From a tenant perspective, problem is landlord will not return security deposit but is in a different state than rental, so small claims judgement does not help when the landlord ignores it...a bank sweep does not help with landlord in different state, a lien on the property does not help if the landlord is not selling for years. Tenant never gets the security deposit.

How about you have evidence of the landlord’s bank account and the landlord has enough money in the bank account?

This might be the way small claims works in NC but I took a Landlord to court 20 years ago in California. You had about 2 minutes to state your case or respond to comments. Judge did not ask any questions and closed the file and said we would be notify via mail of the outcome. The outcome was that both the claim and the counter claims were dropped. Best Advice, make sure you submit everything in writing and get in all your comments early because you may never be asked to explain. I think the courts are way too busy for cases like this video.

At 8:44 the "witness" testified that the "living room and dining room had carpet". Cross exam of the landlord she states there was no carpet in the dining room! Sounds like the tenant is guilty!
