IN REGARDS TO THE CONTRACT: 1) you scan/make a copy 2) You attach TRACKING information (it's worth the extra $6, trust me) 3) You make it a CERTIFIED letter, which means he has to sign for it IN REGARDS TO THE PAYMENT: The defendant SHOULD have sent some sort of notice that is DATED, whether by text, email or mail stating the change in regulations/payments stating that, from x date moving forward, ALL deposits needed to be given UP FRONT and [insert whatever else he wanted to change], KEEP A COPY of that notice. That way the Plaintiff can't be under the impression, "Well, Joe said to keep it the way it's always been". No, these are the new rules that went into effect before you booked the August bus, you don't get special treatment just because you've, "worked with him for years" there are SO many instances, many that you see on this show in particular, of people who suddenly change after "working with people for so many years." IN REGARDS TO THE SWITCH: 1) if you tell someone you're going to call them back, REGARDLESS of what the person you're about to call says, CALL THE PERSON BACK IMMEDIATELY, not after six hours "right before I went to bed". I have DND mode on that starts at 9 which only allows my boyfriend and a select few others through. If I'm not made aware that I have to be somewhere at 7AM on a SATURDAY than I'm gonna sleep in! 2) HOWEVER, once the first phone call was made asking where I was and what my ETA was I would be like, "I was not made aware that there was a pick up that was VERIFIED for today. The last time I SPOKE to anyone to CONFIRM the pickup it was NOT confirmed and still needed some details ironed out. My business hours are from 8AM-6PM. After those hours, unless it's from a pickup I'm currently attending, my phone is off." I would not be rushing to pick them up, I'd be taking my sweet time because, "Poor planning on your part does not constitute an emergency on my end" I do NOT think it was professional nor adequate for the new person to completely cancel the whole rental because of The Plaintiff's frustration. I think he took it as her being "rude" but, if you look at it from an outsider's POV, you can see that she's frustrated because the expectations that have been set for so many years are now not being met, which makes her look bad in front of her church ladies. If you can't handle irate customers, than don't go into retail. 3) It needed to be made clear EARLIER that the Plaintiff's contract was no longer made with the Defendant but was now with the "other bus driver". Had that been made aware sooner, I think things would have gone not only smoother but also the confusion wouldn't have been there. The confusion started when the Defendant originally STATED that he was going to call the other bus driver to "set up the bus rental" that, in hindsight, makes it look like you're subcontracting the bus rental to the new guy but that the contract in whole still stays with you. REGARDLESS, I think it was handled poorly on BOTH parties. I think she should have gotten at least a PARTIAL reimbursement simply due to the bus driver's incompetence and the last minute cancellation because there was STILL TIME to save the day, the new bus driver chose not to. For Church going and God Fearing women, they're always so dramatic, you'd think that they would review the written word: Psalm 147;3 He heals the brokenhearted and binds up their wounds. Even if the lady signed the contract, she never gave a deposit. No private bus company is going to set a date of travel without any cash up front. She tried to take advantage because she was too comfortable with him.
She claims they had numerous conversations where the date was questioned/confirmed, it's unlikely that would happen if they truly had a contract and an agreement about the deposit.
Why mail a contract when we have email and phone caneras, etc? Annnnnd if you mail something like that, you do it with certified mail and return receipt.
