Given that the band is from Italy, I'm surprised by how much of the history of their own country that they got wrong concerning this. "I'm the slave who defied the empire of Rome" -- Incorrect. When Spartacus rebelled against Rome, they were yet a Republic still. "Ave Caesar; Morituri Te Salutant" -- This was the gladiatoral salute directed towards Gaius Julius Caesar, Imperator Roma, before each fight (Hail Caesar; We who are about to die salute you!), during his reign as Dictator. Except by the time Caesar had assumed the role, Spartacus was already a memory, having suffered a final defeat against the legions of Crassus and Pompey many years before. Spartacus would never have uttered these words.
The only thing that I'll nickpick against you here is that despite still being the Republic, Rome was very much an empire. Ruling over large swaths of territory, with many former states under their control.

The Republic was an (lowercase e) empire after its first few centuries, especially after the Punic Wars. It's not necessary for an empire to be ruled by an emperor, or even a king, after all. Rome became _the_ (capital E) Empire when Emperors started taking charge, but the territories and provincial system remained recognizable.
