09:08 🌐 *Discussion branches into the concept of the American global role, contrasting national interest versus global influence and its impact on policies.*
16:07 🤨 *Analyzing Trump's actions through a lens of flexible authoritarianism and political corporatism to label them as a form of fascism.*
19:16 🗳️ *Key distinction: Trump's unique action of pursuing the Eastman legal theory to manipulate electors stands out compared to past challenges, elevating concerns about a coup attempt.*
21:51 🔍 *Eastman's theory aimed to have Pence unilaterally toss electors of seven states, potentially leading to a House vote where Trump would win.*
22:47 🏛️ *Eastman's theory involved pushing the election decision to state houses, giving Trump an advantage based on Republican House delegates.*
23:54 📜 *Eastman's plan focused on claiming dual slates of electors in seven states, enabling the House to declare Trump the winner.*
24:35 🛡️ *The legality of the action, not just the definition, matters in labeling it as a coup or insurrection.*
25:59 💡 *Legal steps, even if constitutionally dubious, may still constitute a coup if taken by a president to entrench their power.*
34:10 🚫 *Pence's unilateral action to toss electors based on alternate slates aimed to circumvent the Electoral Count Act, potentially altering the election outcome.*
36:18 📜 *Eastman's plan wasn't about following through with legal processes but manipulating the system to benefit Trump.*
40:18 📜 *There's debate on whether actions intended to change election results could be considered a coup, depending on the legalities and outcomes.*
44:15 🧠 *Despite legal debates, most agree that allowing the Vice President to unilaterally alter election results goes against the spirit of democracy.*
45:23 🇺🇸 *There are historical examples of disputed electoral votes, but they differ significantly from the proposed actions, involving official state recognition and electoral certifications.*
52:09 🗂️ *Historical cases of alternate electoral votes were rooted in genuine disputes recognized by state institutions, unlike the proposed scenario of unilaterally rejecting certified votes.*
58:20 🔍 *Understanding procedural issues in past elections helps contextualize current disputes.*
59:44 🏛️ *Similarities exist between past Democratic goals in 1876 and claims made by Trump's team in 2020 regarding election fraud.*
01:00:13 🤔 *Questions arise about laws determining voting rights and the legitimacy of alternate elector slates.*
01:01:09 ⚖️ *Historical instances of alternate electors and challenges prompt a discussion about legal responses and perceived double standards.*
01:02:04 🌍 *The focus shifts from subjective viewpoints to the legal system's response to these actions.*
01:05:53 🏛️ *Distinct cases between past and present electoral controversies underscore nuanced differences in legal interpretation and circumstances.*
01:07:42 🤔 *Despite similarities in alternate electors, differences in intentions and circumstances shape how these actions are perceived legally.*
01:17:32 🗳️ *Trump's belief in election rigging stemmed from legal changes in voting laws in Pennsylvania, leading to court challenges regarding mail-in voting and signature verification.*
01:20:45 📜 *Pennsylvania's mail-in voting law was ruled unconstitutional in 2022, raising questions about the legality of voting changes, but the Supreme Court later overturned this decision.*
01:21:26 🏛️ *Trump had reasons to believe the election was rigged, citing legal challenges in Pennsylvania and potential impacts on the election outcome.*
01:27:47 🌐 *Trump's claims of election fraud focused on swing states and alleged anomalies, fueling his belief in a rigged election despite multiple claims being invalidated.*
01:36:26 🗳️ *There was anticipation about late-counted ballots favoring Democrats, widely acknowledged before the election, including by Trump's team.*
01:37:22 🤔 *Arguing that an election is secure when significant changes to voting methods occur might become a recurring trend, not just a one-time occurrence.*
01:41:09 📥 *Chain of custody issues regarding ballots in Georgia were raised, although subsequent reviews and investigations altered the narrative around these concerns.*
01:46:16 🧐 *The legitimacy of challenges to election results was doubted due to their lack of substantive change despite numerous inquiries and recounts.*
01:55:34 🕵️‍♂️ *The Weiner case agent expressed concerns to the Southern District of New York, prompting further investigation after the FBI's delayed action on the laptop.*
01:56:18 🚔 *Going outside the FBI to another agency like the Southern District of New York was unconventional, suggesting a lack of response within the chain of command.*
01:57:26 🧐 *The Southern District of New York's involvement pressured Comey into publicly announcing the investigation's reopening to avoid potential accusations of cover-up.*
02:00:30 🤔 *The Inspector General highlighted the FBI's inaction until external pressure intervened, indicating a reluctance to address the Weiner laptop issue promptly.*
02:05:11 🕵️‍♂️ *The IG report suggests the FBI's inadequate explanations for delayed action on the laptop issue, indicating incompetence or bias, leading to further investigation.*
02:08:12 🕵️‍♂️ *Despite FBI leadership's belief that the laptop information was significant, delayed action persisted due to internal issues, even with ample resources available.*
02:11:44 🕵️‍♂️ *The report revealed a lack of evidence suggesting intentional hiding of the Weiner laptop, but it also questioned the FBI's failure to act on crucial information promptly.*
02:13:20 🔍 *The discussion dives into why certain FBI members didn't pursue investigating the Weiner laptop more stringently.*
02:14:45 🕵️‍♂️ *The conversation speculates about the FBI's prioritization between Russia collusion and investigating the Weiner laptop, suggesting potential biases.*
02:15:56 🤔 *The debate grapples with the possibility of FBI bias against Trump and favoring Clinton, examining the evidence and patterns of behavior.*
02:17:07 🕵️‍♀️ *Exploring the significance of potential biases within the FBI and the impact on investigations, considering internal reasons and responses.*
02:18:30 💡 *The conversation delves into differing interpretations of the Inspector General's report, specifically on bias and evidence clearing individuals within the FBI.*

02:30:18 🔍 *Reviewing specific reasons behind Comey's public announcement about the reopened investigation, including concerns about concealment and perceptions regarding the election.*
02:32:41 📰 *Comey's belief that Hillary Clinton would win shaped the handling of the investigation; they aimed to avoid accusations of aiding her victory.*
02:35:00 📢 *Comey's decision to announce Hillary's wrongdoings sans charges aimed to preempt post-election controversies, assuming she'd win.*
02:35:42 📚 *Comey's concern about delegitimizing Hillary's win led to his disclosure of her wrongdoings before the election.*
02:36:24 🔄 *Handling of Clinton and Trump investigations reflects disparities; Comey's belief in Hillary's victory heavily influenced his actions.*
02:37:05 💥 *Comey's announcements were more about preserving FBI's reputation than intentionally affecting the election outcome.*
02:37:48 🗳️ *Comey's actions regarding announcements were frequently cited to counter arguments about FBI corruption during Trump's era.*
02:38:16 🏛️ *Comey's primary concern was to maintain the FBI's public reputation rather than influence the elected official's relationship with the bureau.*
02:38:58 🗣️ *The public perception of the FBI, shaped by Comey's announcements, played a critical role, despite not being an ideal practice for the bureau.*
02:39:26 ⚖️ *Trump's firing of Comey was linked to discrepancies between public and private statements regarding the Russian investigation, potentially amounting to obstruction of justice.*

To be clear, there will always be bias in what should and should not be prioritized (i.e. the severity or type of case - not necessarily politically based biases and nor should Red or Blue play a factor). The FBI does not have infinite resources to pursue each and every case the same. To act as though someone could just willy-nilly use the FBI against whoever is a poor interpretation of issues that were found in the IG and Durham reports. All in all, the 3-party oversight was pretty damn good by the looks of it. Bad actors were found with one of them actively being charged, and has put greater pressure on the FBI to ensure that there are rigorous processes in place to minimize biases.

      1) Virtually all of them were unarmed - same with BLM rioters. So I guess those weren't violent either.
      2) You clearly don't know what violence means. If BLM protesters kidnapped, blindfolded, and tied up Ivanka Trump from her bedroom and held her hostage, but didn't actual bruise or cut her, is that violence?
      3) yeah they were too cowardly to do any damage. I'll give you that.
      4) also agree..they were angry and too stupid to realize that what they were doing was becoming an eternal laughing stock to anyone with a functioning brain.
In conclusion, I totally agree with you. It was the most cowardly attempt at an insurrection in American history. And it was carried out by Trump supporters. At least they left that accurate mark in history.

Sure, there will be many more losers than winners, but there evidently is a winner. That invalidates your argument. The majority consensus does not necessarily imply the correct result. I'll admit I don't know that much about this, but what gets to me is how the focus is so heavily upon the written text.
So I work for my local railroad, right? And my employer has given its employees a half day every year (either for Christmas Eve or New Years Eve, sorted out amongst the staff typically along seniority lines). This has been long standing practice, so much so that the employer has a payment code specifically for this purpose. In 2019, my employer claimed that it was unable to give us a half day for the holiday. One of the unions brought them to arbitration, and won the right to a half day.
Now, there was nothing in the union agreement for the union to point to. When arbitration concluded that we were owed the half day, they did so with this in mind.
The core of the union's argument during arbitration was simple: When the contract is silent, past practice prevails. Even though it was never explicitly stated that the rail road had to give us a half day, the fact of the matter is that they had done so, every year, for decades.
Anyway, that's what I don't understand. Even if the law itself is dubiously written, isn't the actual power of the vice president in this situation essentially etched in stone through decades of practice? Wouldn't that be the obvious go-to when trying to make this determination?

    • @MrShanester117

You can put Trump in jail for treason, but I think what Rob's trying to say is that if he was a really sore loser with a mad lust for power then he would've declared a civil war with any of the states that didn't secede or chose to support him.

Big big hole for Destiny: success of plot depended on Pence, who has stated that he told Trump no before Jan 6, so lack of this lynchpin makes the coup/insurrection attempt claim difficult. Also, your assertion of the number of courts dismissing Trump's claims based solely on a substantive basis seems far fetched. Glenn Greenwald, a lawyer, will know this. Some courts may have commented on the strength of the Trump team's claims, but the reason the vast majority of these cases were tossed was due to procedure (standing), not substance. You need to be more exact on this.

    • @DogshitArgument
      @DogshitArgument 8 หลายเดือนก่อน +2

What you fail to realize is that the "legitimate electoral concern" is an utter falsehood and it was not ever being done through explicitly legal means of just throwing the results away and declaring Trunp the winner. That's inarguably illegal and highly immoral, the results were proven to be accurate, Trump was intensely informed on this, he did not care. He had been saying there would be interference for over 8 months before anyone sent in a single ballot. He was preparing to weaponize his people for about a year before the sixth...
There is no possible way you think that Pence throwing the results away and declaring Trump to be re-elected is a legitimate and legally sound strategy. I do not believe that you believe this. Do you think if Biden as VP in 2016 threw the results away and declared Hilary the victor, that it would've been legal or anything remotely close to legitimate???
