Why were we required to use the Technical Orders (TO) for the smallest task in the Air Force and the VA won't do the same for rating? make them open the manual for each case...line by line
It’s easier to pencil whip everything though. Cmon man it’s the VA.

This is the absolute truth. The issue I have is it is impossible for the raters to know everything so they absolutely should be made to follow the manual to the T.

Are you saying that that the people in charge of assessing the claims for percentage rating, that 75% failed to properly apply the CFR?
When they (VBA staff) received the training to understand how to apply the changes, 75% failed the training.

I don't know why anyone would be surprised by this. Is it unsatisfactory, yes but it explains a lot.
I'm not surprised because I can't get nothing connected with all the evidence possible
I'm having this exact issue right now. I am rated 20% for my back from a Military Vehicle Accident in 2001. Been rated since 2003. Now I am trying to rate my neck as I was misguided into thinking the back was rated as a whole when in fact it is not. So the same accident, same accident report, same medical paperwork has neck on it as well as back and they said not service connected. How? This is absurd.
This is why I waited to file a pact claim. I wanted to let the Va raters get some experience messing up all the early claims before doing mine.

This does not make me feel honored, respected or "warm and fuzzy" at all! Who the heck is roping this goat anyway? It sure seems to me that there must be a whole heck of a lot of VBA employees that are being hired that are not qualified for positions, are not being trained properly and/or are not being supervised by competent supervision, to keep this huge VBA train and it's employees on the right track. All any of us veterans ask of the VBA and it's employees along with our government, is to just do your job correctly like your life depended on it, since ours did while we served, and now a lot of us feel too tired and broken mentally/physically to put up a good fight, and only ask that our claims be processed correctly, so we possibly don't have to deal with financial burdens, while we deal with mental/physical burdens due to our service.
Filed sleep apnea secondary to PTSD with a nexus. I was deferred 4 times to be denied come to find out in the decision letter they never used my nexus that ties everything together. The VA then tells me to file a supplemental and now I’m back to waiting almost going on a year from start to
Finish. Let me tell you if I worked like that I would’ve been fired or you would think that when I called it would go right back to the rater that rated me to use my nexus. I’m so pissed off and on top of that BS I filed a simple pact act claim with maybe 3pages of evidence and yet months later they can’t even rate that claim. This is a shame meanwhile they let thousands of illegals in and give them thousands no questions asked. Its a damn shame

I stopped filing anything secondary to PTSD. Sleep apnea, headaches, what else all denied. The only claim I got secondary to PTSD was erectile dysfunction.
Everything is a process and that's a good move to file a supplemental claim this way you get a increase from the day you first filed that's more money in your pocket. 😮
They only let in 161,000 illegals in Texas in 2022, and paid them $585 each for only a grand total of $94,000,000 ( million) Dollars.
Oh, and they took it from the Veterans Funds.

This year I was told by the VA that I needed to have my hips replaced just after having a X-Ray that showed arthritis. WHAT? You can get my hips replaced for arthritis pushed through the insurance? Well, we are seeing what looks like NECROSIS. What the VA didn't report EVERYTHING that was seen in the imaging (just like my Adrenal Tumor that was discovered by the VA in 2017 but not disclosed until it was reported OUTSIDE the VA in 2022. And the VA has the balls to BLACKBALL me when they are practicing politics instead of medicine.
Hell, I had both hips replaced thanks to no cartilege left in them. Should I have submitted a claim for the hips? Hey, thanks for a very clearly spoken update on this stuff.

Yep they just collect a check and deny, they denied a couple of my claims, and the evidence was right in front of them, they send me the CFR, contradicting themselves, wtf
Definitely worrisome as someone who just finished my last C&P. Filed 14 conditions, VA put in a “any additional conditions discovered on exam” clause to my examiner and we sat down for 3 hours. Probably examined for 20-25 conditions… needless to say, I’ll be waiting a bit and am pretty beat up.. hopefully they can rate me right.
I believe this report was put out by VA OIG office of Inspector General about 3 months ago, or what I read may have been the summary report back then. Thank you for your work!

VA will keep people that fail initial training as well. They will either put them back through again or put them side by side with a mentor.
This literally happened to me, with a hip surgery I had in august, from previous repairs I had in service. Had open hip at VA, took them 4 months to get me 100% from 80% and then took it away a month later. I still cannot walk
75%? That's 3 out of 4 VA workers!
And they keep hiring like crazy, VHA, and VBA training is non-existent, we have "team" meetings which are horrid, claims go through too many hands while being processed, you get a claim and have to correct the previous person's before you get to work on it and on a time limit with quotas. Also, unlimited OT makes 75% of failed VSR's TSP millionaires if they make a long career of it. ACCOUNTABILITY FOR BOTH VHA AND VBA
what qualifications are needed to become a rater? shouldn't reading be one? basic reading comprehension? obviously not.

I've seen Marines "retrained" (even 2676 Marines) and it wasn't pretty. I'm sure VBA folks were given a stern lecture though.
Annoyingly I had three knee surgeries at the VA over the past 4 years

If they fail training and are in their one year probation, they get a free ticket to the house. I can vouch for training and re-training. It seemed that’s all we did when I was there. Training on top of training. Now you got some people that are there for a pay check and could care less. But, from what I saw, those were very very few.
Well their civilians not military want do you expect.

What are some ways to obtain your DBQs from your C&P exam? I was told you can file a FOIA request but I was told by my VSO that will take 3-6 months. Is there any faster way?
I’m wondering the exact same thing, I was told maybe to fill out the FOIA and physically go to my Regional VA office.

I filed a FOIA to Janesville for a copy of my C&P exam. It took six months (outrageous), but at least I got it. They sent a CD via certified mail.
That’s how it is delivered by CD I went o my regional office Portland, Oregon and walked into the veterans assistance office and asked for it they said we will give it to you, he said it’s not n their database so they couldn’t pull them for me. File a FOIa request 6 month wait…..
Need advice. Tried my VSO but they said I’d have to make an appt but is 3 months out here in NorCal. My rep submitted a claim for my Plantar Fasciitis but as a new claim - service connected. It should have been as Secondary for Back, knee and radiculogpthy of lower extremity. I have a C&P exam next month for the claim as new - service connected. I do not have any records to support that. Should I resubmit my claim as new and as Secondary? Or will this mess up my current claim?
I'm going through a similar problem now. My VSO filed a couple of my claims wrong as Primaries instead of Secondaries. Went through the process and both were denied as they weren't looked at as Secondary conditions, even though I informed the C&P examiner of the error. I just refilled a Supplemental claim for one of my conditions (OSA) and this time I uploaded a personal statement with it explaining the initial error. Fingers crossed that this works!!
One day, probably sooner than later, raters will be replaced... by artificial intelligence.
It can be done now EASILY. I've been in a couple of HLRs due to human error. 1. human ignored DBQ check box. 2. typed DBQ key words are ignored.
Value: AI doesn't have to make excuses and apologize during HLR for low ball rating errors.

do you guys remember all the online training courses we took to be "certified" and all the safety stand down powerpoint nonsense? The same training is how the VA employees are educated, of course you can't trust the system, it is run by people just like you and me.
