I had a c&p exam and the examiner only took one measurement or my name and I had an increase for my left shoulder and a secondary for my right shoulder and she took zero measurements of either one of my shoulders I got my award letter my left shoulder stayed the same my right shoulder got denied and was told it wasn't file properly as a secondary. my knee has been deferred, but doesn't say why, I injured it 3 times while on active duty. My VSO won't let me see my C file and I filed the FOIA in August and haven't received anything yet.
My IBS went from 0% to 30% BUT it did not make any changes to my 90% SCD. Even though my combined rating at 200 BUT the va math is at 94% so it stayed at 90% instead 100%
I was awarded 10 % for aorta insufficiency and 0% for hearing loss in 2004. Both of my condition are worst now. My cardiologist told me this year that my heart valve condition is severe that I will need a valve replacement when my symptoms get worse. Should I hire and attorney?
@Bebie Cuajotor Did you get 10% for tinnitus? Also, a doctor needs to state how your heart valve condition has gotten worse along with your your functional loss and impairment. The good thing you are service-connected already.
I'm currently rated at 50% for PTSD, I have buddy letter that discuss aspects of my issues that I wasn't aware of when I went to my C&P exam and I'm currently past the appeal time. Are the buddy letters relevant at this point? I also got the records of my visits with my social worker but there's not exactly much listed in them. Do I have enough relevant evidence to apply for an increase or should I continue to get more?
@Tom Paul Look at the rating criteria and also your buddy letters and your personal statement should state your social and functional impairment. More evidence never hurts.
@lisa alvarez What are you service connected for and what other claims do you want to make? Do you have evidence, current diagnosis and or a doctor linking your injuries to service?
Why don’t you CCK talk about how to fight willfull misconduct? Why should a vet and his family suffer over a lifetime because there was a willfull misconduct? Why they (VA) don’t even let you know you have one until you apply for a legit service-connected disability.
Thank you for the information. My claim is at the DVA awaiting a decision and the VA.gov website says there are 17,103 cases ahead of me. Does this means I have another 2 or 3 years to wait before my case is even looked at? Thank you.
