      If so, perhaps the six Republican appointed, three Trump appointed justices Supreme Court has just given Biden free rein to do as he pleases, like having the Justice Department throw convicted felon Trump in prison and call it an official act in his role as president.

      Oh, you do have a point. I've been telling people that all officials have legal immunity. It is somewhat implied in the US constitution (re: "They (senators and congressmen) shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest...") and the constitutions of states, counties, other countries have similar weasel words. Officials have given themselves legal immunity and we all just have to trust that they won't act in self-interest, but will execute their duties of office in service to the interests of the public. BUT, they are not obligated to, nor bound with punishment should they fail to perform their duties. So, here we are, the court rules that Trump has... oh, not just OFFICIAL IMMUNITY, but ABSOLUTE IMMUNITY. That's an extension of the law that applies to court officials. I have no skin in the game. I know that US presidents are selected, not elected. Otherwise, I'd be wondering if Biden's people would take advantage of their official immunity and eliminate the competition.

      Because presidents campaign while they are in office. He is also the chief executive of the country that is supposed to make sure the laws are faithfully executed. If he had a concern that the law was being broken, and he told someone to investigate it, you might want to tell him to go pound sand, but he's still the chief law enforcement officer of the US government. That's exactly what official capacity is: He gets to investigate matters. It's his job he was elected to do.

    Can anyone explain this. If a president in office while election results are declared, refuses to accept the results, can he have power to do anything? If so why would any president in power give his office to coming president that results confirm? Every president can then continue ruling indefinitely untill he himself chooses to step aside.       Arguably yes and IMO that's where this is so odd. Let's say a sitting president believes the election was stolen or that his opponent is working for a foreign government. I'd say that in both of those cases he could argue that taking action to stay in office is an official act of protecting the country. This opens the door for what we see in other countries where a leader holds office pending "free and fair" elections that never come.

    Let me tell you how I see the Supreme Court’s ruling on Presidential Immunity published July 1, 2024.
    The ruling contains the seeds of disaster for the Government of the United States. Immunity for Official Acts of the President is considered absolute. Immunity for Official Acts was implicitly assumed in our government from the beginning. However, the wording of the finding does not limit the realm of Official Acts and includes actions which are presumptively Official.
    The wording does not permit the consideration of motive or intent. The wording, in present conservative interpretation, would allow directing the Attorney General to ignore or postpone a suit brought against the actions of the President or his Executive Staff.
    Recent history has shown us instances when a President of The United States attempted change the outcome of normal elections. Some of the actions were in direct contradiction of established democratic procedure.
    I will not Vote for Mr. Trump

      up until now, it has worked, but you had a leader to the senate who held up one nomination during a Democrat term, and using logic contrary to the first steal, snuck another one in at the last minute when RBG died. So Trump appointed 3. 3 Conservative ultra right wing judges that sent Roe back to the states to decide and removed on of our rights we have had for 60 years. I knew it was just the beginning. so now we have 6 ultra conservative justices to 3 moderate liberals.

      If I've understood the SCOTUS decision today, then it will be legal arguments going forward in the lower courts that determine exactly what is and what is not an "official" act as a president. The main point is that this SCOTUS ruling has bought Trump more time (i.e. if he gets re-elected then he's effectively home free). I would at least find some measure of comfort if Biden's administration were on the ball sufficiently to take advantage themselves of this decision.

Anything the lower courts do can be overruled by SCOTUS, meaning the five MAGA judges, and they alone, will determine what is legal for a US president to do. Effectively they have given themselves unlimited authority over the executive branch of the government. All to help Trump escape jail, and stop him taking down the whole GOP with him if that ever happens.
      Basically it's the sequel to Jan 6th we've all been waiting for, except this time the thugs are better dressed, and taking aim at a different branch of government. Nothing else has changed.

    Actually, that word "some" is a very big word in the decision and when applied to future cases involving actions of Presidents while in office it has a very far reaching impact. For example declaring war without the consent of Congress, can he be fully prosecuted for his action or the President has "some" immunity because it was an "official" act.     That’s not what they have said at all. Some immunity but it depends upon whether or not the law was broken during the course of normal presidential duties. Inciting an insurrection is not part of normal presidential duties. Taking confidential papers and hiding them from the FBI is not part of presidential duties.

      Not exactly. This is about in the event that the law is broken by the President. So in this example he has already broken the law. If it is in the course of an official act he is immune. If it is not then he is not.
      What they have said is that Trump is not immune for actions where he has repeatedly and willfully broken the law in cases where those were not official actions.
      It's a 'win' for Trump only because he has a mountain of charges against him. This helps him with some of those so the net is a win given his current legal situation. A 20% shorter mountain is still a mountain.

      Actually Labour were more than involved in "retrospectively changing the Law to legalise illegal acts".
      "The Investigatory powers act" breaks Article 8 of the ECHR. "The Online Safety bill" breaks Article 10.
      The EU's own "Digital services act" also breaks Articles 8 and 10 ( as are France and I think Germany )
      Governments, it seems, 'retrospectively change the Law' when it suits their agenda.

    Allegation That's the thing. And the one conviction that is already Being reviewed and The findings of the lower court have been frozen. This is usually an indication that there's going to be a overturn of the lower court's findings. Not a return to the court but I can fleet overturn. If the district court would have ordered a review, that's one thing, but to put a stay on the order.That's definitely an indication that things are not gonna go so well for this court. Especially since it's already indications of this barment and other repercussions due to the illegal activities that went on in the courtroom. And inside the judges chambers, this church is probably looking. Some time in federal penitentiary and I don't think he'll go where martha went.
