It's apparently passed the House and is headed to the Senate. I work in the court system as a Certified Spanish interpreter and the lawyers I work with are just getting continuances for their cases to wait and see what happens with this law.

I think there needs to be a change to our “birthright citizenship”. There are people who come here specifically to have their children get US citizenship. A system more like that in the UK is probably what we need to adopt. For foreigners who give birth there, citizenship is given to the child only if the parents are “settled” at the time of birth. That means that they have permanent housing, and at least one parent is legally working (studying?) or has the “right to remain”. This makes far more sense than some of the birth tourism we currently have.

We have to remember that Federalist Society judges are activist judges and good Republicans, too. If they want to reinterpret the language -- calling it originalism -- they will do it if it fits their agenda and within their moral and ethical framework which isn't a very good one, to say the least. Look at what they did with presidential immunity. Further, there is a Southern flavor to the Federalist Society so there might be a larger reason to reinterpret the 14 Amendment to fit into their longer-term agenda like the Red States not providing education or vouchers for temporary resident workers or in the case of the Christian nationalist judge's values to deny citizenship to non-citizen US soldiers, their wives, and families to denying things like social security benefits to green card holders or habeas corpus protection. It was religious people and judges who went along with the Third Reich in the 1930s.

My country stopped birthright citizenship at the same time it made work visas for seasonal workers (people to harvest crops). That seems sensible. Then your immigration is people you decide, not low skill labourers who happen to have a baby with a local while working.
There are also people who would like not be under that rule. I have a colleague who was born in the US but with German parents. He lives and works in Germany but still has all the hassle with US tax so that it is very difficult for him to get an account because banks don't want to mess with the US taxes. But getting rid of this citizenship is costly and cumbersome. I (non US) see that, too. With nearly all bank documents I have to sign that I'm not American and don't fall under their taxes.

If Switerland holds that a person can claim Swiss citizenship by virtue of having been born to Swiss nationals, and if your parents hadn't yet applied for US citizenship at the time of your birth, the answer might be "yes". There may also be an age limit before which one needs to apply.

the fact is without birthright citizenship, how do you prove you are a citizen? being born here doesn't prove anything. Now do you have to prove your parents were born here? What if they weren't? Do you have to prove they immigrated legally, in 1940? This idea is almost entirely unworkable.

I think there needs to be a change to our “birthright citizenship”. There are people who come here specifically to have their children get US citizenship. A system more like that in the UK is probably what we need to adopt. For foreigners who give birth there, citizenship is given to the child only if the parents are “settled” at the time of birth. That means that they have permanent housing, and at least one parent is legally working (studying?) or has the “right to remain”. This makes far more sense than some of the birth tourism we currently have.
Better solution. Ban dual citizenship. Why does all of cingress have two citizenship but it’s illegal for regular people

It appears that this would create a category of "stateless" people. I believe it would be up to one or both parents to actually register their child's birth at the embassy or consulate of the country in which they hold nationality. But what if they don't do that ?
What nationality would the child have ? Cuba for one is not even taking back its own citizens who've fled abroad not to mention any child born abroad. This is truly insane and illegal.

We have to remember that Federalist Society judges are activist judges and good Republicans, too. If they want to reinterpret the language -- calling it originalism -- they will do it if it fits their agenda and within their moral and ethical framework which isn't a very good one, to say the least. Look at what they did with presidential immunity. Further, there is a Southern flavor to the Federalist Society so there might be a larger reason to reinterpret the 14 Amendment to fit into their longer-term agenda like the Red States not providing education or vouchers for temporary resident workers or in the case of the Christian nationalist judge's values to deny citizenship to non-citizen US soldiers, their wives, and families to denying things like social security benefits to green card holders or habeas corpus protection. It was religious people and judges who went along with the Third Reich in the 1930s.

Aside from the possibility of trying to bring this issues to the Supreme Court’s adjudication of those children’s citizenship; we also need to have a full accountability of the children that were taken out of the arms of the parents that were sent out away, or into this Nation’s arms and disappeared as far as the National events are concerned!
All of those children need to be brought to justice at the Supreme Court’s processes and adjudicated for their rights and freedoms to be respected!
Aside from the aforementioned issue, the 14th amendment Section 3 , must be enforced just as the forefathers of this Nation intended!
Aside from the fact that they have been violated or protected they are to be considered Americans since this is the Nation, if still viable, regardless of the status at the entry of their parents, this is the only nation those children are cognizant of belonging!
We are not in Russia or any other nation that have horrible practices, where their identities are obliterated, we are better than that as Americans!

There are also people who would like not be under that rule. I have a colleague who was born in the US but with German parents. He lives and works in Germany but still has all the hassle with US tax so that it is very difficult for him to get an account because banks don't want to mess with the US taxes. But getting rid of this citizenship is costly and cumbersome.
I (non US) see that, too. With nearly all bank documents I have to sign that I'm not American and don't fall under their taxes.
If one is not subject to the US jurisdiction, then one cannot be pronounced to be "illegal" by that entity.

It is a complicated legal issue. It all depends on how the Supreme Court defines the phrase " and subject of the jurisdiction thereof". Currently , the children of foreign ambassadors and diplomats do get birthright citizen if they are born in the USA.
