      The 14th AMENDMENT wasn't written because of the WONG CASE in 1898. It was written after THE CIVIL WAR and was ratified in 1868 to extend citizenship to FREED SLAVES and THEIR CHILDREN.. It says that “a]ll persons born or naturalized in the United States and subject to the jurisdiction thereof” are citizens. Wong's parents were Permanent Residences when Wong was born, therefore he and they were subject to the JURISDICTION of The United States. How does that apply to the children of two ILLEGAL CITIZENS who have a child? I think they may be right, the COURT'S interpretation can be challenged. So how would they defend this if Trump go forth?

      She's outside of the constitution. I didn't expect to get an answer. U.S. CITIZENS especially Black Americans are going to end up suing and winning, because of Biden Administration Policies that caused deliberate adverse discrimination and harm to Black American communities all over the U.S.! We are not immigrants. Black Immigrants are also COSPLAYING, PRETENDING TO BE AND SPEAK AS BLACK AMERICANS and stripping the Black American communities of resources and their tax dollars pay for. Black Americans have NEVER SUPPORTED Illegal Immigration. This is why they have left the democratic party at a 35% level. So who are the LEGAL people filling that void. Now these BLUE STATES are using TAXPAYER MONEY to pay for attorneys for Illegal Immigrants. That's another violation of the laws.

      The point is, that the child who was born in the USA was not in the country illegally. We can debate if birthright citizenship is good or bad, but it has nothing to do with "people that came here illegally". It's curious that the same people who say that fetuses are human and should have all the basic human rights are trying to say that fetuses committed a crime by existing and should be deprived of basic human rights. Be consistent.

    A lot of people who are pregnant are coming to the USA to get the baby. Once the child is born they are waiting for the passport. They leave and come back with the child when the child is eightteen years old . They do this every time they get pregnant.Sometimes they come to the USA to get pregnant and are waiting for the child to be born . They are getting all government benefits when they are pregnant. Sometimes the government pays for the hospital bills

      I’m from the Dominican Republic and I know so many Dominicans who have done this to get their children to be US citizens. They have tourist visa come to the states in the last month of the pregnancy just to have their children born here so they can be US citizens. In my country citizenship is through the blood if you are illegal in the country your children are not Dominican citizens. We have taken so much heat from UN for this because they are an increase number of Haitians giving birth in our country and their children by the constitution are not Dominican. Nobody can force another country to carry with other’s countries problems neither to abuse the system

By the time all states are prepared to vote on it and get through the process, working class Americans will be in such dire straits after trump and his billionaire buddies pilfer the country, most will be to busy trying to pay bills, not get their homes foreclosed on or being evicted and trying to eat!

    If one of the parent is American citizen yes , the child has the birthright to be a American citizen, but if neither one of the parents are American citizens, then the child should not be considered American citizens, just because the child was born in America.

      There are app. 350 Million LEGAL crossings of the US v Mexico border per year.

    I personally can tell you a story I was working at a major hospital in Georgia in Atlanta Wayback in 2010 I was working in ICU had a lady at that time she was about 29 years old flew all the way from Nigeria nine months pregnant Started having a major crunch contractions when she landed. Had the baby at the hospital. The baby automatically became a US citizen. She ended admitting to the doctors how she was allowed to fly on the airplane at nine months pregnant and she only travel to the US so her baby can be a US citizen. She admitted that after delivering birth, and this is not an isolated situation, those of us who work in the hospital see this every day and this is the reason why birth citizenship is in danger of being removed, not completely, but because of these type of scenarios

    The U.S. Constitution's 14th Amendment states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States."     Deport....Let them choose their country at 18 and have a 3 yr sponsor to age 21? If they choose USA- they must have studied and learned ENGLISH: have a job: paid taxes: have health & auto insurance AND they CANNOT bring in relatives until age 25. They must support their family member they bring: no public assistance.

      The 14th Ammendment was interpreted to exclude Native Americans and was rectified with the 1924 Indian Citizenship Act which is based on Birthright Citizenship.

    If they were to go the original intent route at the Supreme Court, they could say the 14th amendment birthright citizenship clause applied to the formerly enslaved since they were considered property prior to the Civil War and it clarifies their status afterwards (Section 2.of the 14th amendment in effect does away with the three-fifths rule)The 13th,14th, and 15th were all Reconstruction Era amendments

      Basically, we are. Those MAGA haters are trying to use Amendments from a long time ago to target women and Migrants. The Trump Bibles included our Constitution in it and Amendments 11 - 27 are conveniently missing. So, they want to erase progress made in the last 150 years. White women got the right to vote in 1920. The rest of people of color didn't get that right to vote until 1965. Amendment 20 is the Women's right to vote in 1920.

    The 14th Amendment does not state that every baby born in the United States automatically becomes a citizen.
    The amendment specifies that citizenship is granted to "all persons born or naturalized in the United States, AND SUBJECT TO THE JURISDICTION THEREOF."
    This means that mere birth on U.S. soil is not enough; the individual must also be "SUBJECT TO THE JURISDICTION" of the United States.
    This clause has historically been interpreted to exclude certain groups, such as children of foreign diplomats, enemy occupiers, or those not legally subject to U.S. law. Therefore, the 14th Amendment's language establishes conditions for citizenship beyond just the location of birth.

    People need to stop making assumptions regarding Section 1 of the 14th Amendment, it deals with the actual Supreme Court Dredd Scot v Sanford 1857 decision.
    1. "Persons of African decent cannot be and WERE NEVER INTENDED to be Citizens under the U.S Constitution. Plaintiff is without standing to file a lawsuit."
    2. "The Property Clause is applicable only to lands possessed at the time of the Constitutions ratification (1857)
    As such, Congress cannot ban Slavery in the Terittories.The Missouri Compromise is unconstitutional."
    3. The Due Process Clause in the 5th Amendment prohibits the Federal Government from freeing slaves brought into Federal Terittories.
    Section 1 had absolutely NOTHING to do with former Slaves, it was because of the color of their skin.
    That's the actual reason that Section of Section 1 of the 14th Amendment exists, to kick them in their #$$ and throw it.
    The ONLY way to guaranteet that they would not attempt to do it again on people from a different continent, was to make it apply to any person born within the borders this Country.

That said i think he will overplay his hand and the same 45% hispanic and asian vote he managed this time will swing right back to the DEM party in only 2 years. Just my take.

      The majority of the Asian votes went to Harris. The majority of Trump's votes came from white men and white women. As an Asian voter, I have always voted for Democratic presidents. I vote based on qualifications and work experience. They are generally Democrats.

    I don't think he will take away the citizenship for those who were already born and given citizenship but will discontinue for new births.     I am Puerto Rican and born in N. Y. C. NY. My mother was also born here my father was born in San Juan PR. I am a retired veteran with 25.5 years of service and also retired from the federal government with 19.5 years of service. And you can’t retire from the military without being a U.S. citizen. My question is will I get deported? I may know the answer to this but there is a lot of uncertainty going around.       The U.S. Senate is nowhere near overwhelmingly Republican. Republicans would need a filibuster proof majority, which requires 60 votes in the Senate. Currently, the Republicans only have a 53 seat majority. I’m always amazed how many people forget about that with the U.S. Senate. They would also need 3/4ths of the states to ratify the Constitution.

An American can have a child anywhere in the world and the child will be America. I this Congress can pass a law not giving illegals and visitors children who are born here citizenship.       Biden pulled us out of a Trump mismanaged pandemic and a crashed economy. Biden has passed many bills to help the poor and created a lot of jobs from his Infrastructure Bill. He also had Senate Dems work on a Bipartisan Border bill that two very Conservatives helped to draft. That was in Dec. 2023. In March 2024, both sides were going to sign it. Trump called Mitch McConnell in the Senate and House speaker Mike Johnson to kill the bill so he could have something to run on. Then Biden passed a Border Bill through Executive Order yet the propaganda machine was so loud that nobody heard about the truth of this situation.
