    Thank you so much sir. if there is no lower-tds-certificate then we will be paying for whole amount. still we hv to use 195 section or its direct challan 281?

      Hi there, if there is no lower-TDS-certificate, you will have to deduct the TDS at the rates specified and pay it. Your transaction still falls under section 195, as it deals with TDS on Non-residential payments. Challan 281 is used for depositing TDS. I hope this helps!     a buyer is purchasing a property from coowners- equally shared(1 is a NRI and other s resident)on 5th oct, total sale vale is 72lac, whether surchase applies? when to pay tds and when to file to file tds return? how much TDS required to be deducted

      The Surcharge is not applicable in your case. For the purchase of the property, TDS is to be deducted at the rate of 1% if the seller is a Resident. However, since one of the sellers is an NRI, TDS would be deducted at rates varying from 20%-30% depending on the period of holding the property. The TDS deducted must be paid within 30 days from the end of the month in which TDS is deducted. You need to file TDS return in Form 26QB within 30 days from the end of the month in which TDS is deducted.     i am an NRI seller whose buyer is not cooperating and may not file the 27Q form. He says that I should get a CA since it's my (seller's) money on the line. What are the legal ramifications of not filling out 27Q? I want to share those with my counterparty.

    Hi, if there are two owners (out of which one is the co-owner) and the property belongs to an NRI. In this case, is it mandatory for both the two co-owners to have the TAN or if owner has it and he makes the payment, it will suffice.

    One of my friend is going to buy a property from a NRI... Registry will be on 4th of April, but someone guided him that he should paid the tds amount to the department before registry as it's mandatory to attach a document of payment at the time of registry.... It it right? I don't think so and as per your video as well, it's incorrect as required to pay tds within 30 days of registry. Please guide

      Challan number is required in Sale deed.

      Yes, for buying property from an NRI, you need to file Form 15CA and obtain Form 15CB from a chartered accountant before making the TDS payment.

      @@taxajca i consulted with a ca, the nri seller has nro account. Bank did not ask for 15ca/cb and ca also said 15ca/cb won't be required. Payment is done, is it correct?

    I have paid my 1st installment on 23rd November 2023 and 2nd installment on 25th January 2024. I have yet not paid any TDS. Now can I pay TDS witout penalty. I have read that it is mandatory within 30 days after the end of month in which payment is done , there is penalty of Rs. 200 daily. Please clarify it.

    If a person deduct and pay TDS in a particular month eg. July. Then can he file 27Q before 1st October? What is the minimum no. of working days required between tds deposit and filing of 27Q?

    Sir, 6 sellers me se 1 seller 2021 me Dubai gya and ab NRI hai toh buyer ko 38lac ki deal me uske hisse k amount me se kitna percent TDS deduct karwana hoga... 1% ya phir 20%

    Sir property sale value is 1.2 Cr from nri, if 2 buyers jointly purchasing it, then individual buyers share will be 60K then what will be the surcharge added by each individual during tds ? Is it 10% as individual share is less than 1cr or 15% as total sales value is more than 1cr ?
