The 14th AMENDMENT wasn't written because of the WONG CASE in 1898. It was written after THE CIVIL WAR and was ratified in 1868 to extend citizenship to FREED SLAVES and THEIR CHILDREN.. It says that “a]ll persons born or naturalized in the United States and subject to the jurisdiction thereof” are citizens. Wong's parents were Permanent Residences when Wong was born, therefore he and they were subject to the JURISDICTION of The United States. Why should the parents' citizenship be enough? They should be on a provisional residency until they can earn green card and naturalization when they are older.
Basically, we are. Those MAGA haters are trying to use Amendments from a long time ago to target women and Migrants. The Trump Bibles included our Constitution in it and Amendments 11 - 27 are conveniently missing. So, they want to erase progress made in the last 150 years. White women got the right to vote in 1920. The rest of people of color didn't get that right to vote until 1965. Amendment 20 is the Women's right to vote in 1920.
The 14th Amendment does not state that every baby born in the United States automatically becomes a citizen. The amendment specifies that citizenship is granted to "all persons born or naturalized in the United States, AND SUBJECT TO THE JURISDICTION THEREOF." This means that mere birth on U.S. soil is not enough; the individual must also be "SUBJECT TO THE JURISDICTION" of the United States. This clause has historically been interpreted to exclude certain groups, such as children of foreign diplomats, enemy occupiers, or those not legally subject to U.S. law. Therefore, the 14th Amendment's language establishes conditions for citizenship beyond just the location of birth.
The Pilgrims never arrived demanding sustenance, housing and cash cards from the Native Americans, sweetie. There is a great difference between those who built the country and these destroying it
The Constitution was drafted in a different era, long before mass immigration, air travel, and the current complexities of global mobility. It's important to consider how these changes impact our understanding of immigration policies and their potential impact on society.
People need to stop making assumptions regarding Section 1 of the 14th Amendment, it deals with the actual Supreme Court Dredd Scot v Sanford 1857 decision. 1. "Persons of African decent cannot be and WERE NEVER INTENDED to be Citizens under the U.S Constitution. Plaintiff is without standing to file a lawsuit." 2. "The Property Clause is applicable only to lands possessed at the time of the Constitutions ratification (1857) As such, Congress cannot ban Slavery in the Terittories. The Missouri Compromise is unconstitutional." 3. The Due Process Clause in the 5th Amendment prohibits the Federal Government from freeing slaves brought into Federal Terittories. Section 1 had absolutely NOTHING to do with former Slaves, it was because of the color of their skin. That's the actual reason that Section of Section 1 of the 14th Amendment exists, to kick them in their #$$ and throw it. The ONLY way to guaranteet that they would not attempt to do it again on people from a different continent, was to make it apply to any person born within the borders this Country.

Listening to Ms McBean is like being in class. That said i think he will overplay his hand and the same 45% hispanic and asian vote he managed this time will swing right back to the DEM party in only 2 years. Just my take.
The majority of the Asian votes went to Harris. The majority of Trump's votes came from white men and white women. As an Asian voter, I have always voted for Democratic presidents. I vote based on qualifications and work experience. They are generally Democrats.
If you are not a Native American your history in this country most likely began with birthright citizenship. Make it retroactive then, let's return the country to its rightful owners then... right?

I don't think he will take away the citizenship for those who were already born and given citizenship but will discontinue for new births. Foreigners coming to give birth does have an overwhelming stress on healthcare since tax papers pay for their healthcare costs. So many Chinese come to Garfield medical center in La to have babies. They are packed by 50 people who live in a 4-5 bedroom houses in the area and have baby and leave.

You’re number 1 on TH-cam on everything relating to immigration, thank you. However, you wouldn’t be addressing this subject if lame duck Biden had done his job correctly as it relates to immigration. Harris had no chance because of their own collective inefficiencies.
Biden pulled us out of a Trump mismanaged pandemic and a crashed economy. Biden has passed many bills to help the poor and created a lot of jobs from his Infrastructure Bill. He also had Senate Dems work on a Bipartisan Border bill that two very Conservatives helped to draft. That was in Dec. 2023. In March 2024, both sides were going to sign it. Trump called Mitch McConnell in the Senate and House speaker Mike Johnson to kill the bill so he could have something to run on. Then Biden passed a Border Bill through Executive Order yet the propaganda machine was so loud that nobody heard about the truth of this situation. We have less border crossings now than when Trump was in office.
I have a question. I filed for adjustment of status because I got married. This was in June 2024, and the initial estimate was to receive the work permit and Social Security by December. Today, I checked, and it was pushed back by another 4 months. The green card, which was supposed to be issued in 10 months, has now been extended to 24 months. What is going on?
It is about eight month for you to get your work permit and social security card then the interview for your two years unconditional green card then after two years is up you applied to remove unconditional and then the ten years green card you should get it in eighteen months every one situation is different.

The amendment specifies that citizenship is granted to "all persons born or naturalized in the United States, AND SUBJECT TO THE JURISDICTION THEREOF."
This means that mere birth on U.S. soil is not enough; the individual must also be "SUBJECT TO THE JURISDICTION" of the United States.
This clause has historically been interpreted to exclude certain groups, such as children of foreign diplomats, enemy occupiers, or those not legally subject to U.S. law. Therefore, the 14th Amendment's language establishes conditions for citizenship beyond just the location of birth.
Thank you for the informative video!!
Wonder if the Pilgrims came here legally.
Stop with your nonsense.
If there were an established country, the yes. But since there wasn't, that isn't just a dumb comment.
You know they didn't and I don't hear anyone challenging them.... that's a good one though 🤣🤣🤣🤣🤣😭😭 👀
Hello first time lister from California
Trump as pretty much brain-washed his followers into thinking he can move mountains😂😂😂they believe anything
Exactly 💯
The truth is that law was only INTENDED for American Descendants of Chattel Slavery. If we back him it will happen swiftly. I’m just saying 🤔..
😂😂😂
Have you heard of an executive order?
@@RenardGarzarohave you heard of the constitution. 😂 Executive orders can be overridden by the courts and congress.
So what?
People need to stop making assumptions regarding Section 1 of the 14th Amendment, it deals with the actual Supreme Court Dredd Scot v Sanford 1857 decision.
1. "Persons of African decent cannot be and WERE NEVER INTENDED to be Citizens under the U.S Constitution. Plaintiff is without standing to file a lawsuit."
2. "The Property Clause is applicable only to lands possessed at the time of the Constitutions ratification (1857)
As such, Congress cannot ban Slavery in the Terittories. The Missouri Compromise is unconstitutional."
What about him , his parents was immigrant , that's mean he should remove himself as the president . The country you're born that's where you from .
Wait didn’t he say “ going forward “
But he can do what he wants
Just like Biden. This would hardly be an issue if old Joe hadn’t opened the gates of he11 .
Yall making America seem like some type of promise land. Worked hard came here, worked double hard again, I went back home so fast. Can't understand why immigrants would sacrifice their life and pride to go to America. Grass is greener where you water it.
Listening to Ms McBean is like being in class. She’s not only beautiful and eloquent, but a source of good info., as well. i don’t think Trump will manage to end birthright citizenship given it is in the constitution, not even through the courts.
You mean that Ted Cruz might not be a US citizen if Trump gets this change? 😂😂😂
Tuned in from Toronto of Guyanese origin
Yes end birth citizenship rights
If you are not a Native American your history in this country most likely began with birthright citizenship. Make it retroactive then, let's return the country to its rightful owners then... right?
From Juarez, Mexico. Waiting for my waivers to be approved. I have been waiting for 2 years already. But every months processing time keeps increasing from 17 months 2 years after is at 31 months😮💨if this keep moving, when would I get close to date to send an inquiry 🤦🏽♀️
So if a child born there what is the Child birth place status
Trump doesn't have to get rid of 14th. All he has to do is not issuing passport to the women who is pregnant and mandated it before giving passport.
But trump him self wouldn’t be American if these rights had existed already.
Exactly!! His mom was an immigrant from Scotland.
Thank you for this video. If Trump succeeded with the birth right citizenship, is it going to affect children born from 2025 and the future only or will it affect young adults too?
All the Supreme Court has to do is clarify the 14 amendment to determined if it applies to illegal aliens and their American born babies. Back in the 19 century America didn’t have and illegal alien problem.
What ur saying is hopefully supreme court can be bias take old white guys wishes side hello constitution simple Grammer. English class. All person born are citizens of the united states ...simple English. If u don't know Grammer them u think executive order has no power on birth right zero. Fact he saying that ya entertain it. Is hilarious .....
Only the court can change it
There where no problem because almost everyone had illegal parents but the Native American.
Donald Trump want the Supreme Court to address Birth Right Citizenship that’s why he’s issuing an executive order to implement it he knows it will get disputed by the left and approve by the majority of the conservative justices on the Supreme Court
...and you got your law degree from where?
What should adults grown up here is it retroactive
I am Puerto Rican and born in N. Y. C. NY. My mother was also born here my father was born in San Juan PR. I am a retired veteran with 25.5 years of service and also retired from the federal government with 19.5 years of service. And you can’t retire from the military without being a U.S. citizen. My question is will I get deported? I may know the answer to this but there is a lot of uncertainty going around. I preached that this day would come when Trump was elected the first time many laughed at me. Well reality is here. And I know that when the time comes I will be stopped and have to explain myself.
Yes, you get deported because you don't know that PR is US Territory! 😂😂😂😂
Puerto Ricans are legal American citizens.
He cannot. But he can force it to the Supreme Court who can interpret the amendment in a way that favors trumps view. Which is likely
Let's see, Barron is a birthright citizen, right?
Barron is legal
Thank you for the clarification 🙏👍🌟
You are so welcome
No, he can’t. He need to do an amendment to the constitution.
The thing is that usa is not the kost powerful passport or citizenship anymore 😢so he can keep it all. Ppl are moving out of the USA
Don't worry, some of them will regret it
@nadinelouis6210 yup
Yup! They don't regret it. They are glad that they don't have to live in a fascist dictatorship if he gets inaugurated in January.
As long as the parents are illegal yes, he can boot them out had is correct
OUR GREAT GRAND PARENTS DIDNT HAVE WELFARE❤
Oh yes, they certainly did. For example between 1862 and 1934 the federal government gave away millions of acres to white farmers all over the country.
Unless they were here when FDR was President. Before that? The elderly and the poor died. They didn't have any safety nets. That's how FDR grew our middle class. Gave GI bills to soldiers that came home from the war. Unfortunately, Blacks, Asians, and Native Americans were not given to them so that's why there is such a great gap in-between the races in the '50's.
The House and Senate is going to be overwhelmingly Republican under Trump, he can get them on board with this!
What about the states?
@McBeanImmigrationLaw But aren't immigration laws primarily a federal issue- I never understood this well, how cities have the right to decide to be sanctuary cities or not, and various states enforce border policies differently - aren't immigration laws on the federal level?
@@963ag More info on this would be cool to explore
The U.S. Senate is nowhere near overwhelmingly Republican. Republicans would need a filibuster proof majority, which requires 60 votes in the Senate. Currently, the Republicans only have a 53 seat majority. I’m always amazed how many people forget about that with the U.S. Senate. They would also need 3/4ths of the states to ratify the Constitution.
@@blongshanks77I think they can do it

What about US citizen kid born another country?
It precludes them because they are not targeting those kids. They are targeting people of color.
If parents are US citizens, the kid is too.
He cant end that without a change to the 14th amendment. Good luck with that.
75 percent of people that is having babies that is coming from another country. Doing this on purpose they have agents help them with these processes. Slavery and people that trying to take advantage of the system is a little bit different. So what county was the slaves going to.
Including Baron Trump. He is a birthright citizen.
@joycelynseetaram3731 BaronTrump is not a birthright citizenship . His father is American citizens who was born in America. His father Donald Trump is a legal born American citizens therefore Baron Trump is a legal American citizens. His Ancestors who migrated in America came to America legally, they did it by the law of America.
Yeah from Germany , Scott land and Latvia, Trump and baron are original birth rights citizens.

*FACTS ON THE BIRTHRIGHT CITIZENSHIP NOT THE WOKES TRUTHS*
Fourteenth Amendment of the US Constitution states -
All persons born or naturalized in the US, and subject to the Jurisdiction thereof, are citizens of the US and the State wherein they reside.
1.) *and subject to the Jurisdiction thereof* - They not legally in the Jurisdiction therefore they are subject to it.
2.) *Wherein they reside* - They are not legal and do not have legal right to reside in the USA.
TRUMP to MAGA-A
@mcbeanimmogrationlaw are undocumented people domiciled in the US? Is someone on a visitors visa domiciled in the US?
Yes! He can do that! Mistaken!
I don’t think the language in any case or amendment extends constitutional rights to the globe 🌍
Each country has their own form of the Constitution. Ours has the 14th Amendment.
@@Wynn-fr6ozit does , are you entitled to another country’s constitutional rights . If you travelled to Jamaica would get the same rights and privileges as the Jamaican citizens ?
Courts cannot interpret it differently .nonsense
Remember roe v wade think people
@MrJk321 Roe was not written into the Constitution so that's why they asked each Justices if they were going to leave it alone. During their confirmation hearing, Kavannaugh, Gorsuch and Coney-Barret all said they were not going to touch it. Well, they lied. Now that we know better than to trust any MAGA or Republicans, if we ever have the chance to vote again, we will codify Roe v Wade. Millions of women will die meanwhile under this evil regime. Our mothers and grandmothers had more reproductive rights then the child bearing women of today.

Pure evil 😈
Evil is sneaking into a country and faking ID's and lying.
No its not. Its evil that these people break the law to anchor their babies in our country!
Does this mean parents have to show proof of citizenship at the hospital before the birth of their child or will the birth certificate state non citizens on it? This is just ridiculous
It’s unconstitutional. Executive order shouldn’t be enough.
Like she said, Anyone born on US soil automatically becomes a citizen.
Hope so

Huh?😂
no more welfare get rid of welfare state they will leave.
He can do it and lawsuit can be filed.
Elk v Wilkins look it up. SCOTUS ruling. That's what Yrump wants done.
Most time we talk about laws we do not speak of the origin of the law. The 14th amendment was based on the children of slavery!. An American can have a child anywhere in the world and the child will be America. I this Congress can pass a law not giving illegals and visitors children who are born here citizenship. In the case of the Chinese that was discrimination since it was based on a group of people and not all children of illegals and visitors. I believe birth right citizenship will end because it makes no sense. No one is saying people with green card and naturalized citizens, children shouldn't be citizens. It's illegals alien and birth tourism.
Yes he can 👍
Trump think he is a God
Immigrants whether illegal or LEGAL think they can sneak into the United States committ all kinds of heinous crimes and believe they're entitled to get away with all their heinous crimes.
Thats the ultimate in thinking you're "God"
God is working through him to save our country
@johnson2191cj Yeah, ok 😂
@@johnson2191cj Stop blaspheming. God does not support hate. Do you know what God says about how we treat foreigners? You are blasphemer. Be careful!
Blaspheme nothing! The Bible says to obey the law of the lands.
Should be ended! At least one parent must be a US citizen. Preferrably the mother, as it is an easy to prove fact.
What is going on?
bro,
change the username
A lot of people get married for reasons to stay. Sometimes they are paying for a marriage. The government is always waiting to give out green cards
It is about eight month for you to get your work permit and social security card then the interview for your
two years unconditional green card then after two years is up you applied to remove unconditional and then the ten years green card you should get it in eighteen months every one situation is different.
Backlog, may be!
@@pedro1234567ify Why? If the US becomes a country where people can’t even ask about legal actions, I’m the one who won’t want to stay here anymore. I have nothing to hide.

even if it goes before the court some one who it effects would have to challenge it. The term subject to the jurisdictions there of can also be challenged
Oh, I’m sure Everyone will challenge it.
@JohnDoe-qz1ql executive orders are powerful. The 13th amendment is an executive order
@JohnDoe-qz1ql even if they challenge birth right DACA has its own issues. People who came here as children still have to settle their own issues in the country of their origin. Can a Mexican surrendered their citizenship? It sounds messy
I really wonder if people know the laws. I've been reading some info and it appears that those DACA folks are going to have a hard time on the Mexican end. If you came to the US as a child from Mexico you still have a Mexican birth certificate/Citizenship. From what I've been reading a Mexican can't really renounce their Mexican Citizenship. You guys need to know what you're getting yourselves into
@sionrouge1697 How are the DACA adults settle with the country of their parent's when they have never been to that country?
He also said that for birth right citizenship requires that at least one of the parents should be a citizen of USA.
