solicitor general during a constitution bench hearing on 30th April, in which the topic of wealth redistribution which has been at the centre of a political faceoff between PM Modi and Rahul Gandhi came up. SG Tushar Mehta said that it would be rustic and juvenile to suggest that the nation's wealth could be computed by totally the wealth of all citizens, and then re-distributing it - something that the 9 judge constitution bench headed by CJI Chandrachud seemed to agree with. This came up while the constitution bench was hearing the process of interpretation of article 39(b) of the constitution, which basically allows the government to acquire and redistribute privately owned properties if they are deemed material resources of the community.     Wealth Distribution was done in 1947 by Nehru through Zamindari Act. When CPIM came to power in West Bengal for the first time, they introduced the same and we have seen the downfall of Bengal since then.
    INC is now filled by jobless jerks of DU, JNU, SFI and they come up with ideas like providing reservations at secretary level jobs, reservations in private sector. Commie mindset needs strong strikedown

    It's a common sense. If you take all the wealth from Ambani, then how will he pay salaries to millions of Indians working in refineries, telecom, reliance marts , trends etc.
    How will they maintain profit and how will they expand?
    This is the most disastrous idea a government can think of. In odisha the govt has started giving rice to poor people at rs 1. This has made them so lazy that they don't want to do work. They have no will to get rich , they know that they have enough money to feed their generations because they have thousands of rs 1. 😑 This is the reality.

    Wealth redistribution is a complex and potentially challenging policy to implement. It is a bit extreme, a recipe for disaster. There have been historical examples, such as in the Soviet Union under Stalin, where the state sought to abolish private property and seize the means of production through communist policies. In a communist system, the state owned everything, and individuals were expected to align themselves with the state's ideology, with no room for other political or religious beliefs. There was no discrimination as long as one aligned with the state's communist views.
    While this approach may have worked for a time, it raises concerns about individual freedoms and the potential for the state to essentially "enslave" its people, reducing them to mere cogs in the state's machinery. The motivations for personal development and progress could also be stifled in such a system.
    Once I had a conversation with a Bangladeshi person in 2019. That person asked me why India cannot get out of the labyrinth of sect politics while Bangladesh can do away with reservations. I explained to that person what is possible in Bangladesh due to its demographic composition is not currently feasible in India, at least at the moment.
    However, one thing must be kept in mind implanting a policy in a socialist democracy and partially capitalist country by grabbing it from a communist regime of a particular era in history will not be effective. In a more democratic and mixed-economy context, like that of India, the implementation of redistributive policies would be vastly different. Reservations, for example, are not inherently problematic in our situation, but they should be carefully designed and implemented based on objective criteria, such as financial instability, regional backwardness, and physical disabilities, rather than on discriminatory grounds.
    The benefits provided through reservations should be reviewed periodically to ensure they are still necessary and proportionate. The status of individuals benefiting from reservations should be periodically reviewed. Discriminatory reservations can create grievances and make certain groups feel marginalised, which goes against the principle of treating all people with equal dignity and respect, regardless of their background. People should be treated with dignity for everyone has equal potential, nobody is small.
    In summary, while reservations and related policies can be considered, their implementation must be carefully evaluated and tailored to the specific socio-political and economic context of a country. Blindly adopting approaches from communist regimes of the past, that too, after distorting the intent, may not be effective or desirable in a democratic, mixed-economy setting.

    The problem is not so much Wealth distribution as it is Income distribution. There are HUNDREDS OF MILLIONS whose incomes are so low that they can neither actively engage with the country's national economy nor contribute to it. This actually inhibits the growth of businesses and thus reduces the potential GDP and the country's wealth to the DETRIMENT OF ALL.

    This is a bit unclear, the court is discussing on the interpretation of the article 39(b) and not on anything mentioned by the congress. It was about the fact that India is moving forward towards more of a free market than a socialistic approach and thus the article should be interpreted in similar light. The discussion wasn't political but the video tries to make it sound political and that the court is condemning a socialistic policy by mentioning congress' survey

    SC judges think they are above the government elected by the people. It is not their problem. If Congress forms government (0.1% chance), CJI will not be able to do anything if Rahul Gandhi decides to redistribute wealth. Remember Shah Bano case?
    Interestingly, most people are missing the main point: redistribution of wealth is already happening. Taxation is redistribution of wealth. It is a different matter that what Rahul Gandhi wants even Rahul Gandhi does not know. May be Sam Pitroda knows, but he will not speak to media anymore I think!
