      Unfortunately our constitutional rights will always be held hostage during unconstitutional laws that get passed every year! Then we go to court and get those specific rights back.

      "Citizens" let this happen and you hold yourself hostage. Everyone just sits back now and lets the gov do whatever. Maybe some will send out an angry tweet but that's the extent of effort. Oh my. Remember it was called The Boston TEA Party and not The Boston TWEET Party. US citizens checked out and became overall timid sheep some time ago. Can't preserve a Free Country that way. Nope.

      Its crazy how a law can pass over night even if later seen unconstitutional but it takes so much time and effort to prove that and get our rights back. Thats backwards it should be hard to make laws and easy to overturn the wrong ones

    Excellent job on the facts of this process. I live in San Diego, California. I can tell you gun sales and CCW applications are at a all- time high! We have over 90 CCW instructors in our County. I feel lucky living in South San Diego, due to many places to shoot in Imperial Valley. Outdoor ranges with no restrictions. I think California is going in the right direction now. But we will have to wait and see. 🙏🏾

    What is crazy about these laws is that the people making them have no costs involved nor do they have any personal stakes. Meanwhile, people are going to jail, having to spend money to fight these laws or fight for their freedom on a constitutionally protected right.

    It is time to remove liability protections for politicians who enact clearly unconstitutional laws. The burden of constitutionality should be on them. They should have scholars and lawyers look over their laws and decide if it is constitutional. If it is, then they run it, if it is not or potentially not. They sign a liability waiver and accept all potential risks. Including but not limited to jail time.

      Unfortunately a lot of the universities that these lawyers and scholars come out of are far/radical left wing. I agree that they should be guided by the constitution, not radical ideologies. It has been killing America!

      The politicians should be lawyers education wise. as their job is drafting laws. And part of the process is supposed to be the state Senate reviewing the drafted law to determine if it's fair and constitutional.

    Hoping for the best. As much as we all hated the summer of love in 2020. It was a huge awakening for people about who is really responsible for your safety. Fingers crossed that this begins the demise of the gun control movement.

    Having the roster in CA it will give the state the opportunity to take their time, and just watch the fees they will charge these companies

      You are 100 percent right on the first part. But it doesn't matter how much they charge these companies. It is a one-time fee. Once the gun comes on the roster, they do not test the guns every year. Companies only have to sign and affidavit every year that they didn't change anything in the gun. While I agree the roster is bullshit. I'm just letting you know how it works. I learned how this works when the beretta fell off the roster. I think it happened in 2017, but they came back on later that year. I spoke to the lady who deals with the roster. I wasn't sure how they came back on. She explained it to me. They were waiting for beretta lawyers to get back to DOJ.

    Being in the military but from California. I picked up a 43 and gen5 19 while I was stationed out of state. However I’m now stationed back here and have been looking into building a g48 for my fiancé but been stuck with all this stuff going on. If it passes I’ll be getting a couple 43X/48 frames as soon as I can lol

    Exciting times we are seeing in CA. I keep encouraging people to remain optimistic as well and try to explain the change in dynamics brought on by NYSRPA case. Keep putting positive energy out, like Anthony mentioned CA didn't seek an emergency stay, they are relatively silent o this, and that alone is a drastic change from previous cases. Be ready for the restoration of our Liberty!

    I live in California and own weapons from California, trying to buy AR-15 in Las Vegas this weekend, they said NO, no guns from California residents and the cold part is, I'm a Disabled Vet!

    What worries me is that if we get these wins, newscum will try to pass some kind of licensee scheme, we already have one for handguns but he’ll try to pass one for rifles that’ll be harder and expensive to get, he can’t take an L his ego will not allow him to lose

      @@aimwright489 exactly that’s what I’m worried about, look at states like New York and Illinois’s who have to meet more requirements than we do, we shouldn’t have to take a test to exercise a right but I acknowledge that it could be worse but with these rulings I’m sure he’ll try to add more requirements to exercise our rights

      @@213chewy I believe we are in agreement. I’d rather have seen the idea of a roster ruled unconstitutional than a subset of its requirements. We see how that went for CCW. They’ll play a shell game, and we have to wait infringed while they play. Unfortunately, the judiciary corrections takes years, decade to correct bad legislation. Without penalties, bad behavior becomes a strategy. It’s disheartening, but it’s good to see at least the courts starting to move in our direction.
      But the pessimist still sees where the left is inducing more bad behavior with leniency, closing prisons, and defunding police which allows criminals to feed violent crime with guns, which the politicians push for further restrictions for law abiding citizens to protect themselves. Smh.

    Thank you for this comprehensive analysis of some of the directions anti-2A lawyers would like to take our nation and the opposing viewpoints pointing the other way. The best part was explaining the hesitation on the part of those who've gotten us to this point and why it (may) be turning around. It does appear that the cognative disonance of our nation may be abating. It's taken us a hundred years to get to this point, so this won't turn around in a couple of weeks. No reason to stop now...

    If there is a ratio of taking multiple off, when 1 comes on, and that part is NOT removed, then this will be good for California anti gunners. Each time taking more guns away... this if not removed will result in only 1 gun available.

    I think what California's doing right now is trying to stall for the Benitez ruling. One of my friends became a lawyer and became pretty dang good at it. He always talked about how momentum was such a crucial factor for judges and gotchas were big for jurist. How judges were like a fraternity and they all look to each other even if not the same circuit. Last thing they want is to appeal this and within a day or two The other ruling drops. They have 14 days but man they don't got a lot of good cards to play but doubt you not they will go to the end, This has zero personal cost to them and in their mind only upside to not take a big L

    Gun rights groups in Massachusetts are gearing up to fight our handgun roster. We have one similar to California's, but not as harsh. We get some new guns added, but we're still limited to what Maura Healey says we can own.

    Someone should sue the state to eliminate the California Handgun Roster completely because it is obviously about restricting handgun availability to most citizens and not about safety at all. If it were actually about safety there would not be any exemptions for LEO's and so many other city, county, and state employees - what, these people don't need "safe" handguns? Why should they be allowed to purchase and use newer, more modern handguns that the state has not blessed to be "safe?"

    Anthony, I’m a little confused on your 3:1 ratio comment. Referring to the Glock gen 4 and 5 potentially added to the roster and the gen 3 getting dropped. The gen 3 could be added back at a latter date. Maybe I’m not understanding the process correctly. My understanding is at current, 832 guns are actively available on the roster at the time of this post. If a new one is added, three are to be removed. I know this is extreme, but say all 832 are replaced on the roster, that would mean that only 277~ could be added back on. If all 277 are replaced, we are left with 92~. Is my understanding of this wrong?

    It’s ironic. I read somewhere that the 9th Circuit has the highest overturn rate by SCOTUS while the 2nd( NY, Vermont, and CT) has the lowest. It’s not political leanings, rather political rigidness.

I just don't understand how they can swear to uphold and defend the Constitution in front of the whole world and then months later start stopping all over it and turn it apart something needs to be done about that.     Lawsuits should also attack the portions that exempt government agencies and their retirees. If these features aren't safe for a citizen, how is it safe for a citizen employed by the state. Hundreds of instances (maybe many thousands) that show police et al. aren't safe firearm users.

    if you move to CA from out of state,
    you can bring your off roster handgun?
    as long as it doesn't classify as an assault weapon
