Housing attorney here: just wanted to clear up a misconception on what a squatter is. A squatter is someone who ENTERED a property without permission. It’s not someone who has overstayed, refused to leave, or hold over. This person had permission to enter, granted by mom as owner, and she’s likely a licensee. Now, with mom deceased, the new owners are likely revoking her ‘license’ or permission to stay. She’s not a squatter; she’s a holdover licensee and has the right to summary process in court, which is what we watched here.
So if I was to allow someone to enter my home to use the restroom and when they're finished using the restroom they decide they're going to stay and live in my home. They're not paying rent so would that make them a squatter even tho I let them in my home? What about the people who rent an Air BnB and then refuse to leave and just stay? They were allowed to enter into the home by the homeowner as they paid to be there in the Airbnb. By your definition of what is or isn't a squatter then neither of the situations I used as an example would qualify someone as a squatter... Cant have it both ways.... It's no different than allowing a friend to stay for the weekend while they're visiting the area and they choose not to leave Monday morning like they originally said they would. Does that mean they're not a squatter? If none of these situations falls under someone being a squatter how come they end up with squatters rights... Are you a housing attorney for every state in the US and does every state have the exact same housing laws? We both know that answer which is also why YOUR definition of a squatter isn't THE definition. Look at how many people in LA rent a home for the weekend and don't leave and everyone including police and the district attorneys call then squatters. You may need to refresh your memory on each states housing laws or what rights squatters legally have in each state before making broad opinionated statements after letting everyone know from the very start that you're a housing attorney so that it would make people thing what you said was correct solely based on you supposedly being a housing attorney which in my own opinion is think you're telling lies about being a "Housing Attorney" because if you were you would've known that what you were saying wasn't accurate because it clearly doesn't represent the definition of a squatter for every state in the US. Be like saying you're a DUI Attorney and you can't get a DUI just for being passed out in a running vehicle in the middle of the road because they weren't operating the vehicle as they were just sleeping in a vehicle which isn't a DUI...which is the same situation as the squatter definition you thought you knew.

I personally have a great deal of compassion for this poor, older woman. What often happens whenever a person has died and left any kind of property, real or otherwise, and no will, the claws seem to come out. She often reiterated that she cared for her elderly mother as if to state that no other family member contributed to their mother’s aid. So sad. The judge demonstrated a great deal of patience and tolerance.
I lived with and took care of my mother for many years. After she died, I had to be out of the house in 6 months so the house could be sold. I don't think that first woman is the owner of the property just because she lived there for three years. She needs an attorney, and she should have brought all of her paperwork to court. 😮

With the first case, people have to understand the judge Let this woman go on and on because what you see in a lot of courts where people represent themselves, judges tend to be a little more lenient with people who don't know what they're doing. Most likely, she wouldn't allow the actual lawyer to go on and on because he should know better. The judge also knew that this woman didn't have a leg to stand on, so the judge allowed her to go ahead and dig the hole deeper.
This breaks my heart. I worked with this woman 52 years ago, what fun we had, intelligent, great sense of humor, attended family weddings and knew her sisters. She is so confused now and is obviously challenged. I moved away over 40 years ago and often wondered what became of her. I wish her peace and comfort. .

right? her case was very strange! sounds like she may be showing the early signs of dementia? my grandfather passed from dementia and i vividly remember how it started and how confused he got. one night my grandmother woke up to him sitting on the edge of the bed, in the middle of the night, cleaning his gun and the gun went off and shot right in betweeen his legs and through the floor... another time, he left to go to the grocery store in town to grab a few things just like he had done for over 50 years (papa was always the one to run the errands into town cause my grandmother didnt like to drive)... from my grandparents house to town is exactly 2 miles.. its only one turn from our street onto route 3 which brings you straight into town. Well on this day, an hour went by and he still wasnt home... then 2 hours.. then 3 hours... he still wasnt back yet. So grandma went into a panic and had the whole street and the police out looking for him.. he was found on a back road outside town in pulaski which is 20 mins away from the store he went too, he had gotten lost coming home. Like i said, my grandparents have lived in that house for over 50 years, he drove into town and back home a billion times.. for him to get that confused that he got lost going down the street...?! instead of turning right onto his road, he just kept going straight on state route 3 and route 3 runs all the way through the state of NY so he could have ended up hours away just by staying on that road. That incident is what got him diagnosed with dementia. After that it went hard and fast and he passed less than a year later when he ended up in the hospital with a collapsed lung. taking a dementia patient out of their normal surrroundings and putting them in a place they have never been to before is the worst! he thought i was still a baby and he went back to his time in the army talking about missles cause he thought he was fighting in a war. dementia/alzheimer's are is a horrendous and very aggressive disease. I wouldnt wish it on my worst enemy. Now off my long ass side story... im not a doctor so i obviously dont know if this lady has dementia but i certainly feel like something very serious is going on with her, just by the things she was saying in court. She is seriously paranoid! She thinks everyone is out to get her, even the Judges! When she said that one Judge was reincarnated so he could refile the case against her was pretty insane! I really hope her family keeps a close eye on her.

I don't know all the facts either but I've lived long enough to see all sorts of strange behaviour after someone dies
It's entirely possible that her mother told her the house would be hers as a token of appreciation for looking after her but that means nothing if the mother didn't make that legally binding. It's always sad when families behave badly when someone dies
So how does wanting someone out of a home you recieved from an inheritance after the parents passed away. Should they just allow the person to stay their until they pass away like the parents did. This isn't between 2 siblings fighting over an inheritance or for certain items after parents passed away.
It sounds to me in 1st case that sister may have felt like she was only child who cared for her mom and felt “entitled” to the house even though mom didn’t have a will but that means nothing in court. The court seems to have done what they felt was fair dividing the house equally among the siblings but only problem is they get nothing out of it if that 1 sister won’t leave the house for it to be sold where they could all benefit getting equal shares of the sales from house so instead due to her unwillingness to leave the home and not paying rent she is losing it completely. I believe she knew what she was doing and kept taking it to court over and over thinking she would eventually get a judge to side with her since she did “more” for their mother then the other siblings…just my opinion and it is very sad she will lose her home but had she just gotten out of the property so they could sell it or pay the rent amount she could continue living there but she wanted to stay in the house and live there for free…
Just watched that happen with some family, one family member was hands on and took care of her brother as he was losing the battle with cancer. He died and left his house ( no mortgage ) to his sister and not to circling nieces ( from his deceased wife’s side ) who did nothing but expect the estate. They went off the rails and got nasty. Still lost out as the sister was the beneficiary in the will.
My mom is 85. She's basically supported my brother, who is now 65, his whole life. He's finally earning his keep by helping her out with chores. I'm 100% sure he's going to pull the "I was there for my ill mother at the end" malarkey. He's never even owned a car, they've all been mom's cars.

THIS! Tenants (squatters) get all the time in the world to not pay and drag the landlords through the courts for years. Landlords already lost the rent and now they have to spend $$$ for a lawyer. At this point the landlords just want their property back. It should be: if they haven't paid rent in three months (90days) they are dragged out on day 91. 🤷

This lady needs an attorney PERIOD!! I dont see how she brought a motion and yet no recollection of ANYTHING. She no paperwork, she doesn’t remember which court, she keeps saying pending litigations and they have nothing to do with the motion she set forth. They told her to get an attorney at the first hearing and yet she still hasn't obtained one. The judge is allowing her to go on and on and yet nothing is being resolved. She should be old enough to know better.

I believe for a civil case theres much less that a judge can do. if it were a criminal case they'd more than likely order a competency exam and more than likely deem her unfit to represent herself.
They tend let people go on if they don’t have legal representation. This is a courtesy to make sure people feel like they have had their day in court and so that people will understand and possibly accept the judgement.
I feel for this first woman. She’s elderly and clearly out of her depth. An attorney would benefit her enormously, if only to convince her of whatever her circumstances really are. There’s no “shame” here and there’s no “act” either. Just an elderly woman trying to keep the home she lived with her mother in. Nothing nefarious going on despite some snarky comments.
A stipulation of facts is a written document wherein the parties agree to certain facts of the case. Someone should file a deed or order from a court deeming who the owner is. I’m sure that was submitted with the complaint.
The Circuit Court ruled all 4-sisters equally and jointly owned the house. Therefore, when one of the sisters decides to live in the house, she then owes rent to the others. If she doesn't pay such rent, she can then be evicted, even if she is a joint-owner. Actually a fairly simple case for the judge, not withstanding all of the mumbo-jumbo by the defendent.
She's clearly got early stage dementia and needs help. Either they didn't explain it when they all signed the deed, or she feels that she shouldn't have to pay if she was the only one to take care of their mother until death. It's very normal that that sibling that does take care of the owner stays in the home, while the rest still demand money. But the one that takes care of the mother usually get the house and life insurance/bank acct etc. There is no way her SSI could cover that. Where did they expect her to go, straight to the nursing home after the mom died?
The Judge should write the court order not 1 of the attorneys in the case! The Judge has law clerks who have graduated from law school to write the court orders for the Judge.

Like many ancient traditions a mixture of mythology and basic sense... high in protein and iron, part of the placentae would be cooked and fed to the new mother to help her regain strength after the birth. I understand wanting to pull the information out of the woman in the first case and I'm very sorry for her in the sense that she was a caregiver for years and was apparently under the impression she had some rights as a result. But let's remember the other side is paying a lawyer to sit there listen to nonsense. A better way to handle this would be to get some background information from the lawyer and then ask the woman pointed questions to move her along. Enough is enough.

This lady needs an attorney PERIOD!! I dont see how she brought a motion and yet no recollection of ANYTHING. She no paperwork, she doesn’t remember which court, she keeps saying pending litigations and they have nothing to do with the motion she set forth. They told her to get an attorney at the first hearing and yet she still hasn't obtained one.

I believe for a civil case theres much less that a judge can do. if it were a criminal case they'd more than likely order a competency exam and more than likely deem her unfit to represent herself.

I feel for this first woman. She’s elderly and clearly out of her depth. An attorney would benefit her enormously, if only to convince her of whatever her circumstances really are. There’s no “shame” here and there’s no “act” either. Just an elderly woman trying to keep the home she lived with her mother in. Nothing nefarious going on despite some snarky comments.

A stipulation of facts is a written document wherein the parties agree to certain facts of the case. Someone should file a deed or order from a court deeming who the owner is. I’m sure that was submitted with the complaint.
The Circuit Court ruled all 4-sisters equally and jointly owned the house. Therefore, when one of the sisters decides to live in the house, she then owes rent to the others. If she doesn't pay such rent, she can then be evicted, even if she is a joint-owner. Actually a fairly simple case for the judge, not withstanding all of the mumbo-jumbo by the defendent.
She's clearly got early stage dementia and needs help. Either they didn't explain it when they all signed the deed, or she feels that she shouldn't have to pay if she was the only one to take care of their mother until death. It's very normal that that sibling that does take care of the owner stays in the home, while the rest still demand money. But the one that takes care of the mother usually get the house and life insurance/bank acct etc. There is no way her SSI could cover that. Where did they expect her to go, straight to the nursing home after the mom died?

No she thinks the woman is lying. Thats why she said she would look up the name of the business in the state registry.
Yes and no. She knows those men gave her some sovereign citizen bs. The elderly woman doesn't understand but she is protecting them even though her mind is going bad. She really believes they know something about law. From her perspective the court is helping her sisters take the house after she spent all the years being the only one to take care of their mother. She's in her 70s. She wanted to just relax and pass on in that house too without worries.
