When the citizens are armed with knowledge, and everything's on camera, the cops chose not to break the law. They still pushed the limitations, but they eventually left. So what we need to do is arm the citizens with knowledge and cameras. Thank you for doing that, brother. Respect.
Even better, require that all police wear untamperable body cameras and microphones at all times. Whenever all the police in a department are required to wear cams and mics, use of force incidents drop through the floor. The same holds true for citizen complaints. Community relations improve, crime rates drop, and people respect the police more when their actions are recorded by objective means instead of the neverending fucking lies they write on their reports. Additionally, actual criminal offenses are prosecuted more thoroughly with fewer lenient plea bargains when DAs know they have hard, nondebatable evidence to make their case, and fewer he said/she said cases are prosecuted when the recorded facts don't line up with the skewed version of the truth that always seems to find its way onto the police reports.

Most people don't know the law when it comes to these types of encounters. The police themselves have no idea what the law is (although it is their responsibility to know) as they are incompetent at law, so let me inform you of the law. First, having an "Open Container" is not a crime. How do we know this? Because it is one of the first things that a judge will inform one about that "law" should one wish to plead guilty to that "offense". The exact words will be "This is not a crime..." Second, the government can never give people permission to commit a crime. "Open Container" can not be criminal in nature if government can make it permissible in one location today, unlawful the next, then lawful again the following day, all in the same location. People with a functioning intellect should understand this can not be a crime as a matter of law. "Open Container" is a civil infraction. Members of the NYPD have no authority to serve civil process, or initiate a civil actions. No law enforcement officer has the lawful authority to forcibly seize and search based on a hunch that someone is in possession of an open container of alcohol. The search to discover the hidden contents would be unlawful, and the contents could not be used as evidence against the subject. This goes to the integrity of the cop doing the search; the cop would have to perjure himself and say that the contents were in plain view. This tells us that these are the "Bad Cops'. This is the law in New York, it is thoroughly documented in the case law People v DeBour which makes up the law for these types of stops. If a cop has a hunch that you have an alcoholic beverage in a bag, and ask you to disclose the contents of the bag you have the right to say "Fuck Off Pig", and that cop has no lawful authority to escalate any further action against you based on his belief that you are drinking alcohol in public because of the appearance of your hidden container in a bag. This other stuff that people are saying to the contrary is simply their baseless opinion that is not grounded in any law.

No it's not. The vast majority of cops are decent and genuinely want to be of service to the community. Every time I look at a video like this I go look one up of the hero cop who tied a kids necktie for him so he would look good in court. Or the one where the cop saves the woman from the abusive husband, or the one where the cop goes out once a week to the skate park to skate with the punks, on and on. For every example of a bad cop, there's a dozen examples of good ones. What you're experiencing is called confirmation bias. You didn't like cops going in, and you watch these sorts of videos to confirm your predetermined opinion. You need to be smarter than that buddy. There's 350 odd million people in this country, you're gonna find examples of everything in a sample size that large.

I live in Nassau County which is outside of NYC. The cops here aren't that bad like the NYC. One time I was at a dui checkpoint going on the southern state, and the state troopers found out I had a joint. Long story short, they searched my car and let me go. no tickets or anything. I was pretty happy lol.

Usually there are some bums in all fields ,and they're the ones that make it bad who are doing their best to righteously do their jobs. A few of the protesters in Dallas were saved by the very cops whom they were protesting. Policing in higher crime areas is different than those where crime is not as rampant. The problem in the higher crime areas whether it's black or Latino is the cops in those areas assume first they're dealing with a bad guy. The one approached by the cop gets paranoid and anxious, and that's where these things tend to escalate. I am not naive in thinking that all cops are good, because that is not the case. I don't think all are bad, either. Society in urban areas has evolved to the point where the citizenry distrusts the cops, are angry at them, and will do everything possible to make their lives miserable. Deep seeded anger toward anyone is a poison.

When the citizens are armed with knowledge, and everything's on camera, the cops chose not to break the law. They still pushed the limitations, but they eventually left. So what we need to do is arm the citizens with knowledge and cameras. Thank you for doing that, brother. Respect.
Even better, require that all police wear untamperable body cameras and microphones at all times. Whenever all the police in a department are required to wear cams and mics, use of force incidents drop through the floor. The same holds true for citizen complaints. Community relations improve, crime rates drop, and people respect the police more when their actions are recorded by objective means instead of the neverending fucking lies they write on their reports. Most people don't know the law when it comes to these types of encounters. The police themselves have no idea what the law is (although it is their responsibility to know) as they are incompetent at law, so let me inform you of the law.
First, having an "Open Container" is not a crime. How do we know this? Because it is one of the first things that a judge will inform one about that "law" should one wish to plead guilty to that "offense". The exact words will be "This is not a crime..."
Second, the government can never give people permission to commit a crime. "Open Container" can not be criminal in nature if government can make it permissible in one location today, unlawful the next, then lawful again the following day, all in the same location. People with a functioning intellect should understand this can not be a crime as a matter of law.
"Open Container" is a civil infraction. Members of the NYPD have no authority to serve civil process, or initiate a civil actions.
No law enforcement officer has the lawful authority to forcibly seize and search based on a hunch that someone is in possession of an open container of alcohol.
The search to discover the hidden contents would be unlawful, and the contents could not be used as evidence against the subject. This goes to the integrity of the cop doing the search; the cop would have to perjure himself and say that the contents were in plain view. This tells us that these are the "Bad Cops'.
This is the law in New York, it is thoroughly documented in the case law People v DeBour which makes up the law for these types of stops.
If a cop has a hunch that you have an alcoholic beverage in a bag, and ask you to disclose the contents of the bag you have the right to say "Fuck Off Pig", and that cop has no lawful authority to escalate any further action against you based on his belief that you are drinking alcohol in public because of the appearance of your hidden container in a bag.
This other stuff that people are saying to the contrary is simply their baseless opinion that is not grounded in any law.
So, I have to find you drinking, ask you to stop, have you tell me to fuck off, then the cops have a right to help me enforce a civil infraction?

No it's not. The vast majority of cops are decent and genuinely want to be of service to the community. Every time I look at a video like this I go look one up of the hero cop who tied a kids necktie for him so he would look good in court. Or the one where the cop saves the woman from the abusive husband, or the one where the cop goes out once a week to the skate park to skate with the punks, on and on. For every example of a bad cop, there's a dozen examples of good ones. What you're experiencing is called confirmation bias. You didn't like cops going in, and you watch these sorts of videos to confirm your predetermined opinion. You need to be smarter than that buddy. There's 350 odd million people in this country, you're gonna find examples of everything in a sample size that large.
So a good cop means there’s no bad cop; or finding good cops is how you avoid addressing bad cops; are good cops the carpet that you sweep the bad cops under? What’s your point?

One time I was at a dui checkpoint going on the southern state, and the state troopers found out I had a joint. Long story short, they searched my car and let me go. no tickets or anything. I was pretty happy lol.

+Shawn Thomas I'm speaking in general terms. In a kinder society both civilians and cops would have mutual respect for another. I realize, though, such is not the case anymore, if in fact such a time ever existed. It's too bad that American blacks not only have to be suspicious of possible bad policing, but be outright hostile toward them. It doesn't make life easy for both. I understand the man drinking felt as if he were being harassed. He probably prevented anything worse from happening by being defiant and filming this incident. I would hate to life like this because it's better for all concerned if we can be kinder to one another. I don't know who the cops were serving here, but in general they're supposed to protect and serve, to be vigilant, and see if anything is wrong. Based on what the video shows, the guy was minding his own business, and the cops come to pry. Thank God things didn't escalate. What are your views?

+Shawn Thomas I don't think that's possible. That doesn't apply across the board in all aspects of life. Usually there are some bums in all fields ,and they're the ones that make it bad who are doing their best to righteously do their jobs. A few of the protesters in Dallas were saved by the very cops whom they were protesting. Policing in higher crime areas is different than those where crime is not as rampant. The problem in the higher crime areas whether it's black or Latino is the cops in those areas assume first they're dealing with a bad guy. The one approached by the cop gets paranoid and anxious, and that's where these things tend to escalate. I am not naive in thinking that all cops are good, because that is not the case. I don't think all are bad, either. Society in urban areas has evolved to the point where the citizenry distrusts the cops, are angry at them, and will do everything possible to make their lives miserable. Deep seeded anger toward anyone is a poison.

Im from Upstate NY and came across your videos. Glad to see someone finally putting these NY cops in check. I've been all over the US and in my opinion NY has the most corrupt and unlawful police forces in the US. They think they can do anything because of that badge, on or off duty. Thanks for your service man. If your ever upstate and need a back up camera let me know!
