I tried to get legal representation but the attorneys hesitated, primarily bc even though I had 'poor man's copyright', I wasn't registered with the US copyright office. I had a list of approx 20 infringements (lyric, title, harmony, beat... It was clear as day that I had been infringed upon but bc the attorneys would not have won that much money, they declined... Also likely bc of the fame of the other artist. (There are dollar amounts associated with copyright infringement that are essentially unable to be gained without registration with the copyright office.)

The key point here is about original content being taken based on IP and patents for original content, not race. If the idea is not patented IP content then anyone can use it as a base. I was told in college that a “Poor man’s trademark” doesn’t really stand up. However, I’ve done it. Mail 3 copies to yourself. Make sure you never open them unless you have to prove it in court. Mail a copy post marked for yourself, one to use in court and one to keep for a later date just in case.

listen up everyone: copyrights do not HAVE to be filed, they should in prep for any potential suits, but copyrighting something does NOT mean it is copyrightable/"protected". copyrights ONLY exist for TANGIBLE, ORIGINAL, works. meaning things you can TOUCH (a painting, a musical score, for eg.) NOT an idea. therefore, the moment you create something original and tangible the copyright exists. so her idea of rage baking is NOT copyrightable, but doesn't mean it doesn't suck to have an idea stolen from you. if they had used an ORIGINAL drawing from her book or something that would be a different story. in a lawsuit she would also have to show (amongst other things) that the 2 women had access to her work, because 2 people can absolutely come up with the same idea and not know about each other. the policy behind copyright law is to allow for the free flowing of ideas. also, trademarks are COMPLETELY different. they exist only for signs, designs or expressions like a company's logo. knowing this, their whole discussion doesn't make sense since you can't trademark an idea or a book. (btw my source is law school). ps: a "poor man's copyright" does not hold up in a court of law and is not substitution for registration.
You can't copyright an idea, but you can copyright the tangible product. Tangerine should have copyrighted the full work before giving it to someone to edit. To copyright a book or other item, it is only $35. Trademarking is in the thousands, however.

True story, I experienced my idea being stolen on TH-cam in 2014. TODAY, I received patent approval on the patent I filed in 2017. I've never been one short of ideas so I decided to protect my idea/invention before releasing anything online again. I met with over 20 attorneys who said my product wasn't patentable. I didn't believe them. The 21st attorney said there are guarantees but I'll take the chance if you will because clearly you will not stop! Today I received notice from my attorney of my full patent approval, on the 1st try. Less than 3% of patents receive approval on the 1st try. I didn't really receive feedback or help from the program to implement my idea. Later found out that the manager had tried to use my idea for himself but hadn't been able to get it off the ground. Moral: Be sure you know the people you share your ideas with.

No. I'm quite sure that Instagram has something under their "Terms and Conditions" that intellectual property posted on their site belongs to them or something equally shady. I don't post any non-trademarked or copyrighted materials on that site for that very reason!

I was told in college that a “Poor man’s trademark” doesn’t really stand up. However, I’ve done it. Mail 3 copies to yourself. Make sure you never open them unless you have to prove it in court. Mail a copy post marked for yourself, one to use in court and one to keep for a later date just in case.

listen up everyone: copyrights do not HAVE to be filed, they should in prep for any potential suits, but copyrighting something does NOT mean it is copyrightable/"protected". copyrights ONLY exist for TANGIBLE, ORIGINAL, works. meaning things you can TOUCH (a painting, a musical score, for eg.) NOT an idea. therefore, the moment you create something original and tangible the copyright exists. so her idea of rage baking is NOT copyrightable, but doesn't mean it doesn't suck to have an idea stolen from you. if they had used an ORIGINAL drawing from her book or something that would be a different story. in a lawsuit she would also have to show (amongst other things) that the 2 women had access to her work, because 2 people can absolutely come up with the same idea and not know about each other. the policy behind copyright law is to allow for the free flowing of ideas. also, trademarks are COMPLETELY different. they exist only for signs, designs or expressions like a company's logo. knowing this, their whole discussion doesn't make sense since you can't trademark an idea or a book. (btw my source is law school).
ps: a "poor man's copyright" does not hold up in a court of law and is not substitution for registration.
You can't copyright an idea, but you can copyright the tangible product. Tangerine should have copyrighted the full work before giving it to someone to edit. To copyright a book or other item, it is only $35. Trademarking is in the thousands, however.
The term "Rage Baking" could have been trademarked if that was part of her brand and her business. I've been through the process of trademarking a name.

This means that you have legal recourse to sue for copyright infringement.

George Vozary explains that). if she wrote the recipes in a CREATIVE/original way, like in the form of a poem, then THAT can be protected. the layout, if original, would also be protected. but she must also show that the 2 women had access to her book, read it, and copied those protected parts (not the recipes themselves), she's going to have a hard time. so copyrighting is a great idea, but it's not where the fight ends.

True story, I experienced my idea being stolen on TH-cam in 2014. TODAY, I received patent approval on the patent I filed in 2017.
I've never been one short of ideas so I decided to protect my idea/invention before releasing anything online again. I met with over 20 attorneys who said my product wasn't patentable. I didn't believe them. The 21st attorney said there are guarantees but I'll take the chance if you will because clearly you will not stop!
Today I received notice from my attorney of my full patent approval, on the 1st try. Less than 3% of patents receive approval on the 1st try. I'm working out manufacturing kinks, but in the next few months the Effortless Braiding system that teaches inexperienced men & women to cornrow is less than 15mins will be released. Protect your ideas, even if you never make money you can credit yourself as an inventor!

I had this happen to me. I went to an entrepreneurship program, shared my idea, wrote my business plan and submitted it for review. I didn't really receive feedback or help from the program to implement my idea. Later found out that the manager had tried to use my idea for himself but hadn't been able to get it off the ground.
Moral: Be sure you know the people you share your ideas with.

I'm not a lawyer and know, for sure, mailing something to yourself is not a trademark. Also, you don't need a lawyer to file a trademark. It's suggested that you get one, but little ol' me successfully filed one by myself. About to trademark something else by myself as well.
