He was already dead when she walked in. She wouldn't have a clear view of him where she was standing. The chairs and tables would be obstructing her view. She just saw Raylan hoslstering his gun after winning a gun draw.

I've always had this question. One shot should have taken him down, Three shots would actually require an investigation if this was a real scenario.
Every incident requires investigation, he could have plugged him with every round in his mag and he'd still come out clean.
