  • The plaintiff purchased a golden retriever puppy from the defendant. The puppy got extremely ill the next day, and plaintiff ended up having to put the dog down, so she’s suing. The defendant argues she has been breeding dogs for several decades and that the dog was healthy when she sold it to the plaintiff.

      Backyard breeders now say they aren’t selling puppies, but they’re “rehoming” them and some even say “adoption only, not for sale.” It’s disgusting. Any breeding that isn’t done responsibly is disgusting.

    Three puppies got sick from the same virus. They were only in the same place to get sick, with the defendant. She's a moron.

      UM...we have no idea if it was from the same virus. Neighbour's pup lived, and wasn't tested for the virus, Plaintiff's dog died, and wasn't necropsied. It's more likely that the Plaintiff's pup had meningitis from the parasites or the injections.

    No better proof the puppy picked up the virus at the breeders house than the breeder's dead pup from the same litter.

      the first pup died of amoebaeasis and a brain disorder. It probably didn't have a virus at all. No telling what the second pup had, other than diarrhoea...they never said. The 3rd pup DID have a virus....the only one that's sure out of the 3. In med you can't assume they all had the same thing because it makes for a better show...they didn't. Cheers anyways!

      I don't think so. The parasites were being treated under a vet's supervision and various diseases can indeed cause seizures. But even if if as you suggest- pup was unfit for sale and the breeder should have jus done the right thing without a court case.

      @@kittyfan I agree, the breeder didn't know at the time of sale. That doesn't excuse her from doing the right thing once it's apparent she.sold a pup that died from a virus that came from her house.

      @@granitemoss1451 i think there's a law in one state (I'm guessing NY but it could be Conn ) that says even if the breeder didn't know, the pup has to be healthy for 30 days.....the new owner has 30 days to find out if the pup has a congenital defect. (that would take a LOT of tests!!) The plaintiff's pup didn't have a virus btw....only the defendant's pup did for sure. Giardia and coccidia are amoebas, and are easily killed with the right antibiotic (at least they USED to be killed easily with the right antibiotic....maybe they've grown resistant like bacteria do) The plaintiff's pup never had a virus..... it was euthanized because it was circling and had seizures and viruses don't do that. Amoebas can, though it would be very rare. Or maybe they picked up the pup and dropped it on it's head....who knows?? (that's the usual cause of brain injury in pups....that or running into a wall while playing) We don't really know what the neighbour's pup had...it got better. Probably coccidia and giardia, but who knows?? All the best to you and yours!!

    Breeder is insane. In this situation she should have made this right. Three puppies out of 7 sick and 2 died should've been proof enough that her litter was not healthy. She contradicted every fact.

    Editing to add that giardia is transferable to people. So these people were lucky not to catch it themselves

      Unfortunately it can’t be very easy to contract I had ever had either and my dogs were all healthy for years one time my kennel inspector brought it in after them not using bioseurirty messures. I worked for month disinfecting anything and everything back and for to the vets. I was able to quarantine and treat the puppies and dogs and got rid of it. Many vets will say it’s I pot get rid of as it sticks to clothing and will live in the ground. I did it to the best surprise. I feel bad they had a bad vet as that puppy should have been on a probiotic at the same time for treatment of 5 days and you keep the puppy bathed and the puppy should have had IV fluids it might have been saved. I feel for these people though as any loss is horrible the defendant should have refunded the money she is a horrible person and breeder. I was told that most adults dogs will be carries of the coccidia it just might not effect them. I don’t care you don’t sell a sick puppy and you know if your dogs and puppies are sick. Shut that breeder down !!

      @@CristianoGardoni yes, it is. If the mother is vaccinated and healthy, the pups will have the antibodies from nursing until they are old enough to be vaccinated themselves.
      The giardia vaccine isn't as successful sometimes, but the symptoms are glaringly obvious and should have been dealt with before the sale.
      If there is giardia in the ground, it now lives there, so you either replace the effected ground or cement over it. Simple as that.
      If you are a responsible, ethical dog breeder, this is common sense.

Puppies can be vaccinated after the eighth week, and the vaccine seems to be more effective when the puppy has already contracted the disease once, so let's say it prevents it. And as for colostrum, here too, how much milk is the mother able to provide? How many puppies are there? How many dogs are present in the breeding? As with all parasites, the higher the number of subjects, the more persistent the infection can be.

    The defendant is a completely incompetent, arrogant, self-serving liar. And because of her alledged 40 years of breeding, she knows the difference between an autopsy & a necropsy. It only took her 40 years... I'd be surprised if she's got 4 years, and she has the nerve to claim that all 3 of those sick puppies illnesses were completely unrelated, including the one that died under her care.
    She's probably had a hard time taking responsibility for any of her incompetence over the years.
    Quite a few of the female dogs that end up at the local animal shelters in my area were dumped out in the streets or nearby rural areas by breeders that didn't want them anymore. These types of people are disgusting...😤

      When I was younger we all our dogs from rescue and it didnæt cost a lot of money. Now these rescue wants a lot of money and have you sign all these regulations what you can and canæt do. Some even want to come to your home for inspection from time to time. So getting a rescue dog can cost you a lot of money. I also bought from a breeder and had no problems.

      Rescues at shelters cost more now because they come vaccinated and neutered. If the animals weren't adopted out this way the homeless pet population would be even bigger because people often won't be responsible and provide the care the animal needs once the pet leaves the shelter.

    Most great breeders ( and I mean certified breeders) will no longer let puppies before 10 or 11 weeks now. The extra time with the mom has been proven to be beneficial

    Three of the seven got sick, two died. It's absolutely something the pups picked up at the breeders place. I'd say it may have been at the purchasers if both hers and the neighbors got sick only... but one held back by the breeder also got sick and died - so definitely on the breeder.

      Why? She didn’t get them sick on purpose. She may not have taken responsibility and paid the plaintiffs for the loss of their puppy, but exactly what should happen to the defendant did happen and she was sued. Animal cruelty is purposely hurting an animal.

    I just bought a puppy before Xmas and I swear my breeder was insane too.
    My puppy had something wrong with it's ears and this lady DENIED ALL DAY LONG and days afterwards that it had nothing wrong with it.
    The vet confirmed that he had an ear infection and thankfully the whacko paid up.

    The Defendant just couldn't see past her reputation... her own "theory" shuts her down... "Can you look at me and tell if I have cancer???" Ummmm, so how could you look at the dog and tell it WASN'T sick before the Plaintiff took possession??? What a fool... Duh... And she said that the litter was amazing when 2 of the 7 puppies passed away and a third (that we know of) was also sick... I'm wondering if the other buyers were contacted to check on their puppies health or if they were even told that there might be a possibility of sickness... Sad case regardless...

      Great comeback! Wish the judge would have said that! There’s a real good chance that more puppies from that litter did get sick and she DOES know about it. The question was never specifically asked. She just volunteered that the plaintiff’s neighbor had a puppy that was fine-not bothering to tell that his puppy just happened to survive the same illness. What a hot mess she is!

    There's a thing called Incubation regarding ANY ILLNESS. Meaning the illness is building strength and does not demonstrate visible, obvious or presenting signs and symptoms. Puppy was infected at time of sale for sure

    When asked 'how many puppies were in the litter?' she replied 'about 7' what sort of insane answer is that, if she is a registered breeder she has to declare how many puppies are in the litter. The best witness against the defendant was herself admitting that 3 puppies got sick, of which 2 died. And if these puppies not only had a virus but also internal parasites, then she is not keeping her kennels clean. I hope she was reported after this and her animals taken away...

    My 2 dogs got giardia 2 or 3 times from doggy daycare. The vet said it’s a virus that lives in water and it’s from not changing the water. So I took them out and had to keep them home. The doggy day care guy said it’s just like a daycare for kids. They get sick. So. Never again. At any dog daycare.

    That pup absolutely got the giardia from the breeders home, once it's in the ground and on surfaces in an area, every puppy born there will end up with it. It is easily treatable and a "breeder of 40 years" would know this and start treating all pups for it at 6 weeks old.
    She sounds like a kook.
    If she were a reputable breeder there would have been a written and signed contract that stated she would take the puppy back at any time in its life, replaced that puppy or give the BUYER (she didn't "adopt" shit) her money back, no reputable breeder would have flipped the blame and told the buyer tough shit - never buy a puppy from a breeder who doesn't clearly state in writing that they will take the puppy back at any time in its life, no questions asked - that is what good breeders do, this woman is a back yard greeder.

    The only reason I recommend buying from a breeder is with a rescue you have NO idea it's prior health history or how the people before you treated the dog and what it's bad behaviors might be. It's rare to be able to rescue a puppy to begin with, it's usually a more mature dog with problems or he/she wouldn't be a rescue to begin with.

    Ugh…..that puppy did not die from Giardia and Coccidia overload from only having it since it went home with the buyer. She may not have realized before she sold them, but it’s still on her. A good breeder would have had them vet approved and tested for everything before they went home. Also, these live in the soil and if not properly treated she will continue to have sick litters. Back yard breeders do not care about that part.
