  • Kettering Foundation Senior Fellows Neal Katyal and J. Michael Luttig spoke with Kettering chief external affairs officer and director of DC operations Brad Rourke about the landmark ruling by the Supreme Court on presidential immunity in Trump v. United States. This decision redefines our constitutional structure and raises profound questions about the balance of power in our democracy.

If trump is the only person in America who the supremes made immune to criminal prosecution, but everyone around him, working for him, or associated with him is not immune from prosecution of crimes…then does that mean if trump as president orders anyone around or under him to help him do something criminal for which they can be held accountable, does that give anyone not named trump the ability to refuse the orders of the “commander in chief”? And does that not render him useless? Can prosecutors right now go after everyone involved in trumps current criminal indictments?

Let them be properly shamed in front of the American public for what they have now unleashed on the country. And the next step should be that judges who respect the law around the country should get together and state that they will no longer heed what this SC says but will only obey appeal courts as their highest authority. Agreed. My view is round them all up and charge and jail them now. If that doesn't happen now it will happen in reverse in January, under Trump (What does anyone think will happen to Jack Smith, Garland, Cheney, Pelosi, Clinton, Katyal, Luttig, Milley, MSNBC, the Times etc etc?) And the US will be gone.
An immoral act can be moral, such as killing enemy soldiers in war, assassinating Hitler, etc. The moral difference in this case is whether to save America or destroy it. Refusing to act appropriately is understandable but is, in fact, cowardice and betrayal. Refusing to act is to betray the Constitution - action is justified because its intent is to defend the constitution - from domestic enemies.

The SC (Supreme Court) decision to grant a president absolute immunity for official actions and presumed immunity out to the perimeter of their power is, of itself, a violation of our constitution.
    1. There is nothing in our constitution granting a president immunity from criminal prosecution - "no man is above the law"
    2. This SC ruled that a president enjoys absolute immunity for official acts, etc., and in doing so amended the constitution. They wrote a new protection into the constitution that was not there at all beforehand.
    3. Only Congress has the authority to amend the constitution
    4. Therefore, the ruling by the SC is itself un-constitution and must be retracted

Excellent discussion! Thank you Neil Katyal & Judge Littig for your service to our nation, and for your expert opinions in this critical ruling by Supreme Court.

Another know-nothing - man alive - ZERO critical thinking skills and reading needed to understand the topic. Pathetic.

Recent SC rulings seem to dovetail nicely into supporting project 2025, like they are aware of it and easing its path. Except for the gifts to the SC are ok ruling, that appears greedy

They were picked by the Federalist Society and are following the Heritage Foundation playbook.

Katyal said the Supreme Court is out of step with main stream society, but how much is it out of step with the other courts and their judges throughout the country? Is there corruption at other courts at state level that has not yet come to our attention?

Of course there is. There's corruption everywhere you find money and power, on scales big and small, in big bureaucracies and small companies, and among famous people and common people.

I don’t know the answer to your question, but I note that all other federal judges are subject to ethical rules- only SCOTUS of all federal courts has no enforceable ethics code.

We only need observe previous (federalist) court decisions that have ruled
      - in favor of air and water polluters
      - against citizen's rights

Of course. Trump put in over 250 judges during his tenure.

Dred Scott is a parlor game compared to Trump v. United States. I've got to ask you, Neal, how could you possibly have ANY respect for Roberts, never mind "a great deal of respect" for him? He plainly lied during his confirmation when he stated under oath that "no man is above the law, not even the president." He also lied about precedent, he lied about judicial restraint, and he lied with that BS "I'm just an umpire." Judge Luttig is right, the decision is unconstitutional. Not even mentioned is the fact that by this ruling, the Supreme Court has invalidated the impeachment clause. They have just immunized the president of the United States against "treason, bribery, or other high crimes and misdemeanors."

Does SCOTUS has immunity on corruption charges?
