    Its an honor to hear you Respected sir.
    There is so much to learn jst through these sessions that you most humbly organise for young lawyers like us. Since lockdown I have been studying through books like R.V Kelkar on CrPC and really struggle to finish a chapter on investigation by police n pretrial procedure...n felt guilty for not studying that much which is required... perhaps not been able to maintain a discipline but the day I was introduced through BCD a session by you, everything is history and I m actually not jst reading books on CrPC , n following each of the instructions given by you but have been making notes through your sessions. You are lord's blessings to me I want to believe n it's truth!! Its jst a dream to even think of meeting you sir but I wish may be my luck has it and I some day meet you.
    I sincerely want to tell you Sir I am ur big fan today. You are brilliant n the most humble lawyer a country is proud to have. I m indebted to you and thank you from the kernel of my heart to lift my spirits which were low in these times n yes the law school didn't teach us many things n you have shared so mch to us.     Excellent Lecture Sir. Thank you very much. As per 2019 judgment in Vinubhai Haribhai Malavia, SC held that Magistrate has the power to order Further Investigation at any stage even after taking cognizance of the offence till the commencement of trial(framing of charges). Relevant sections: 2(h), 156(3), 173(8) of Cr.P.C.

    Sir if application is moved under Sec 156(3) Crpc for filing fir and upon investigation closure report is filed . Magistrate can still order further investigation .
    1. What are the principles for ordering further investigation ? Any case law
    2. Is there limit on how many times further investigation can be ordered ?

    Sir you have said that burden of proof shifts in two circumstances, firstly- abetment to suicide and secondly- dowry death. but as far as i am concerned, the burden also shifts when some facts is especially within the knowledge of the accused as per section 106 of the evidence Act. kindly enlighten us with reference to 106

As public servant they enjoy immunity under section 197. How and when sanction of state gvt. Is required .. Please explain sir

    With respect to sec 188 of ipc, police cant register FIR.., as per sec 195 of crpc, only a private complaint can be made to court by the public servant who promulgated the order or by any person authorized by him in this regard.

      Please note that Section 174A, 188, 195A, are cognizable and thus are treated as exception to 195 CrPC. There are many instances where FIR are filed directly and are investigated. In all the cases of violation of lockdown orders, FIRs u/s 188 are being registered.

      @@vikaspahwasradvocate2825 Dear sir According to Section 29 of the CrPc., a Judicial Magistrate of First Class may pass a sentence of imprisonment for a term not exceeding three years, then under which section a JM 1st class can have jurisdiction to frame charges for offences punishable more than 3 years. Please guide me to understand. Regards

      @@vikaspahwasradvocate2825 sir his query is how can magistrate try offence with 10 year jail term eg forgery us 467ipc when he cannot award more than 3year imprisonment?
      Delhi High court had sought opinion of centre on this issue
      There is provision u/s240&246,that the magistrate is of opinion that there is ground for presuming that the accused has committed an offence triable under chapter 19crpc ,which such magistrate is competent to try and which ,in his opinion could be adequately punished by him ,he shall frame in writing a charge against the accused.Offences punishable with 10 years or more made triable by JM1st class is not illegal .If magistrate during hearing on the point of the charge he find that in his opinion accused could not be adequately punished by him then he should not frame charge but commit the case to the court of session under section 323readwith sec209 crpc

      Delhi High court has sought answer for this lucanae from centre ... Hopefully it proves to be first step in fixing this mismatch

      Syed Aleem Uddin Subhan Yes the IO can add or subtract any offence during investigation. If he is not doing it, even when there is evidence, you can file an application before a magistrate for supervising the investigation and giving necessary directions in this regard.

    A crime can in many cases a contest between right and wrong irrespective of what the statute says eg. Civil liberty movement,or let say ripple created when one challanged caste system against a established norm (not statute- which is actually a modern form of old religious text etc.) Or trade union movement esrly origins conspiracy punishments.
